AN ORDII4ANCE TO AMEND ORDINANCE N0.913, DECIARIKg AN EMERGENCY, AND FOR OTHER POSES. • • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE.* ARKANSAS: SECTION I. Section 1 of Ordinance no.913 passed Dndthe 28th day of Apri1,1947 is ereby amended to read as follows: "Section 1. An election is hereby called to be held at, he usual polling places in the City of Fayetteville.on the 17th day of June, 1947, for he purpose of determining whether the City of Fayetteville shall issue the following - egotiable bonds: $75,000.00 for the purpose of constructing additions to and remodeling he city hospital, and $500000.00 for the purpose of purchasing fire fighting apparatus nd purchasing a site for and constructing bmildings for housing of fire fighting appata- us. Said bonds shall be payable as hereinafter set forth, bear interest at the rate of wo and one half per cent (2i-) per annum and be dated September 1,1947, but convertible o a lower rate of interest on such terms that the City shall pay and receive substan- ially the same amount of money as upon a two and one half per cent (2 y/o) bond isste. aid bonds shall be secured by a levy not to exceed two (2) mills upon all .real and per- onal property in the City of Fayetteville, Arkansas, for -:each year of the years 1947.to 981, inclusive." It is ascertained and declared that hospital and fire fighting acilities in this city are inadequate to protect the health and safety of the citizens o he city and that improving and adding to the hospital and fire fighting facilities is ssential to the health and safety of its citizens. It is, therefore,.declared that an mergency exists, and that this Ordinance is necessary for the immediate preservation f the public peace, health and safety and that this Ordinance shall take effect and be n force from and after its passage. Mayor The Mayor stated that he had some requestSto purchase a road gr4der, belo gm to sell ing to the Airport, after discussion, alderman Whitfield made a motion that the Mayor be grader authorized to sell the grader on sealed bids, this motion was seconded by alderman Hale, and was passed unanimously by the Council. Alderman Bohe introduced an Ordinance, entitled, "AN ORDINANCE ACCEPTING TERRI- TORIES ANNEXED TO THE CITY OF FAYETTEVILLE BY ORDER OF THE CIRCUIT COURT OF WASHINGTON COUNTY, ARKANSAS, ASSIGNING SAID TEREITORIES TO WARDS, AND FOR OTHER. PURPOSES. The Ordinance•was read in its entirety by the Clerk, alderman Hale made a motion that the rules be suspended, and the Ordinance placed on its second reading, this motion was seconded by alderman White, and was passed unanimously by the Council. The Clerk then read the Ordinahce the second time,'and after discussion, alderman White made a motion that the rules be further suspended, and the Ordinance plat on its third and final reading, this motion was seconded by alderman Gray, and was passe unanimously by the Council. The Clerk i;hen read the Ordinance the third and final time. The Mayor then put the question " Shall the Ordinance pass? ", and'on roll call by the Clerk, the following vote resulted; Ayes: Hale, Adkisson, Harlan, Bohe, Williams, Whitfield, Wh1,4te, and Gray, and the Mayor declared the Ordinance passed; as there vers 8 Ayes. ORDINANCE NO. 9-1-5. AN ORDINANCE ACCEPTING TERRITORIES ANNEXED TO:THE CITY OF FAYETTEVILLE BY ORDER OF THE CIRCUIT COURT OF WASHINGTON COUP?TY, ARKANSAS, ASSIGNING SAID TERRITORIES TO WARDS, ARID FOR OTHER PURPOSES. WHEREAS, at the annuEll election held iii the City of Fayetteville on the first Tuesday in April., 1946, the qualified electors of the •City of Fayetteville, Arkansas voted to•annex certain territories to the City of Fayetteville, Arkansas and the City o: Fayetteville, 9rkansas pursuant to the results of said election filed its petition in t'. County Court of Washington County, ArIcansas, and thereafter on June 119 1946 the bounty Court made an order in said cause and certain remonstrants appealed to the Circuit Cour of Washington County, Arkdnsas, and Whereas, in the hearing in the Circuit Court of Washington County, Arkansas an agreement satisfactory to'all parties was reached and -the Circuit Court of Washington County, Arkansas did on May 7, 1947 amend the order of the County Court of �4ashington County, Arkansas and upon'amending the said order, the appeals of all remonstrants were dismissed without objection and the cause remanded to -the County Court of Washington County, Arkansas for the purpose of completing the annexation procedure, and ( ORDINANCE N0. 915 continued) WHEREAS, the County Court of Washington County, Arkansas did on May 12,1947 make n order annexing the territories described in the order of the'Circuit Court to the City f Fayetteville, Arkansas and the County Clerk of Washington County, Arkansas has forward ranscripts of the proceedings to the Secretary of State and to the City of Fayetteville, NOW, THERFaRE , BE IT ORDAINED BY THE CITY OPUNCIL OF THE CITY OF FAYETTEVILLE: Section 1. That the territories described in the order of the Circuit Court and hat of the County Court on remand, -the description of which is hereby adopted and made part of this Section as fully and to all intents and purposes as if set'out herein ord for word , be annexed to and made apart of the City of Fayetteville, Arkansas. .I Section 2. All of that part of said territory lying douth of Center Street and Center Street produced, and west of College Avenue is hereby assigned to and made a part of Ward Number One of the City of Fayetteville, Arkansas: all of that part of said terri- tory lying west of College Avenue and its extension Northward along United States Highway IiTumber 71 and North of Center Street and East of the Frisco Ttailroad right of way is here assigned to and made a pant of Ward Two of the City of Fayetteville.. Arkansas: all of tha territory lying East of College Avenue and the extension of College Avenue Northward alon United States Hughway Number 71 to the extended City limilts is hereby assigned to and mad part of Ward Three of the City of Fayetteville, Arkansas; and all that part of said ter i�itory lying West of the Frisco Railroad right of way and North of Center Street and .Cemt Street produced is hereby assigned to and made a part of Ward Four. Section 3. It appearing that a special election is to be held in the City of ayetteville, Arkansas, on June 17,.1947, and that qualified electors residing in the ter otory annexed to the City of Fayetteville should be assigned to dards in order that they ay exercise their privilege as qualified electors of the City of Fayetteville, Arkansas, n emergency is hereby declared to exist and this ordinance shall be in full force and ffect from and after its pasage and approval. Passed and approved this 12th day of May, 1947, Before going into the hearing, City Attorney Price Dickson disqualified himself as City Attorney, since he was interested in the Northwest Arkansas Transportati Lines, Inc. and alderman Whitfield made a motion that O.E.Wil.liams be employed as Spedia Attorney for the hearing, tllis?-metion was seconded by alderman Gray, and was passed unan imously by the Council. After hearing both sides of the proposition presented by their respective attorneys, the Mayor put the question " Shall the Certificate of Public Con- venience and Necessity be granted"?, and on roll call by the Clerk, the following vote resulted; Ayes: Hale, Harlan, Bohe Whitfield, White and Gray.,Nays : Adkisson and Vli1- liams.
