( ORDINANCE N0. 915 continued) WHEREAS, the County Court of Washington County, Arkansas did on May 12,1947 make n order annexing the territories described in the order of the Circuit Court to the City f Fayetteville, Arkansas and the County Clerk of Washington County, Arkansas has forward ranscripts of the proceedings to the Secretary of State and to the City of Fayetteville, NOW, THERFaRE , BE IT ORDAINED BY THE CITY ODUNCIL OF THE CITY OF FAYETTEVILLE: Section 1. That the territories described in the order of the Circuit Court and hat of the County Court on remand,.the description of which is hereby adopted and made part of this Section as fully and to all intents and purposes as if set out herein ord for word , be annexed to and made apart of the City of Fayetteville, Arkansas. Section 2. All of that part of said territory lying douth of Center Street and Center Street produced, and west of College Avenue is hereby assigned to and made a part Of Ward Number One of the City of Fayettevdlle, Arkansas: all of that part of said terri- Tory lying west of College Avenue and its extension Northward along United States Highway Number 71 and North of Center Street and East of the Frisco hailroad right of way is here assigned to and made a pant of Ward Two of the City of Fayetteville, Arkansas: all of tha territory lying East of College Avenue and the extension of College Avenue Northward alon United States Hughway Number 71 to the extended City limits is hereby assigned to and mad a part of Ward Three of the City of Fayetteville, Arkansas; and all that part of said ter �itory lying West of the Frisco Railroad right of way and North of Center Street and .Cemt Street produced is hereby assigned to and made a part of Ward Four. Section 3. It appearing that a special election is to be held in the City of ayetteville, Arkansas, on June 17,.1947,-a.nd that qualified electors residing in the ter otory annexed to the City of Fayetteville should be assigned to l'Jards in order that they ay exercise their privilege as qualified electors of the City of Fayetteville, Arkansas, n emergency is hereby declared to exist and this ordinance shall be in full force and ffect from and after its pasage and approval. After hearing both sides of the proposition presented by their espective attorneys, the Mayor put the question " Shall the Certificate of Public Con- enience and Necessity be granted"?, and on roll call by the Clerk, the following vote esulted; Ayes: Hale, Harlan, Bohe Whitfield., White and Gray,.Nays : Adkisson and Wil- isms. A� rr :; ::.1.1 .. ,. f {:• ..n Ta a T Yr ' }., ..o I �'�.Q Petition) A Petition signed by a number of pro@rty owners in the Southeast serition of the City,l for was presented by the Clerk, asking that arrangments be made for them to connect with the Sewer Sevier system, after discussion, alderman Hale made a motion that the Council go on record referredas being. in favor of granting the request of the petitioners,and that the matter be refe'red to to the Sewer Committee to confer with the Commissioners of Seftr Improvement No.l, to see Como what arrangments could be worked out, this motion was seconded by alderman Whitfield, ancj I passed unanimously by the Council. Alderman Bohe introduced an Ordinance entitled " AN ORDINANCE PROHIBITING THE PARKING VEHICLES ON THE WEST SIDE OF COLLEGE AVENUE BETWEEN EAST MOUNTAON STREET AND EAST MEADOW EET IN THE CITY OF FAYETTEVILLE, ARKANSAS." The Ordinance was read in its entirety by the Clerk, and alderman Williams ma motion that the rules be suspended, and the Ordinance placed on its second reading, th tion was seconded by alderman Whitey and was passed unanimously by the Council. The Clerk then read the Ordinance the secondttime,.and after discussion, ald n Hale made a motion that the rules be further suspended and the Ordinance placed on i ird and final reading, this motion was seconded by.alderman Adkisson, and was passed ani_mously by the Council. The Clerk then read the Ordinance the third and final time. e Mayor then put the question "Shall the Ordinance Pass"?; and on roll call by the Cle: e follwing vote was recored,; Ayes: Hale,Adkisson, Harlan, Bohe, Williams, Whitfield, its and Gray. Nays None. And the Mayor declared the Ordinance passed , as there were ayes, and no nays. Alderman White made a motion that the emergency clause be adopted, this mo s seconded by alderman Gray, and on roll call by the Clerk,.the following vote results, es: Hale, Adkisson, Harlan, Bohe, Williams, Whitfield, White and Gray, Nays: Nones d the Mayor declared the emergency clause adopted, as there were 8 ayes, and no nays. ORDINANCE NUMBER 9-1-6. APT ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON THE WEST SIDE OF C011EGE VENUE BETWEEN EAST MOUNTAIN STREET AND EAST MEADOW STREET IN THE CITY OF FAYETTEVILLE# RKANS'AS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION I. It shall be unlawful for any person, firm, or corporation to park vehicle of any kind whatsoeber on the wesb side of College Avenue, between East Mounts treet and East Meadow Street, in the City of Fayetteville, Arkansas. SECTION 2. Any person violating Section 1 of this ordinance shall be deemed ilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less an one dollar ($1.00) nor more than twenty five dollars ($25.00). SECTION 3. It appe ring that College Avenue at ,the-1point above' described is very congested, by reason of heavy traffic, and it being necessary for the protection of the public health, peace, and safety, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage and approval. The mayor then appointed the follwing commuttee: Hale,Gray and Whitfield. 'I The Mayor, reported that it had been the custom for a number of years for the Discon, Plumbers, Gas Fitters.and.Electricians to file bonds with the City.Clerk, and asked the tinue opinion of The City Attorney as to their value to the City, the City Attorney stated th accept- his opinion, the bonds, as written were of no value to the City, alderman Adkisson made ing a motion that the City Clerk be instructed to notify the Insurance Companies, that had bonds been furnishing the bonds, that effective -from this date no further bonds would be requ of Plumbers, Gas Fitters and Electricians., this motion was seconded by alderman Vlhitfi and was passed unanimously by the Council.
