(Fayetteville City Council met in a called session,Wednesday,July 7, 1949. + iresent: Mayor Powell M.Rhea, City Clerk J.W.McGehee, City Attorney Price Dickson,and Aldir - en; Richardsmn, Feathers, McGoodwin, Bohe, Williams, Kincaid, White and Kent. The Mayor stated that the meeti.gg had been called for the purpose of considering Paul the resignation of Paul Jameson as Municipal Judge and the filling'of the vacancy caused by Jameson the resignation, also, to ask the Council to approve the closing of the purchase of 3 pieces of resigns propertyfor the use of the Lake Project, after discussion, Alderman Feathers made a motion that .as it be made a general meeting for the consideration of any business that might come up, and M=Judge that the Councilmen waive notice of a CALLED MEETING, this motion was seconded by Aldergan Williams, and was passed unanimously by the Councils A PETITION, signed by Maude C.Rogers, Julia Ann Rogers, Wm.R.Rogers, Willis Petition Noll and Geo.A.Handy--was presented, requesting permission to lay a 6 inch Sewer line along to lay Assembly Drive and ERst Maple Street, copy of Petition is as follows: Sewer Line PETITION Comes Maude C.Rogers, Julia Ann Rogers, Wm.R.Rogers,Willis Noll and Geo.Ae andy, hereinafter known and designated as the Owner, and for their.petition herein, state: ghat they are the owners of certain real property situated in said City, which cls not sekved by the present sewer system, and that they desire to construct, own, use and maintain a sewer system, to be connected with the sewer system of said City, for the benefit of their said groperty That they have prepared and herewith submit the plans and specifications for the laying of six (6) inch sewer line and constructing brick manholes, which have been I by the City Engineer of said City, which plans and specificatiAns show the location, I all other pertinent data and information concerning the proposed construction.' That it is necessary to use the -right of way of Assembly Drive and East aple Street in said City for the purpose :of haying and maintaining said system,and they ereby request that they be granted permissimn to lay and maintain a private sewer system n and over the right of way of Assembly Drive and East Maple Street in said City, and hat said permission to lay and construct said.sewer be continuous for a period of six onths from the date of the granting thereof, and that said period of ownership and the r o -maintain said sewer be continuous for a period of not exceeding fifteen years from my 1st, 1949. Alderman Feathers made a motion that the request be granted subject to the approval of the State Board Of Health,'this motion was seconded by Alderman White and was passed unanimously by the Council; Alderman Williams made a motion that the Mayor be authormzed to close als with three parties for land in the lake site area, Viz.: Geo.W.Linglebach 22 acres fo: 3,000.00, Harvey H.Wilkinson for lo5 acres @ $30,000.00 and B.B.Brogden 60 acres @ 030,01 is motion was seconded by Alderman Feathers and on roll call by the Clerk; the following to resulted; Ayes: Richardson, Feathers, Bohe,'Williams, Kincaid and Kent. And the Mayor declared the motion passed, as there were 6 Ayes and 2 Nays Alderman Feathers made a motion that the Mayor be authorized to continue gotiations for two othertracts of land belonging to Mr Ivey and Mr Sanders, this motion conded by Alderman Williams, and was pass ed:':u$animously by. the Council•' .00, 2.1 Postpone Che question of filling the office of Municipal Judge caused by the resignation of action Paul Jameson, came up for consideraVion, and after discussion, City Attorney Price Dicks on �equested the Council to postpone action on the matter, till he could get an opinion froi M.Judge the Attorney General,Alderman Richardson made a motion to postpone action on the vacancy till the regular meeting, July 11th, this motion was seconded by Alderman Bohe, and on roll call by the Clerk,'the following vote was recorded; Ayesi Richardson, Feathers, Boh I{incaid, White and Kent-. Nays: McGoodwin and Williams. And the Mayor declared the motion passed, as there were 6 Ayes, and 2 Nays. Vere being no further business, Alderman McGoodwin moved to adjourn, second Alderman Kincaid, which was passed unanimously by the Council, and the Mayor declared Council adjourned. NAYS: Feathers and White. And the Mayor declared the motion passed, as there we 6 Ayes, and 2 Nays.
