Fayetteville City Council met for regular session Monday, September 4th, 1944.
No Present: Mayor Pro -tem f.T.Sanders, City Clerk J.W.McGehees aldermen.Bronsonand McRoy.

Minutes of the regular meeting of August 21st, were read and approved.

A1dePman Stubblefield made a motion that the bills be allowed, as approved, seconded by

lderman Banks, which was regularly passed by the Council.
Humane A committee representing the Fayetteville Humane society appeared before the
Society Council with a request that the handling of dogs and all other stray animals on the
present streets of Fayetteville,and all other duties in connection therewith as are now handled

Pursuant to agreement with the Council last night we undertake to assume
immediately, all duties in connection with handlAng of stray animals on streets of Fay-
etteville, and to perform such duties in connection therewith as are currently performe4
by the Police:

since there was a State Law governing the age limit for Pool halls, and the Mayor so infor

Alderman Stubblefield introduced an Ordinance, entitled " AN ORDINANCE DECLAR&
ING THE CARRYING OF PASSENGERS FUR HIRE A PRIVILEGE,FIXING A TAX THEREONre PROVIDING FOR
THE ISSUANCE OF CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY, FIXING PENALTIES FOR
VIOLATIONS, AND FOR OTHER PURPOSES. . 11
The Ordinance was read in •its entirety by the Clerk, alderman Gregory made) s :,:o_._.• r
ion that the rules be suspended, and the Ordinance placed on its second reading, seconded
alderman Banks which^was passed unanimously by the Council•
The Clerk then read the Ordinance the second time, and after discussibngl
man Gregory made a motion that the rules be further -suspended, and the Ordinance placed
its third and final reading, this motion was seconded by alderman Banks, which was pass
unanimously by the Council. I

the following vote was recorded: Ayes; Gregory, Banks, Stubblefield., Williams and MoRoy.
Nays:None. Absent, and not voting aldermen Bronson and Adkdsson. And _the Mayor declare
passed, as there were -5 Ayesis and no Nays.

`AN ORDINANCE DECLARING THE CARRYING OF PASSENGERS FOR HIRE A PRIVILEGE
A TAR THEREON; PROVIDING FOR THE ISSUANCE OF CERTIFICATES OF PUBLIC CONVENIENCE AND
SITY, FIXING PENALTIES FOR VIOLATIONS, AND FOR OTHER, PURPOSES.
BE GT ORDAINED BY THE CITY COUNCIL UF THE CITY OE FAYETTEVILLS0
SECTION 1. The carrying of passengers for hire in the City of Fayetteville is
hereby declared to be•a privilege and no person, firm or corporation shall carry or offer
to car an passengers y y privilege tax for the '_ ,i �.^ '-fi ,
carry y pa ngers within the Cit of Fayetteville until the
operation of such transportation•shall have been paid as hereinafter provided.
SECTION II The privilege tax to lie paid by all persons, firms and corporations
carrying passengers for hire within the City of Fayetteville shall be one hundred dollars
($100.00) per annum, which period shall run from January first of each year to the succeed—
•ing January first of the followings ar..Provided, however, that if license is sold on aiid
after July first -of any year, the license shall be fifty dollars for the.privilege of op=
orating until January•first,<next after the payment of said tax.
SECTION•III No person, firm or corporation "shall operate any vehicle within
the City of Fayetteville for the purpose of carrying•passengers for hire until and unless
they shall have first -made application in the manner,hereinafter set forth and have -received
a certificate of Public Convenience and Necessity from the City of Fayetteville.
SECTION IV Any person, firm or corporation desiring a certificate of Public
Convenience and Necessity for the operations mentioned in this Ordinance shall make written
application therefor and file said application together with remittance to the City of F&y—
etteville in the sum of One Hundred Dollars, said application must show the ability of the
applicant to furnish the service proposed, and the proposed charges and schedules for such
service. The City Clerk shall forthwith give notice of,the filing of.'such.application and
by publicatiob in a nespaper printed,.published and having a general.bona fide circulation
in the City of Fayetteville. Said notice shall fix a date for hearing before the City
Council of the City of Fayetteville not less tha:j,two weeks from the date of application,
at which hearing all interested persons; firms and corporations may appear and present
such matters as they may deem adviseable in assisting the Council to properly pass upon
said application. The Council may either grant or reject said application in their discrl
tion. They maypermit amendments to the application if applicant offers to amend and the Coun
cil considers said amendments to be the best interest of the residents•of Fayetteville.
In the event said application is granted, the One Hpndred Dollar deposit shall be credited
as payment for the privilege tax herein provided. I the application is rejected, the costs
of publication of the notice and other necessary expenses shall be deducted from the deposit,
and the balance returned to the applicant*
SECTION V The City of Fayetteville hereby adopts all of the terms of Actl
.213 of the Acts of Arkansas for the year 1939, which Act applies specifically to taxicabs.
SECTION VI Any person, firm, or corporation violating any part section, c:
or phrase of this ordinance shall be guilty of a misdemeanor and fined in any sun not le
than $50.00 nor more than $1000.000 and each day's violation shall be deemed a seperate

SECTION VIII It appearing that there is immediate need for proper regulat
of trasportation of passengers for hire within the City of Fayetteville, an emergency is
hereby declared to exist and this ordinance shall be in full force and effect from and a:
