Present: Mayor Pro -tem G.T.Sanders, City Clerk J.W.McGehee, City Attornpy Price Dickson, City Engineer E.T.Brown, Acting Fire Chief Henry George,and aldermen; Stubblefie8, Williams, McRoy and Stubblefield. Absent: Aldermen,Brohson,Gregory and Banks. The absence of a Quorem was noted, and alderman McRoy moved to adjourn till 5 O'clock P.M.Friday the 29th, 1944, this motion was seconded by alderman Adkise.on, and was passed unanimously by the Council, and the Mayor declared the Council adjourned till 5 O'Clock P.M.,Friday the 29th,1944. WHEREAS,there aPe five retail liquor stores in the City of Fayet#eville at the present time, which is more than one liquor store for each two thousand residents of th City of Fayetteville, and, , WHEREAS, it is the opiniap of the City Council of the City of Fayetteville, A that there are allready enough retail liquor stores in the City of Fayetteville and tha additional retail liquor stores are not only definitely not needed, but are highly unde , irable; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fayetteville, Arkansas, that the Commission of Revenues of the State of Arkansas be and he is hereby memorialized to refuse to grant•additional retail liquor 16a<lers' permits to any persons firm or corporation for any other or additional locations whatsoever within the City ; of Fayettevilleand further, that Said Commissioner be memorialized to refuse to grant or transfer retail liquor dealers' permits to any premises other than those allready occupie by licensees. BE IT FURTHER RESOLVED that the Commdssioner of Revenues of the State of Ark- ansas, be and he is hereby requested to notify the City: of Fayetteville of the filing of any applications for retail liquor dealers' permits within the City of Fayetteville, by any persons, firms or corporations for any premises not'presently licemsed by said Con** missioner and occupded by the licensee, and that the City of Fayetteville be granted ani opportunity to be heard prior to any action taken on such applicatiohs by said Commission of Revenues. BE IT FURTHER RESOLVED that a duly authenticated copy of this resolution be forwarded to the Commissioner of Revenues of the State of Arkansas. Adopted this 29th day of December, 1944. Alderman McRoy, chairman of the Police Committee, made a motion that the Police salaries of PATROLMEN Pearl Watts and D.M.Patton be raised from $100000 permonth to salary $120.00 per month, with $10.00 per month Uniform maintenance Allowance, effective, raised January 1st, 1945, this motion was seconded by alderman Adkfdson, and was passed unan- mously by the Council* , The Mayor stated that NIGHT WATCHMAN LIDO Cole had been very co-operative Eldo Cole with the Police Departmentand had been instumental in causing rhany arrests to be made to be paid and felt like he should have some remuneration, alderman Stubblefield made a motion tha 810.00 Eldo Cole be paid $10.00 per month for UNIFORM ALLOWANCE, effective January 1st, 1945" Der mo;e this motion was seconded by alderman McRoy, and was passed unanimously by the Council. T;}e Mayor reported some vacancies on the SLUM CLEARANCE COMMQTTEE, and Slum Clear- appointed C.C.Yarrington for a 3 year term, Maribn Wasson for 2 year term and G.M.Lemar: once Com. for 1 year term, Alderman McRoy made a motllion that the Council approve these appoint- Ya}rington ments, seconded by alderman Bronson, which was passed unanimodisly by the Council* Wasson LeMarr Alderman Stubblefield made a motion that the vacant lots in Block 17, Jennings Addition, former site of the Jefferson School, be turned over to the Chamber C.Commerce of Commerce for the establishment of a FARMERS MARKET, if they decided to use it for to have that purpose, this motion was seconded by alderman Banks, and received the unanimous use of vote of the Council• vacant Lot The question of the purchase of the.City Pari from PT.F.Drake came up for Tolpay discussion, again, and alderman McRoy made a motion tit the City pay $16,000 cash for cash for the City Park,that $4,000 ofIthid amount be paid from✓ treet Fund, and $12,000 be paid City Park from the Water Department funds, and further that.11LITY GENERAL FUND be pledged to from re-imburse these said funds1-.inttheff.ellot#g manner: Viz; on June 1st, 19450 the sum St%eet Fund of $4;000 is to bepaid to the Street Fund from the General Fund. Absent and hot voting: Alderman Gregory, and the Mayor declared r .'the Resolution adopted, a•s there were 6 Ayes and no Nays. -��;R E S O L'U T T_ O N. -�I WHEREAS, SOUTHWESTERN GAS AND ELECTRIC COMPANY is the owner of an indetermi- nate permit authorizing said Company to construct,own, operate and maintain an electric SW.Gas & distribution system in the City of Fayetteville, Ar'ransas, and all lines, appliances, Elctric Co equipment and installations necessary and incident thereto; and to pay 2 Of INHEREAS, said Company, under and pursuant to said indeterminate permit is ;roes receipnow serving said City and the inhabitants thereof with elctric power and energy; and W:IF.REAS, said Company has made a written proposal to said City,•which propo sal is dated December 29; 1944, and is in words and figures as follows, towit: Southwestern Gas and Electric Company hereby offers and proposes to -the City of Fayetteville, Arkansas, to pay it, commencing January•10 1945 for a period of one year, certain, and continuing from year to year thereafter, subject to termination by either the Company or the City at the end of any year by the giving of a written notice at leas 60 days prior to the end of the year after which this agreement shall terminate; a sum equal to two percent (2%) of the Company's gross revenues derived from the sale of elec- Itric power and energy to domestic and commercial customers within th, City limits of,sai City of Fayetteville, Arkansas, Said sum is to be due and payable ju�terly, and 'the Comp ny shall have thirty(30)days after the expiration of each quarter n which to make said payment. I 1 The sum described in the preceding paragraph is. to be paid by the Company and accepted by the City in lieu of any and all Occupation taxes, pole taxes, license fees, I rentals,and any and all levies, taxes and fees of whatsoever kind, nature or char acter(except general ad valorem taxes) during the term of operations under this proposal provided that the City of Fayetteville, Arkansas, shall never increase or attempt to in- crease the percentage of such gross receipts as provided herein durmng the term of opera Miens under this proposal; provided, further, that in the event said City should increas or attempt to increase said percentage, then this proposal and any agreement or contract based hereon between said City and said Company shall ipso facto become null and void an I no force and effect. I - Southwestern Gas and Electric•Company is to furnish said City of Fayetteville, Arkansas, no free service; said City is to take from Southwestern Gas and Electric Compa ny and pay said Company at the regular published rates for said service, all the electri power and energy requirements of said City during the entire term of operations under th proposal. This proposal shall be kept open until January 1, 1945, and Iffaccepted by proper resolution of the City Council of the City of Fayetteville, Arkansas,within said I of time, shall become and constitute a firm and binding contract between the Com- pany and said City and shall be incorporated in and become a part of the indeterminate permit now held by Southwestern Gas and Electric Company authorizing it to operate in 'said City. Whereas, said proposal of said Company is advantageous and beneficial to sai City and said City desires to accept said proposal in its entirety and thereby to effect a contract between said City and Southwestern Gas and Electric Company embodying therein all the terms and provisions and conditions of said proposal made by said Company,which I contract shall be an amendment to anddincorporated in the rindeterminate permit afore said, and shall be a firm and binding contract between said City and said Company. BE IT FURTHER RESOLVED THAT THE CONTRACT between the City and the Company Affec by this resolution be and the same is hereby incorporated in and made an amendment,to indeterminate permit above described,.and all ordinances, resolutions or parts or port thereof in conflict with the terms of said proposal are hereby repealed..
