Fresent:*Mayok Powell M.Rhea,City-.Clerk J.W.MeGehee, City Attorney Price Dicljson, City Engineer'Carl Smith, and Aldermen; Feathers,McGoodwin, Bole, Williams, Kincaid, White end Kent. Absent: Alderman Richardson. Minutes of the regular meeting of August 8th, were read and approved. It this time the bids for the contract of installing the Boiler at the City Hospital were I pened, with the following result: Shirley & Smn .... $2,179,00 Shirley & Son Duggans Plumbing Co 2,231.58 awarded contract Johnson'Plumbing Co. 29375.00 Fayetteville Plumbing'Co 2,492.87 Alderman White made a motion that Shirley % Son be awarded the contract on the low bid o $2,179.009••and that the Mayor -and City Clerk be authorized to sign the contract, this motion was seconded by Aderman Feathers, and was passed.unanimously by the Council. Patl Young Architect Alderman White, member of the Hospital Committee,reported tgbat the Committee had for Hoop gone Over the Contract submitted by Paul Ias Ardhitect for the City Hospital, and it was the recommendation of the committees a 1.Young be employedy and made a mojiion that'the recomendation be approved and the Mayor and City Clerk be authorized to sign the contract, this motioffi was seconded by Alderman Kincaid, and was passed unanimo*sly Protest by the Council* disposal of quite a number of citizens living in the vicinity of the proposed site garbage or the unloading and feeding of the CITY GARBAGE appeared before the Council to..pretest;: the:l6oation,of-6a1.d site, and after discussion, Alderman Feathers made a motion that action on the protests be postponed till an adjourned meeting oa the City Council Thursds August 18th, at 8 OtClock, P.M. This motion was seconded^by Alderman Williams, and was passedc:unanimoysly by the Council; ALDERMAN BOHE introduced an Ordinance entitled It AN ORDINANCE ESTABLISHING TREET IMPROVEMENT DISTRICT NO. 56 OF THE CITY OF FAYETTEVILLE# WASHINGTON COUNTY, ARKAN AS. The Ordinance was read in its emtirety by the Clerk, Aldertyan Feathers m motion that•the rulesxbe suspended and the Ordinance placed on its second reading, thi otion was seonded by Alderman Williams, and was passed unanimously by the Council. The Clerk then read the Ordinance the second time, and after discussion, Alderman Williams made a motion that the rules be further suspended and the Ordinance placed on its third and final reading,-ihis motion was seconded by Alderman Feathers, and was pass unanimously by the Council. The Clerk then read the Ordinance the third and final time. The Mayor then•put the question 't Shall the Ordinance pass?' and on roll call by the Clerk, the following vote resulted; Ayes: Feathers, McGoodwin, Bohe, Williams, Kincaid, White and Kent. Nays :None. Absent and not voting Richardson• And the Mayor declared the Ordinance passed, as there were 7 Ayes, and no Nays Alderman White made a motion that the emergency clause be adopted, this motio was seconded by Aldermam Feathers, and on roll call by the Clerk, the following vote resulted; Ayes: Feathers, McGoodwin, Bohe, Williams, Kincaid, White and Kente Nays:None. Absent and not voting: Richards&n* and the Mayob declared the Ordinance passed, as there were 7 Ayes, and no Nays• ORDINANCE NO 9 -5 -2 - AN ORDINANCE CREATING A CIVIL SERVICE COMMISSION TO BE KNOWN AS.THE CIVIL SERV COMMISSION FOR THE POLICE AND FIRE DEPARTMENTS OF THE CITY OF FAYETTEVILLEs ARKANSAS, AND FOR .OTHER PURPOSES & WHEREAS, Act 326 of the Acts of Arkansas for the year 1949r;require cities -,.-of the first class now having a Civil Service System to enact an ordinance naming five uprig and intelligent citizens of the City of Fayetteville to be known and designated as a boar of Civil Service Commissioners for the Police and.Fire Departments of the City of Fayette Villas Arkansas: NOW,THEREFORE, BE IT ORDAINED BY THE CITY OF FAYETTEVILLE,ARKANSAS: Section 1. There is hereby created a Board of Civil Service Commissioners fo the Police an re epart ments of the City of Fayetteville, Arkansas and r, Jr ; V.E.Russum , a/ Hal Douglass , and Jack Phillips are hereby named as a Board of Civil Service Commissioners for said police and fire departments whose ter shall normally expire on the first Monday in April of 1952, 1954, 1956, 1958 and 1960 ri spectively. ORDINANCE NO 9-5-3- AN ORDINANCE PROVIDING.FOR THE PROMULGATION OF RULES AND REGULATIONS GOVERNING TH WATER DEPARTMENT OF THE CITY OF FAYETTEVILLE, ARKANSAS, PRF�SCRIBING PENALTIES FOR T'E VIO* CATIONS OF SUCH RULES AND REGULATIONS, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH, AND FOR OTHER PURPOSES& BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF-FAYETTEVILLE, ARKANSAS: Section le The Superintendaut of the City Water Plant of the City of Fayetteville, rkansas s ere y authorized to.prepare such rules -and regulations in connection with the aintemance, operation, rep air,extension, tapping ofmains, size of mains, and all other matters ad things in connection with the operation of the City Water Plant of the City, of Fayette- ille, Arkansas as to him shall seem.proper, necessary or expedient. Upon the preperation of such rules and regulations as_herein providedsthey shall e submitted to the City Counoil.of the.City of Fayetteville, Arkansas and upon approval by he City Council of the City of Fayettdville, Arkansas either by motion or resolutions.such ales and regulations shall govern the water department operations as therein provided and hall repeal all rules, regulations or ordinances in conflict therewith. Any person, firm or corporation violating any of the rules and regula- ions of t e� Cify nater Plant of the City of Fayetteville, Arkansas prepared and adopted s herein provided shall be deemed guilty of a misdemeanor and upon conviction thereof shell = e fined in any sum not exceeding One Hundred ($100.00) Dollars and each day of such violi- ion shall be considered a separate offense. Section 4. AN ORDINANCE REGULATING THE HANGING OF SIGNS EXPENDING OVER SIDEWALKS OF THE• IT Y OF FAYETTEVILLE, ARKANSAS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND FOR THER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIB OF THE CPYY OF FAYEEFEVILE, ARKANSAS: Section 1. It shall be unlawful for any person, fmrm or corporation to erect, ruct, ma n n or hang from any building or any other support any sign hanging or ding ober the sidewalks of the City of FayettevilloiArkansas unless such persAn, or corporation shall have first complied with the provisions hereinafter set forth. S8oti6n1,. Any 2person, firm or corporation who may desire to erect or maintain ny sign �axen31ng over or across any side walk or street in the City og Fayetteville, rkansas extending more than eighteen inches from the building to which it is attached or xtending more than eighteen inches over any side walk if not attached to a building,shal ubmit to the City Engineer of the City of Fayetteville, Arkansas ari application for a ermit to erect or maintain such sign, together with the design anti specifications showin he size and construction of such sign and the matter to appear thereon. If said City Engineer approves such application, design and specifications, h hallendorse thereon his approval and the applicant shallthen present said application so ndorsed by the City Engineer to the City Clerk of the City of Fayetteville,Arkansas, who hall issue a permit on condition that the work b.e.done under the supervision and inspeo- ion of the City Engineer or his duly Authorized representative, provided that the appli- ant shall par for said permit and rose action the sum of Two Dollars and Fifty Cents $2.50) which shall be a prerequisite,_to the Issuanoe of such permits. Section 3. All signs provided for under Section 2 hereof shall be of metal con truction o=cent strength to insure the safety df the public and the method of ttachment of said sign as well as the height from the sidewalk or street level as the ase may be, shall also be of construction such as to insure the safety of the public nd to that end the City Engineer shall require the applicant to show the method of uspending or hanging of said sign,the height above the sidewalk or street level and such ther i0formation with respect to said sign as is necessary to determine that its install tion will not endanger the public. Section 4. Electric Signs shall be of such design. -;and materials as may be by engineer. Section 5.
