ORDINANCE ABANDONING THE EAST 162 FEET 114 INCHES OF THE EAST -WEST ALLEY IN BLOCK 18 OF THE PLAT OF THE ORIGINAL TOWN OF FAYETTEVILLE, ARKANSAS. ° WHEREAS, a petition was duly filed with the City,Council of the City of Fayettevil Arkansas, on the 28th day of April, 1947, asking the City Council,to vacate and aban- don all that portion'of the alley designated on the plat of the original Town of Fayetteville now appearing of record in Plat Record, Page 2, in the office of the Recorder of Washington County, and WHEREAS, after due notices as required by law, the Council has, at the time and place mentioned in the notice,.heard all persons desiring to be heard on the question and has ascertained that the alley or the portion thereof, hereinbefore described, has heretofore been dedicated to the Public use as..,an alley herein described has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abut- ting upon the portion of the alley to be vacated have filed with the Council their written consent to such abandonment, and that public interest and welfare will not be adversely affected by the abandonment of such street. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE: Section 1. The City of Fayetteville, Arkansas; hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the alley designated as follows: The East 162 feet 11; inches of the East-West alley in Block 18 of the plat of the original Town of Fayetteville, Arkansas Section 2. A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of the county and recorded in the deed records of the county. Section 3. Absent and not voting: Hale. nd the Mayor declared the motion passed, as there were 6Ayes, and 1 Nay; Alderman Adkisson made a motion that the Council recommend to the Civil Servic ommittee, that they certify all the employees of .the Police and Fire Departments who ha een employed by their respective departments for at least 6 months, this motion was sec y alderman Williams, and was passed unanimously by the Council'. Tre Mayor stated that M.Silverman had requested the City to pay 10.00 per' onth for parking 5 trucks on his lots, after discussion, alderman Adkisson made a motio hat the Mayor be authorized to make acontract with Mr Silverman at not to exceed $10.00 ler month, this motion was seconded by alderman White, and was passed unanimously by the ouncil. The mayor reported the arrival of 3 more traffic lights, and said if there as no objection, he would have them installed at the following locations: NORTH Fz COLLE iILLOW & LAFAYETTE and WEST & LAFAYETTE, there being no objection,the Mayor stated he wo gave them installed at the above mentioned locations. Alderman Bohe introduced an Ordinance entitled "' AN ORDINANCE AUTHORIZLdTG EXHIBITI%TS OF CARNIVALS WITHIN CERTAIN ZONES OF THE CITY OF FAYETTEVOLLE, PROVIDL^TG LICENSE FEES OR PERMITS, REPEALING ALL CONFLICTING ORDINANCES, AND FCR OTHER PURPOSES*" The Ordinance was read in its entiretyby the Clerk, alderman White mad motion•that the rules be suspended, and the Ordinancplaced on its second reading, this motion was seconded by alderman_ IYhitfield, and 1r!as passed unanimously by the Council. The Clerk then read the Ordinance the second time; and after discussior. q.lderman Whitfield made a motion that the rules.be further suspended and tho Ordinance placed on,its third and final reading, this motion was seconded by alderman 1,11hite, and v passed unanimously by the Council. The Clerk then read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass"?, and on roll call by the Cif the following vote Iwas recorded; Ayes: Adkisson, Harlan, Bohe, Williams, Whitfield, Whit and Gray. Nays None. Absent and not votong: Hale. And the Mayor declared the Ordinance passed, -as there were 7 Ayes, and no Nal, Alderman Williams moved the adoption of the emergency clause, seconded by alderman Adki: and on roll call by the Clerk, -:'the following vote was recorded; Ayes: Adkisson, Harlan, Bohe, Williams, Whitfield; White and Gray. AN ORDINANCE AUTHORIZING EXHIBITIONS OF CARNIVALS WITHIN CERTAIN ZONES OF THE C )F FAYETTEVILLE, PROVIDING LICENSE FEES OR PERMITS, REPEl'LING ALL CONFLICTING ORDINANCES, AND FOR OTHER PURPOSES ' BE IT ORDAINE1 BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. It shall be lawful for carnival companies to set up the usual stands and equipment and to conduct the usual business of carnival companies in the City of Fa3 vill,e, Arkansas provided that the stands, amusement machines and other attractions usual accompanying carnival companies are located not closee than one mile to.,the public squar %in the City of Fayetteville, Arkansas; provided further, that the name " company" shall for the purposes o6fcth5.s ordinance include not only a corporation but also firms, assoc' tions or individuals as the case may be. was m , .s tk, son 'Ilderman Adkisson made a motion that the bills be allowed as approved, serionded by alder nan Gray, which was regularly passed by the Council. A privilege tax or permit fee of three hundred dollars $300.00) is hereby levied against any such company as defined in Section 1 hereof for the privi- ege of exhibiting for a period of not more than one week in the zone or zones permited n Section 1 of this ordinance, which fee shall be paid to the City Clerk of the City f Fayetteville, Arkansas before any of said equipment or amusement devices, buildings tents or other property of such carnivals is erected „ installed or put in operation as th case may be. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby epealed, and it appearing under present ordinances no carnival companies can exhibit 1lithin the City of Fayetteville, Arkansas and'it further appeaDing that since the passage cf the Ordinance prohibiting such exhibitions., the city limits of the City of Fayette- �ille, Arkansas have been @K.pa:nd6dj and now embrace grounds uponwhich the carnly*al compa- nies have always exhibited,and,,£ tbeing the desire of the City of FayettevillE to permit at e use of said grounds and it Jrecessary for the preservation.of the public health, peace and safety, an emergency is hereby declared to exust and-this,ordinance shall be in full I orce and effect from and after its passage and approval. Attest_ 4,Jy y ; eTMk Approved Mayor The Mayor reported that Washington County Fair Committee made a contract with he Carnival Company for_.this year, with the understanding that there would be no City icebse,since the Fair-GFounds was not in the City at that time, alderman White made a otion that the City Clerk be instructed to collect the fee, and then donate it to the sir Committee; this motion was secondedv by alderman.Gr.ay, and was passed unanimously y the Council`, T�ere being no further business, alderman White moved to adjourn till uesday.. August 12th, at 8 O'Clock P.M., sedonded by alderman Harlan, which Wa® passed nanimously by the:Council, and the Mayor declared the Council adjourned till 8 O'Clock , Ai agust ;12th; 3947• Approved Mayor The Council of the City of Fayetteville in the County of Washington, State of rkansas, met in adjourned session at'the Council Chamber in said City, at 8:00 o'clock, .M., on the 12th day of August, 1947. The meeting was called to order by the Mayor, and the roll being called, here were: Present: G.T:Sanders, Priayor in the chair,J.W.McGehee, City Clerk, Price ickson, City Attorney, and the followung named aldermen: Adkisson, Harlan, Bohe, williai hitfield, White and Gray. and also : Absent: aldermam Hale, who had notice of the meet - 136 . The Mayor stated that consideration should be directed by said Council to he question of the passage and adoption of a resolution accepting a bid for bonds to be ssued by the City of Fayetteville, Arkansas, for the purpose of constructing additions o and remodeling the City Hospital, and purchasing fire fighting apparatus and for pur- hasing a site for and constructing buildings for the housing of fire fdghting apparatus; After discussion by said Council, Alderman Bohe intrdduced in writing and ead a resolution for that purpose, entitled; " A Resolution Accepting a Bid for Bonds to �e issued by the City of Fayetteville,.Arkansas, for the Purpose of Constructing Additiea �o and Remodeling the City Hospital, and Purchasing Fire Fighting Apparatus and for Pur- chasing a Site For and Constructing Buildings For the Housing of Fire Fighting Apparatus; lnd moved that the same be adopted. The motion was seconded by Alderman Gray, and after ue consideration thereof by said Council, the question was put by the Mayoroin the adop- ion of said motion and the passage of said resolution, and the roll being tailed the ollowing voted: Aye: Adkisson, Harlan, Bohe, Williams, Whitfield, White and•Gray. And he following voted Nay: None. Absent and not voting Hale. Whereupon, the Mayor declared said motion duly adopted and said resolution .uly passed, and signed his approval to said resolution, same attested by the City Clerk, nd impressed wittT the seal of the City.
