ORDINANCE NUMBER 9-3-80
ORDINANCE ACCEPTING THE DEDICATION OF ALL STREETS AND ALLEYS IN THE REPLAT
OF SMITH'S ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS.
'J/HEREAS, the streets and alleys in Smith's Addition to the City of Fayette
ville,•Arkansas;•were not dedicated at the time of the filing of the plat of said additio
and that the City of Fayetteville is desirous of placing a larger water line for the use
and benefit of the owners of said addition,it has become primarily suitable and desirabl
to replat said addition, henceforth to be called a replat of Smith's Addition to the Cit
of Fayetteville, Arkansas, and to dedicate said streets and alleys for the use and benef
of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVIL
Section 1. The dedication of the streets and alleys for the use and benefit
of the public to the replat of Smith's Addition to the City of Fayettreville be and is
hereby accepted.

Alderman Hale introduced the following Resolution, amd moved
its adoption, seconded by Alderman Gray, which was passed unanimously by the Council:
RESOLUTION
RESOLVED: That the City of Fayetteville agrees to a waivervof the removal pro-
visions of Section 313 of the Lanham Act insofar'as it applies to housing transferred
by the Public Housing Administration to thH University of Arkansas*
Alderman Feathers made a motion that Swofford and Company be requested to
make a five year audit of the Plater Department, more clearly showing just what amount
was spent for operating expenses, and what amount spent for Capital investment, and for
the City Attorney to be ready to report at the next regular meeting of the City Council,
as. to what the next step would'be in getting ready for the sale of the Bonds for the Via'
Department, this motion was seconded by Alderman Hale, and was passed unanimously by th(
Counc il•;
�e Mayor reported•that McClinton Bros* had submitted -a bid of $98,008909
for the Construction work to be done at the Airport, invitation for bids for said work
had been duly advertised in the NORTHWEST ARKANSAS TIMES -p and had been opened at 2 0'C1(
July 19th, Alderman Williams made a moyion that the Council recommend the acceptance of
tEe bid to C.A.A., this'motion'was seconded by Alderman Harlan, and was passed unanimos:

Present: Mayor G.T.Snders, City Clerk J.W.McGehee, City Attdrney Price, Dickson, City

Alderman Whitfield introduced an Ordinance, entitled " AN ORDINANCE RUTH(
IZING THE CITY WATER PLANT OF THE CITY OF FAYETTEVILLE, ARKANSAS TO BORROW ONE HUNDRED
THOUSAND DOLLARS ($100,000) for the purpose of purchasing equipment, supplies, extendinE
and enlarging the water system of the City of Fayetteville and improving fire protection
pledging revenues and providing for repayment of said indebtedness and for other purpose
The Ordinance was read in its entirety by the Clerk, alderman Whitfiele
made a motion that the rules be suspended, and the Ordinance placed on its second reads
this motion was sec6nded by Alderman Gray,and was passed unanimously by the Council.
The Clerk then read the Ordinance the second time, and after discussie
Alderman ?"Whitfield made a motion that the rules be further suspended and the Ordinance
placed on Lys third and final reading, this motion was seconded by Alderman Williams, a
was passed unanimously by the Council.
The Clerk then read the Ordinance the third and final time.
'Phe Mayor then put the question " Shall the Ordinance pass"?, and 'on roll call by the
Clerk,•the following vote was recorded; Ayes: Hale, Feathers, Bohe, Williams, Whitfield,
1Jhite'and Gray. Nays:None. Absent and not voting :Alderman Harlan. And the Mayor declare
the Ordinance passed, as there were 7 Ayes, and no Plays.
Alderman Hale made a motion that the emergency clause be adopyed, this motion
was seconded by Alderman Gray, and on roll call by the Clerk, the following vote rias rs
recorded; Ayes: Hale, Feathers, Bohe, Williams, Whitfield, White and Gray; Nays: None.

adopted, as there were 7 Ayes, and No Nays.

ORDINANCE NUMBER 939.
AN ORDINANCE AUTHORIZING THE CITY WATER PLANT OF THE CITY OF FAYETTEVILLE,
RKANSAS TO BOHROW ONE HUNDRED THOUSAND DOLLARS($100,000) FOR THE PURPOSE OF PURCHASING
OUIPMENT, SUPPLIES, EXTENDING AND ENLARGING THE WATER SYSTEM OF THE CITY OF FAYETTEVILL
PND IMPROVING THE FIRE PROTECTION; PLEDGING REVENUES AND PROVIDING FOR REPAYMENT OF SAID
)INDEBTEDNESS AND FOR OTHER PURPOSES.
SECTION 2. The Mayor and City Clerk are hereby.authorized to execute a note
or notes evidencing said indebtedness which shall be payable solely out of revenues of
said water plant; which note or notes shall bear interest 'from date of execttion until
paid at the rate of 4% per annum, with interest computed on unpaid balances, aggregate
mrincipal-and interest payment.to be in the sum of Four Thousand Dollars ($4,000.)per
onth, beginning on the 10th day of the fifth month after execution of said note or notes
ind continuing until the entire amount of principal and interest shall be paid in full ,
ith the right reserved by said Water Plant to pay any part. or all of said indebtedness
