request A Petition was presented by the Clerk, asking that an alley, running North

an alley being signed by all the property owners in said Block, after discussion, alderman Bronson
made a motion that the Clerk be authorized to have a notice -published in the Northwest
Arkansas Times, that a hearing will be had at the regular meeting of the Councfll January
20th, 1947, at which n� person interested in said matter may appearand show cause, if any,
why said petition shod not be granted, this motion was seconded by alderman Gregory, and
was passed unanimousl'5 by the Council.
Nov repprt The Clerk present the November report of the Police -Departments alderman
Gregory made a motion that the report be received and filed, seconded by alderman Williama,
which was passed unanimously by the Council.
Mr.H.L.Woodward and a Mr Watts, with the. State Health Department, appeared
Rose before the Council, with reference to the ROSE LAWN DAIRY, of Muscogee, Oklahoma, delivering
Lawn DairEilk in the City .of Fayetteville, without a PERMIT from the State BOARD OF HEALTH, after
discussion, alderman Gregory made a motion that the Mayor be authorized to instruct Dr.
Allen A.Gilbert, the City Health Offiber, to notify ROSE LAWN DAIRY to cease delivering
milk in the City of Fayetteville, Arkansas, until a Permit from the State Board of Health
is obtained; this motion was seconded by alderman White, and was passed unanimously by
the Council.

Bakery alderman Bronson made a motion that the 1946'bakery license be refunded to Bob White
license Bakery, Shipley Bakery and ,the Gateway Baking C60, this motion was seconded by alderman

Fire Dept Alderman Williams-; chairman of the Fire committee, stated that the ref igerator
to buy at the Fire Station had become 'unusale,'and that-L.L.Baxter, of the Arkansas estern
frefriger Gas Company had offered.to sell'the epartment a -refrigerator at cost, alderman Stubble-
ator field made a motion that the Fire Committee be autchorized accept the bid of Mr. Baxter
for a No. R-600 Deluxe Serval Refrigerator at the'list price of #351.95, less 33 1/3
discount, or net of $234.60;-this'motion was seconded by alderman Adkisson, and was
passed unanimously by the Council.

Fire The Clerk presented the repprt-of Henry George, Acting Fire Chief, in which
Hazards he called the attention of the Counc to an inspection made by himself and other mem-
oted bers of the Fird Department , which ey found A number of'places,where very great
fire hazards were' being permitted to ex10%;,, after discussion; it was' decided that the

7 Alderman Stubblefield introduced an Ordinance, entitled " AN, ORDINANCE
APPROVING AND ACCEPTING THE ANNEXATION OF CERTAIN LANDS DESCRIBED HEREIN INTO THE CITY
OF FAYETTEVILLE, ARKANSAS".
The Ordinance was read in its entirety by the Clerk,alderman Bronson made
a motion tha't•the rules be suspended, and the Ordinance placed -on its second reading,
this motion was seconded by alderman Adkisson, and was passed unanimously by the Council
The Clerk then read the Ordinance the -second -time, and after discussion,alder�
man `&dkisson made a motion that the rules be further suspended, and the Ordinance placed
on its third and final reding, this motion was seconded by alderman Stubblefield, and Js
was passed unanimously by the Council.
The Clerk then read the Ordinance the third and final time.
Tre Mayor then put the question " Shall the Ordinance pass"?, and on roll call by the
Clerk,..the follwing vote was recorded; -Ayes: Bronson, Gregory, White, Stubblef ield,
Williams, Bohe and Adkisson. Nays a None. -Absent -and not voting: alderman Hale. And the
Mayor declared the Ordinace passed, as there were 7 Ayes, and no Nays.
Alderman Gregory made a motion that the emergency -clause be adopted, this
motion was seconded by alderman White, and -on roll call by the Clerk, the following vote
was recorded; Ayes: Bronson, Gregory, White, Stubblefield, Williams, Bohe and Adkisson.
Nays : None. Absent and not voting: Alderman Hale: And the Mayor declared the emergency
clause adopted, as there were 7 Ayes, and no Nays.
ORDINANCE No. 908.
AN ORDINANCE APPROVING AND ACCEPTING THE ANNEXATION OF CERTAIN LANDS DESCRIBED
HEREIN INTO THE CITY OF FAYETTEVILUJ? ARKANSAS.
WHEREAS, there was filed in the office of the County Clerk of Washington Cou
ty, Arkansas, a petition of more than eight resident property owners of the herein de-
scribed lands, together with a plat of the said property to be annexed with its descri
tion, on October 8, 1946, and
WHEREAS on November 12, 1946; a proper orddr of the County Court was entered

approving the said annexation,and whereamore than thirty days have elapsed since the
date of said order and no court action has been instituted to prevent the said annexa-
tion, NOW THFREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS.
Section 1.That the Southwest Quarter'of the Northeast Quarter and the North-
west Quarter of the Southeast Quarter of Section Nine(9), Township Sixteen (16), Range
Thirty '(30) °rest, be accepted as a part of the City of Fayetteville, said area to be asd
signed to and become a part of Ward Two of the 8ai4;City.
Section 2. This ordinance being necessary )for the peace, health and safety
of the public, an emergency is hereby declared to exist and this ordinance shall be in
force and take ect immediately upon its passge,a}Lppr.pyafi'.and publication.

CONTRACT
This contract entered intd the day of ,194 Toby and between
he City of Fayetteville, Arkansas, hereinafter referr Part of the first part"
nd H.W.Luckett and Maurice H.Russell, a partnership, hereinafter referred to as
Parties of the second part", witnesseth:
]:.Party of the first part agrees to permit party of the second part to place upoi
ands presently leased to the said City and described•aa:
The East part of that tract of land located in -Sections Twenty -one (21), Twenty-
wo (22), and Twenty-seven (27), in Township Seventeen (17) North, Range Thiry (30) West
f the 5th P.M., purchased by Jack Reed and wife from.the Ozark White Lime Company, Inc.;
y deed dated February 9, 1946, not to exceed 100 acres*

creening rock for party of the first part under terms and conditions hereinafter descril

3. Parties of the second part shall be permitted to mine, quarry and use any of th(
imestome for - the purposes of this contract; found within the area above described,saVe
nd except the sprawls on the north slope next to`Clear_Creek, use of such sprawls to be
imited and only to the extent as permitted by the City Engineer.
4. Parties of the second part agree to install a rock crusher and screens on the
premises, adequate to crush and screen the stone to -sizes as may be specified from time
time by party of the first part, and ranging from dust to ome and one-half inches in size
Party of the second part further agrees to erect bins in such a manner that the crushed
stone may be loaded into trucks from the said bins by,gravity through chutes controlled
by gates.
5. The parties mutually agree upon the following terms subject to the provisions of
section 6 herein: party of the first part agrees to pay,for services rendered by party o±
the second part, on the basis of one dollar per cubic yard for crushed and screened stone
which it takes from the aforsaid mentioned bins, and -parties of the second part agrees t
to party of the first part at the rate of. fifty cents a cubic yard for all -stone; crushes
and screened or otherwise taken from the premises, it being specifically understodd that
the said fifty cents per yard payment shall -,hot be applicable to stone taken by party of
the first part.
6. It is further agBeed and understood that the provisions of section five herein
shall be in force and effect for a period of six months from and 'after the date of this
agreement, or until such time as the parties shall mutually agree in writing -to alter th
rates of payment by a rider attached to this contract, provided that at the end of the f
six months period, rates may not be changed except at the end of each twelve months peri
7. Parties agree that this contract may be cancelled by either party upon ninety
days notice in writing.

Viz: 25 % Of gross,redeipts from rents and swimming pool, payable 100.00 monthly till
end of the year,'when.balance'of 25 % will be paid' in one sum, this motion was seconded
alderman Bronson, and was passed unanimously by the Councils
There being no further business, alderman Williams mdved to adjourn, sec(
by alderman AAkisson, which .was duly passed by the Council, and the Mayor declared the
Council adjourned.
