Minutes of the regular medting of March 21st, were read and approved.

Alderman Williams made a motion that the bills be allowed as approved, seconded by

Diiokson on the South side of Dickson Street to run fifty (5n) feet East from Gregson Hall, and a
NO PARKING. ZONE" be established on the west side of Garland Avenue to run eighty l(80)
Garland feet North from the south line of Dickson Street, and a "NO PARKING"ZONE be estabished
on the Fast side of Garland Avenue to run fifty (50) feet North from the North line of
Dickson Street, this motion was seconded by Alderman Feathers, and was passed unanimously

a contract -to operate its telephone.systen for a•period of five (5) years, and.for other purpo
T�,e Ordinance was read in its entirety by the Clerk,and Alderman White made a motion that
tine rules be suspended.and the Ordinance placed om its second reading, this motion was sec-
onded by Alderman Gray, and was passed unanimously by the Council*
'llhe Clerk then read the Ordinance the second time, and after discussion, Alderman Whitfield
made a motion that the rules be further suspended and the Ordinance placed on its third
I final reading,this motion was seconded by Alderman White, and was passed unanimously
by the Council.

The Mayor then put the question " Shall the Ordinance pass?", and on roll call -by the Clerk,

An ordinance whereby the City of Fayetteville of the State of Arkans!is and the
Southwestern Bell Telephone Coiapany, assour orpora ion, agree that the.Telepb ne Company
shall continue to operate its 'telephone system and all business incidental to or connected with
the conducting of a telephone business and'system in said•City, and erect and maintftin itis plant
construction and appurtenances along, across, bn, over; through, above, -and under all public
streets, avenues, alleys, public grounds and places in said City, that the City shall. receive an
I payment from the telephone company, and repealing all ordinances and agreements ii conflict

Be it •ordained by the City Council of' the City of Fayetteville of the State of Arkan1sas
That:
SECTION 1. The Southwestern Bell Telephone Company, its successors and assigns (herlin re-
ferreafo as Telephone Company") shall continue to operate its telephone system and all. 1business
incidental to or connected with the conducting of a telephone business and system in the City
I Fayetteville, State of Arkansas, (1•ierein referred to as "City"). The plant construction and
appur enhances used in or incfden�-to the giving of .telephone service and to the maintenance of a
telephone business and system by the Telephone Company in- said City shall remain as now constructed,
subject to such .changes as may be considered necessary by the City in the exercise of its inherent
powers and by the Telephone Company in the. conduct 'of its, business, and said Telephone Company
shall continue to exercise its right to,place, remove, construct and reconstruct, extend land main-
iain its said plant and appurtenances as the business and - purposes for which it is or may be in-
corporated may, from time to thne require, along, across,-on,over, through, above and under all the
public streets, avenues, alleys, and the public grounds and places within the ,limits of said City
s the same from time to time 'may be established. •
SECTION 2. The Telephone Company shall pay the .City *the sum of $2500.nn on the 1st day Cr
July, or the period July 1, 1949 to June 3n, 195h, --inclusive, an��ike sum annsall_y
erea er for a like period on'TFiest. day o u y 5 ,1951,1952, and 1953 , being a term oP
5 years ending June 3n ,1954 ; said payments.to e�"ini eieU o a other liaerises, charges; fees
or impositipns(o er than e'usual general or special ad valorem taxes) which might be imposed
py the City under Authority conferred by law, the Telephone Company shall have the privilege of
crediting such sums with any.tinpaid balance due said Company for -Telephone Service rendered or
facilities furnished to said City.
SECTION 3. The Telephone'Compariy on the request of any person shall remove or raiselor lower
its w rei s e�orarily to permit the moving of houses or other structures. The expense o� amch
temporary removal, raising or'lowering of wires shall be paid by the party or parties requesting
the same, and the Telephone Company may r.equir.e..such.payment in advance. The Telephone Company
shall be given not less.than forty-eight hours advance notice to arrange for such temporary wire

SECTION 4. Permission is hereby granted to the Telephone Company to trim trees uponland over-
anging s r�eeis, alleys, sidewalks and public places of said City so as to prevent the branches
f such trees from coming in contact with the wires and cables,ef•the Telephone Company,lall the
aid trimming to be done under the supervision and direction of any City official.to whom said
uties have been or may be delegated.
SECTION 5. Nothing in this Ordinance contained shall be construed to require or permit any
electr=c Tagg=or power wire attachments by the City or for the City. If light -or powerlattach.
ments are desired by ,the City. or for the. City, then a separate non -contingent agreement shall be .
g prerequisite to such. attachments.
SECTION 6. Nothing herein contained shall be construed as giving to the Telephone Company any
-exclus vi a privileges, nor shall it affect any prior or existing rights of the Telephone Company to
Iintair a telephone system witiv+nthe City.
SECTION 7. All other ordinances and agreements and parts of ordinances and agreements relating
to the opperating of -or right to operate a telephone system within said City are hereby repeafed.
SECTION 8. The said Telephone Company shall have sixty (60) days from and after its

nd approva o file its written acceptance of this ordinance with the City Clerk, and upon such
ceeptance being filed, this ordinance shall be considered as taking effect and being in force
rom and after the date of.its passage and approval by the Mayor.

7:30 P.M'., this motion was seconded by Alderman Feathers, and was passed unanimously by
