Water Alderman Hale, Chairman of the Water Committee, presented the March report. report of the Water Department, Alderman Whitfield made a motion that the report be received and filed, seconded by Alderman Adkisson, which was passed unanimously by the Council. ' :n crease I Alderman Whitfield, chairman of the Fmnance committee, reported that the n Mayor and Finance Committee had made a study of the request of City Employees for an in- alaries crease in salary, and recommended that a $5.00 increase per month be granted to all patrolmen end all of the regular paid Firemen, also,Police Chief, Foreman of the Sanitation Depart rent end the Street Foreman also, the 2 erpployees of the Parking meter Dppartment, and three cents per hour to all other employees of the Sanitation and Street D partmenta, Alderman Hale made a motion that the recommendations be approved,to be effective April lst,1948, this motion was seconded by Alderman Williams, and was passed unanimously by the Council* a 169 lderman-5ray introduced an Ordinance entitled " AN ORDINANCE FIXING THE SALARY OF THE ITY ATTORNEY, PRESCRIBING HIS DUTIES, AUTHORIZING THE APPOINTMENT OF AN ASSISTANT AND OR OTHER PURPOSES." a The Ordinance was read in its entirety by the Clerk,and Alderman Adkisson ade a motion that the rules be suspended and the Ordinance placed on its second reading his motion was seconded by Alderman Williams, and was passed unanimously by the Council Toe Clerk then read the Ordinance the second time, and after discussion, %lderman Hale made a motion that the rules be fubther suspended and the Ordinance placed in its third and final reading, this motion was seconded by Alderman Tray, and was passe lananimously by the Council. r The Clerk then read the Ordinance the third and final time. Ehhe Mayor then put the question "Shall the Ordince pass'?, and on roll call by the @lerk, the following vote was recorded; Ayes: hale, Adkisson, Harlan, Bohe, Williams, flhitfield, white and Gray. Nays: None. And the Mayor declared the Ordinance passed, as there were 8 Ayes, and no Nays• Alderman Gray made a motion that the emergency clause be adopted, seconded by Alderman Adkisson, and'on roll call by the Clerk, the following vote was recorded; byes: Hale, Adkisson, Harlan, Bohe, Williams, Whitfield, white amd Gray* Nays: None* bnd the Mayor declared the emergency clause adopted, asthere were 8 Ayes, and no Nays• ORDINANCE NU1%!BER 9-3-2. AN ORDINANCE FIXINZ THE SALARY OF THE CITY ATTORNEY, PRESCRIBING HIS DUTIES IZING THE APPOINTMENT OF N ASSISTANT AND FOR OTHER PURPOSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE•CITY OF FAYETTEVILLE, ARKANSAS: SECTION I. The City Attorney shall receive one hundred dollars ($100.00) per onth for which he shall perform the following duties: he shall act as the legal advisor o the Mayor, members of the City Council, and prepare ordinances, resolutions, contract nd all other legal documents; the Police and Fire Departments, the Civil Service Com_ ission, the City Clerk and the City Treasurer And�the.City Health Department; he shall rosecute violations of City Ordinances in the Municipal Court, the Circuit Court and th upreme Court of Arkansas,* he shall advise and represent the Board of Health and the Cit ealth Officer;he shall perform all other and further legal duties, except as provided n Section 11, hereof. SECTION 11. The City Attorney shall not be required, nor shall it be a part of his duties to represent the Sewer Committee, the City Water Plant or any of its proj- ects or activities, the Municipal Airport or any of its projects or activities; nor any Euties in connection with any Bond issues whether revenue or ad valorem, or any projects (financed in whole Ior in part by the proceeds of such bonds; nor any Municipal Improve- ment District. SECTION 111. The City Attorney may appoint one assistant City Attorney who shall act under the direction of the City Attorney and shall perform such duties as the City Attorney may direct, but in'.the event the City Attorney elects to appoint an as- sistant, the City of Fayetteville shall pay no salary other than that provided in Sectio 1 of this Ordinance. SECTION 1V. All ordinances or parts of ordinances in conflict herewith are thereby repealed. And it appearing that a new term will soon begin for the City Attorney end that his salary and duties should be fixed and defined to be effective when he (takes office, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after April 6, 1948.
