Nays None. J the Mayor declared the vote unanimous in favor of issuing the permit. The application of Carl Smith to erect a store building on a part of t 6, Ambrose Addition, came up for a hearing, but it was announced that Mr. Smith had thdrawn his applicatdon and a hearing would not he neccessary. narawnM.r. Theatres The Mayor stated that the Sewer Disposal Construction Fund was insufficdent to Sewer complete the proposition, and that he and Aldeiman Adkissori had contacted the 2 banks, Disposal ,and that they had agreed to loan the Plant.$10,000.00 each, at a rate of 4%. to be paid t�o borrow back at the rate of $1,000.00 per ,year to each,.bank, plus the interest, alderman Hale 20.000. a motion that the City Attorney be instructed to prepare an ordinance, authorizing 4ade :he the loan, and have it•ready�for the next regular meeting of the Council, this motion was by alderman 17illiams, and was passed unanimously by the Council. a.n. The ,Ordinance was read in its entirety,by the Clerk, alderman Williams made a mo. tion _that the rules be suapended, and the Ordiamce placed on its second reading, this motion was seconded by alderman Stubblefield, and was passed unanimously by the Council. The Clerk then read the Ordinance the second tdme, after discussion, alderman Bohe made a motion that the rules be further suspended, and the Ordinance placed on its third third amd final reading,.this.motion was seconded by alderman dregory, and was passed unanimously by the Council. The Clerk then read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass'?; and on roll call by the Clerk,, the following vote rresulted; Ayes: Bronson, Gregory, White, Stubblefield,'Williams,Bohe, Adkisson and Hale,. Nays:None. and the Mayor declared the Ordinance passed, as thereewer,�e 8 Ayes, and no Plays. • Alderman Gregory made a motion that the emergency clause be adopted, this motion was seconded by alderman White, and on roll call by t e Clerk; the following vote was r corded; Ayes: Bronson, Gregory, White, 8tubblef4eld, illiams, Bohe, Adkisson and Hale. Nays:114one. And the Mayor declared the emergency clause addpted, as there were 8 Ayes, and no Nays. ORDINANCE N0. 910 AN ORDINANCE REGULATING AND FIXING FARES OR TARIFFS TO BE CHARGED BY PUBLIC PASSENGER CARRIER IN THE CITY OF FAYETTEVILLE.* ARKANSAS PRESCRIBING PENALTIES, AND FOR OTHER PUR- POSES. Whereas all persons, firms and corporations opera.tirig public passenger carrier, including taxicabs and bus lines, in the City of Fayetteville, Arkansas,have agreed andl consented that fares or tariffs for their services may .be fixed as hereinafter set forth; and have waived public hearing hereon, and Whereas the City Council of the -City of Fayetteville has made a careful study of rates and fates to be charged by taxicabs and bus lines in the City og Fayetteville, Arkansas, and finds that the rates and tariffs hereafter set forth will give the public reasonable fares with a fair return to the bus and taxicab operators. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COU14CIL OF THE CITY OF FAYETTEVILI',E, ARKANSAS: Section 1. Tie taxicab fare per person shall be twenty-five (25�) cents from ny point to any other point within an area bounded as follows: Beginning at the intersection of Garland Avenue and North Street and running hence tkast along North Street to the Southwest corner of the Southeast Quarter (SE4 of he Northeast quarter (NEI), Section Nine(9), Township Sixteen (16),kange Thirty (30� West, eing the intersection of North Street with Woolsey Avenue, thence North along Woolsey venue 4 mile; thenciEast to the East side of the right-of-way of U.S.High-way No.71f, hence in a southerlydirection with the said East side of said right-of-way, to North treet; thence East along North Street and North Street produced to the Northeast corner f the Northeast quarter (NEI) of the Southwest quarter (SWI) of Section 10,s thence -'South ne and one-half (1�) miles to the Southt4st corner of the Southeast quarter (SET) of the outhwest quarter (SW4) of Section Fifteen(15), thence 4"Jest to the Eastside of right -Of, ay f U.S.$igh-way No.719'thence in a southerly direction with the East side of said right=f- ay I mile,being the intersection of Highway No.7l,and Seventh Street;thence West acroes s. aid No. 71 to the West side of the right-of-way of said Highway No.71; ✓ Thence along the West side of said right-of-way in a northerly irection to Fourth Street, thence West to the Southwest corner of the Southwest quarter (SW4) f Section Sixteen(16), thence North to the inteessection of Garland Avenue and Maple S�rleet; hence 'Nest along Maple Street to the Southw'Est corner of the Southeast quarter (SEI) f the Southeast quarter (SE -414 of Section Eight(8), Township Sixteen(16), Range Thirty (3O) est. thence North to Clevland Street; -thence Fast -along Cleveland" Street to Garland Avenue; hence North to tP2 place of beginn, ingall in Township Sixteen (16) North, Range Thirtyl(30) est. The fare.1T this section shall be known as the base taxicab fare and the above escribed area as the base area. Section 2. In addition to the base taxicab fare as fixed in Section 1 of this inance, an additional fare of ten cents (10.%) percab for each quarter (4) mile autual veled outside of the base area, is hereby found to be a reasonable compensation which 11 be charged as set forth inSection 3 of this Ordinance. Scetion 3. Taxicabs shall transport passengers over the best route directly to their destination without detouiting to pick up or discharge other passengers; provided that it shall not•be a"violation of this section if other passengers can be picked up or dis- charged without substantial detours or undue delay. But if additional passengers are picked up and discharged as provided in this Section -,(;;the fares shall be determined on the basis of the total passengers carried on said.trip; as if all passengers had been at the same point of call and had had the same destination. Section 5. Bus fares shall be ten cents (104 per person from any one point to any other point on any -of the routes in operation with no charge for transfers from one bus to another. Books good for fifteen (15) fares may be sold for one dollar ($1.00) under such conditions as may be approved by resolution or motion of the City Council of t e City of Fayetteville, -Arkansas.. Section 6. The"above fares shall be one way trips. Round trip fares shall be double the amount of one-way fares. No books or tickets shall be sold at reduced rates, except by bus lines as provided in Section 5 hereof; and if any -unused books or tickets are outstanding at the time this -Ordinance becomes effective they shall not entitle the Y�older to passage in any -taxicabs, but shall be redeemed by the issuing company for the nused portion pro rate*• Section 7. Any person, firm or corporation violating the terms of any section or part of section of this Ordianance shall be deemed guilty -of a misdemeanor and upon convictio{} thereof shall -be fineddin any sum not less than ten dollars ($10.00) nor more ban One Hundred dollars(•$lOOeO0) and each violation shall be deemed a seperatse offense. Section 8. If any person, firm or corporation now operating under a certifi- cate or under Grandfather Rights in lieu of a certificate, 1 ued or walvdd by the City of'Fayetteville, Arkansas, as the case may be, shall know ing„ ermit any employee to vio- late the terms of this Ordinance; such operator shall be"guilty of a misdemeanor anal shall ire punished by a fine of not less than fifty dollars ($50.00) noo more than five hundred dollars ($500.00); and each violation of an employee of which the employer knows shall be a 9eperate offense; and in.addition thereto the City Council of the City of Fayetteville, Arkansas, may revoke the•permit under,which such passenger carrier is operating and may ake such steps as necessary to prohibit further operations. Section 9. All Ordinances or parts of Ordinances in conflict herewith are ereby repealed; and it appearing that the fixing of fares is immediately required, an emergency is hereby declared to exist and this Ordinance shall be in full force and effec from and after its passage and approval.
