Alderman Gregory introduced the following RESOLUTION, and moved its adoption, this motion was seconded by alderman Banks, and on .roll call by the Clerk, the following vote was recorded: Ayes; Bronson, Gregory, Bankd, Stdtbblef i81d, Williams,McRoy, Adkisson and Hale. Western WHEREAS, Arkansas Western Gas Company is the .owner ofa certain franchise from the Gas Co. City of Fayetteville whereby the said Company is authorized to construct, own, operate and to pay maintain a.system of mains for the distribution of .natural gas in the City of Fayetteville, 2 % together with all lines, meters, equipment and installations necessary thereto; and Gross receipts - WHEREAS, the.said Company is now serving the City and the inhabitants thereof with natural gas under the said franchise; and WHEREAS, the said Company has made a written proposal to the said City, dated January 1,"1946, in words and figures as follows, to wit: The Arkansas Western Gas Company proposes to enter into an agreement with the City f Fayetteville, Arkansas, to pay it,commencing January 1,1946, for aperiod of ten(10)yers rom"and after said date, a sum equal to two percent (2%) of the Company's gross revenues 7 erived from the sale of natural gas to domestic and commercial consumers within the City imits of Fayetteville, Arkansas. Said sum is to be due and payable quarterly, and the rkansas Western Gas Company shall have thirty (30) days after the expiration of each qulrter o compute and make said payments The sum described by the preceding paragraph is to be paid by the Company and accepted y the City in lieu of all occupation taxes, meter taxes, license fees, street and alleylrentals nd any and all other levies, taxes, and fees of whatsoever kind, nature, or character(except eneral and ad valorem taxes) for the said period of ten years, and the City of Fayetteville hall never increase or attempt to increase the percentage of such gross receipts provided or herein during said ten(10) year term; and in the event said City should increase orlattempt o increase said percentage, then this proposal or any agreement or contract base&`6j?eon etween said City and said Company shall ipso facto become null and void and oi'no force) nd effect. Arkansas Western Gas Company is to furnish said City of Fayetteville, Arkansas o free service; said City is to take from Arkansas Western Gas Company, and pay said Company t the regular published rates for said service, all the gas requirements of said City fir a eriod of ten (10) years from and after the acceptance of this proposal. The acceptance of this proposal by proper RESOLUTIO14 of the City Council of the ity of.Fayetteville shall constitute a firm and binding contract between the Company and ity, and shall be incorporated and become a part of the Franchise now held by the Arkansas astern Gas Company authorizing it to operate in said City.
