Fayetteville City Council met in regular session, Monday, June 14th, 1948.
Present: Mayor G.T.Sanders, City Attorney Price Dickson, City Engineer E.T!3rown,
apd Aldermen; Hale, Feathers, Harlan, Bohe, Whitfield, White and Gray. Absent: Alderman
Williams. -
T�e absence of City Clerk J.W.McG$hee was noted, and the Mayor Appointed City Attorney
Price Dickson to act as City Clerk.

Aaderman Gray made a motion that the brills be allowed as approved, seconded by Alderman
Mite, which was passed unanimously bar the Council.
An 6rdimance entitled AN ORDINANCE ABANDONING A PORTION OF SUMMIT STREET DESCRI
AS RUNNING NORTH AND SOUTH AIM BEING SEVENTY FEET (70) WIDE BETWEEN LOTS 1,2 and 3 IN
BLOCK 4 AND LOTS I, 2 and 3 IN BLOCK 3 IN MCILROY'S ADDITION TO THE CITY OF FAYETTEVILL
SAID ADDITION BEING A REPLAT OF LOTS 2 and 3 OF BLOCK II OF MASONIC ADDITION TO THE CI
OF FAYBTTEVILLE, ARKANSAS AS SHOWN AND ON FILE IN THE OFFICE OF THE CIRCUIT CLERK AND
EX OFFICIO RECORDER; OF WASHINGTON COUNTY, ARKANSAS., was introduced by Alderman Bohe.
The Ordinance was read in its entirety by the Clerk, Alderman White made a m
that the rules be suspended and the Ordinance placed on its second reading,this:.motion
was seconded by Alderman Harlan and was passed unanimously by the Counell.
The Clerk then read the Ordinance the second time, and after discussion,
Alderman Gray made a motion that the rules be further suspended and the Ordinance place
on iys third and final reading, this motion was seconded by alderman 'White, and was pas
unanimously by the Council.
The Clerk then read the Ordinance the third and final time.
The Mayor then put the question "Shall the Ordinance pass"?, and on roll call by the
Clerk, the following vote was receorded; Ayes: Hale,r•eathers, Harlan, Bohe, Whitfield,
White and Gray. Nays:None. .Absent and not voting: Williams. And the Mayor declared the
Ordinance passed, as there were 7 Ayes, and no Nays.
Alderman moray made a motion that the emergency clause be Apted, seconded by
Alderman Whitfield, and on roll call by the Clerk, the folloising vote was recorded,
Ayes: Hale, Feathers, Harlan, Bohe, Whitfield, White, s.nd Gray. Nays:None. Absent and
not voting: Williams. And the Mayor declared the emergency clause adopted* as there wer
7 ayes, and no nays.

ORDINANCE ABANDONING A PORTION OF SUMMIT STREET DESCRIBED AS RUNNING NORTH APID SOUTH AND
BEING SEVENTY FEET (70) WIDE BETWEEN LOTS 1, 2 and 3 IN BLOCK 4 ATID LOTS 1, 2 and 3 IN
BLOCK 3 IN McILROY'S ADDITION TO THE CITY (F FAYETTEV.ILLE, SAID 'ADDITION BEING A REPLAT
OF LOPS 2 and 3 OF BLOCK 17. OF MASONIC ADDITION TO THE *CITY OF FAYETTE'✓ILLE, ARKANSAS
AS SHOWN AND .07' . FILE IPI THE OFFICE OF THE CIRCUIT CLERK AND EX -OFFICIO RECORDER CF
WASHINGTON COUNTY, ARKANSAS.
WHEREAS, a petition was duly filed with the City Council of the City of Fayettevi
Arkansas, on the 17th day of May, 1948, asking the Cit -y Council to vacate and abandon
all that portion of Summit Street described as running .North and South and being sevetty
(70) feet wide between Lots 1, 2 and 3, in Block 4, and -Lots 1•, 2 and 3 in Block 3 in
WcIlrov's Addition to the'City of Fayetteville, said addition being a repint of Lots 2
and 3. of Block 11 of Masonic Addition to the City of Fayetteville, Arkansas as shown and
on file in the office of the Circuit Clerk and Ex -Officio Recorder of Washington County,
Arkansas, and
WHEREAS, after due notices as required by law, the Council has, at the time and
place mentioned in the notice, heard all persons desiring to be heard on the question
and has ascertained that the street or the portion thereof, hereinabove described, has
heretofore been dedicated'to the Public use as a street -herein described; has not been
actually used by the public generally for a period of at least five yenrs subsequent
to the filing of the plat•; that all the owners of the property abutting upon the portion
of the street to be vacated have filed with the Council -their written consent to such
abandonment; and that public interest and welfare will not be adversely affected by the
abandonment of such street.
NOW THEREFORE, BE IT ORDAINED BY THF. CITY COUNCIL OF THE CITY OF FA=TEVILLF•:
Section 1. The City of Favetteville, Arkansas,•hereby releases, vacates and
abandons all its rights, together with the rights of the public generally in and to the
street designated as follows:
That portion of Summit Street described as.running North and South and
being seventy (70') feet wide between Lots 1, 21•and 3 in Block 4, and
Lots 1, 2 and 3 in Block 3 in McIlroy's Addition to the City of Fayetteville,
said addition being a replat of Lots 2 and 3 in -Block 3.1 of Masonic Addition
to the City of Fayetteville, Arkansas as shown and on file in the office
of the Circuit Clerk and Ex -officio Recorder of* Washington County, Arkansas.
Section 2. A copy of the ordinance duly certified by the City Clerk shall be
'iled in the office of the recorder of the county and recorded- in the deed records of
:he county. I•
Section 3. This ordinance shall be in full force and effect from and after its
