Fayetteville City Council met in regular sess,ion Monday, June 23, 1947.
Present: Mayor G.T,'Samders, City Clerk J.W.McGehee, City Attorney Price Dickson,City
Engineer E.T.Brown, aldermen; Adkisson, Harlan, Bohe, Williams,, Whitfield and Gray.
Absent: Aldermen Hale and White`:
Minutes of the adjourned meeting of June 10th, wereread and approved,

Alderman Bohe made a motion that the bills be allowed as approved, seconded by alderman
Whitfield, which was passed unanimously by the Council.
Protest A number of properjty owners living on Government avenue presented a protest
of prop- to the Council, claiming that*the Frisco Railroad was permitting water and creosote to
Owners on be drained over their gardens, and asked the Council to.take some acyion to relieve the
(3ov.Avee situation, after discussion, alderman Whitfield made a motion that the matter'be refers
to the Street Committee and the Mayor; with power to act;,.this motion was seconded by
aldertya.n Harlan, and was passed unanimously by.the Council.

tr ffio Traffic°Lights, the location of which, to, be left to"'the'discretion of the Street Com-
mittee and the Mayor, however the locations suggested were boilege &North, Lafayette
lights. & Westand Willow &Lafay,Ustriic motion was seconded by, alderman Williams, and was passed
unanimously by the Council..
Aderman Bohe introduced an Ordinance, ent'itl'ed"AN CRD-tNANCE AUTHORIZING THE
BORROWING OF FIFTY THOUSAND DOLLARS PROVIDING FOR TH:S_*RF.PAYMENT THEREOF AND•FOR OTHER
PURPOSES,
The Ordinance was read in its entirety by the Clerk, alderman Adkisson made
a motion that the rules be suspended and the Ordinance placed on its second reading,
this motion was seconded by alderman ,%hitfield, and was passed unanimously by the C rn:n-
oils
The Clerk then read the Ordinance the second•time, and after discussion, aldem
man Whitfield made a motion that tho'rules be further•susperded, and the Ordinance
placed on its' third and finale reading; this motion was seconded by alderman Gray, and
was passed unanimously by the' Council.
The Clerk then rood the Ordinance the third and final•time.
The Mayor then put the question" Shall the Ordinance pass"?, and on roll call
by the Clerk, the following vote was recorded; Ayes: Adkisson, Harlan, Bohe, Williams,
Whitfield and Gray. Nayst Hon".. Absent and not voting.: Hale and'White. And the Mayor
declared' the Ordinate 'passed,• as there were 6 Ayes, and no Nays';
Aldonman Williams made a motion that•the emergency clause be adopted, this
motion was'secomded by alderman Gray; and on roll tali. by the Clerk, the following vote
.. was recorded; Ayes: Adkisson,* Harlan, Bohe, Williams,. Whitfield and Gray. Nays: None.
Absent and not voting: Hale and White. And -the Mayor declared the emergency clause
adopted, as •there were 6 Ayes-, and no Nays.
ORDINANCE N0. 9181.
AN ORDINANCE AUTORIZING THE BORROWING OF, FIFTY THOUSAND DOLLARS PROVIDING FCR
THE REPAYMENT THEREOF AND FOR- OTHER FURPOSES.
Whereas the Sewer Comm&ttee of the City of Fayetteville,Arkansas has under= -::.
taken the construction *of a secondary disposal plant for the City of Fayetteville,
Arkansas and has heretofore received the proceeds of .the sale of one hundred twenty-
five thousand ($125,o00.00 ) dollars in revenue bonds., and
Whereas because of increased costs of •labor and materials, it now appears that
the proceeds of the sale of said bonds is insufficient to complete said project,and an
additional fifty thousand dollars (500000.00) will be needed to complete said project
find put it in operation, and
Whereas First National Bank of Fayetteville,. Arkansas and Mellroy Bank of
Fayetteville, Arkansas have agreed to loan'the'aewer,Committee of Fayettevolle, Arkansa
the sum of fifty thousand dollars ($50,000.00), each of said banks to loan one-half of
that amount, payable over a period of ten years -with interest at the rate of four per-
cent (4%) per annum on the unpaid balance payable solely from revenues of the Sevier
System of the City of Fayetteville, Arkansas.
NOW BE IT, THEREFORE , ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTE-
VILLE, ARKANSAS:
Section 1. The Mayor and the City Clerk of the City of Fayetteville,Arkansas
are hereby authorized to borrow twenty-five .thousand dollars ($25,000.00) from the
First National Bank of Fayetteville.. Arkansas, and•twenty-five thousand dollars
($252000.00) from the McIlro bank of Fayetteville, Arkansas, and to execute notes
payable on or before ten (10� years from date of execution of said notes -in sums not
less than twelve hundred fifty dollars ($1,250.00) and accrued interest on unpaid
balances each six (6) months, interest to accrue at the rate of ,four per cert (41%�
per annum on each of said notes. And that the notes heretofore executed in tee s of
ten th6usand dollars ($10,000.00$ ,to each of said auks in accords eo with t,l^ �gJ$,$
of Ordinance No. 911, be retired out of the Proteus of the notes nereLn�g9�CHer13'EB.

Section 2. Said notes shall in no sense constitute an indebtedness'of the City of
Fayetteville, Arkansas, but shall be paid exclusively from surplus revenues of the Sewer
System of the City of Fayetteville, Arkansas after provision has been made for payment of
bonds•and interest now outstanding which were secured by a first lien on the revenues of sn.id
Sewer System.
Section_ 3. Surplus revenues as provided in Section 2 hereof, are specificallly
pledged for the purpose of repaying said notes in the manner herin set forth.
Section 4. It appearing that the funds hereinabove mentioned are needed immediateLy
in order that said secondary disposal plant may be completed and put in operation, an
emergency is hereby declared to exist and this ordinance shall be in full force and effe t
from and after its �'assage and approval*

seconded by alderman Whitfield; which was duly passed by the Council,and the Mayor

Alderman Bohe introduced an Ordinance entitled, "APT ORDINANCE TO CLOSE THE PORTION
F ALLEY IN BLOCK A OF LEVERETT'S SECOND ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS".
The Ordinance was read in full by the Clerk, alderman Williams made a motion tr t
he rules be suspended, and the Ordinance placed on its second reading, this motion was
