Present: Mayor Geo,Vaughan, City Clerk J.6U.McGeheeX, City Attorney Price Dickson, City Engineer E.T.Brown, Building Inspector Henry George, Police Chief Dan Allen, and alders Bronson, Banks, Gregory, Hosford., McRoy, Stubblefield and Williams. Absent: alderman S i4inutes of the regular meeting of June 28th were read and approved. The question of whether Henry George was, covered by the Workmen's Compensatitn enry Insurance Pol.ici for the AIRPORT IlviPROVEMFNT construction, came up for discussion, also, orge as to whether part of his salary should be paid from the AIRPORT IMPROVEMT FUND, and, it so, lary how much, alderman Bronson made a motion that the matter be referred to the AIRPORT COMA MITTEE, with power to act, this motion was seconded by alderman Hosford, which was passfd unanimously by the Council, The Clerk then read then read the Ordinance the third and final time. The Mayor then put' -the question "Shall the Ordinance pass", and on roll call by the Clerk, the follwing'vote was recorded: Ayes: Bronson, Banks, Gregory, Hosford, McRoy, Stubblef el and Williams. Nays:None. !.Absent and not voting: alderman Sanders. And the Mayor declar d passed, as there were 7 Ayes, and no Nays. Alderman Gregory moved the adoption of the emergency clause, seconded by1 n alderman McRoy, and on roll call by the Clerk, the-following'•vote uesulted: Ayes, Bros1 Banks, Gregory, Hosford, McRoy, Stubblefield and Williams. Nays: None. Absent and not vpting: , alderman Sanders. And the Mayor declared Adopted, as there were 7 byes, and no Nays. II Copy of Ordinance on page 5-9-3 Alderman Brdnson stated that NEWT HINKLE, the Janitor, was having to retire on Newt account of his health, and made a motion that Mr.Hinkle be allowed a 2 -weeks vacation, inkle with pay, thds motion was seconddd by alderman Stubblefield, and was passed unanimously retires by the Council. Alderman Gregory stated that the Building committee had secured the services .E.Hinkle of O.E.Hinkle to take the place of Newt Hinkle, beginning July 15th, at the same salary. ppointed Alderman Gregory introduced an Ordinance, entitled " AN ORDINANCE PROHIBITING rohibit CARNIVAL COMPANIES,STRE'rT CARNIVALS AND SIMILAR PUBLIC EXHIBITIONS WITHIN THE CITY OF arnivals FAYETTEVILLE, AR KANSAS, AND FOR OTHER PURPOSES AND FIXING PUNESHMENT FOR VIOLATION OF TSE TERMS OF SAID ORDINANCES" The Ordinance was read in full by the Clerk, and alderman Gregory made a motion that the rules be suspended and the Ordinance placed on its second reading, this motion was seconded by alderman Banks,and was passed unanimously by the Council. The Clerk then read bhe Ordinance the second time, and after discussion, alderman Gregory made a motion that the rules be further suspended, and the Ordinance p aced on its third and final reading, this motion was seconded by alderman Stubblefield, and rias passed. gnanimously by the Council. II Copy of Ordinance on page 5-9-3 593 (Minutes of July 12th, continued from page 592) 0.1 =D I N A N C E N 0. 8-7-4 " AN ORDINANCE PROHIBITING CARNIVAL C 94PANIES; STREET CARN IVA LS AND SIMILAR PUBLIC EXHIBITIONS WITHIN THE CITY OF FAYETTEVILIE, ARKANSAS, AND FOR OTHER PURPOSES AND IXING PUNISHMENT FOR VIOLATION OF THE TERMS OF SAID ORDINANCE. WHEREAS, there -are no suitable locations within the Oity of Fayetteville, here Carnival Companies,,S4treet carnivals and amusement rides can be located without Ireating a nuisance ano unsanitary conditions to many of the inhabitants of the bity of Fayetteville, and Vlhereas, there are adequate locations outside of the City limits of the City f Fayetteville where such amusements may be installed,without creating a nuisance or causing undue menace to the public health; NOW,THEREFORE BE IT ORDAINED by the City•Council of the Cdty of Fayettevill kansas: I • SECTION ONE:•That carnival companies, street carnivals and amusement rides $hall not be erected or operated within the corporate limits of the City of Fayetteville, {�rkansas SECTION TWO: -Any person, firm or corporation who shall cause to be located n the City of Fayetteville.. Arkansas any carnival company,street carnival or amusement ide shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishe y a fine of not less than Fifty Dollars nor more than:Five Hundred Dollars ($500.00) and ach day of the operation -or exhibit of any of the shows or amusements herein prohibited hallconstitute a separate offense. SECTION THREE: All ordinances and parts of ordinances in conflict herewi re hereby repealed and it appearing that the shows and amusements herein prohibited hav �n the past operated until late hours at night and unsanitary and unhealthful conditions Pave been created by reason of such operations and this ordinance being necessary for th reservation of the public health, peace abd safety an emergency is hereby declared to xist and this ordinance shall take effect and be in full force from and after its passa pproval and publication. Passed and approved this 12th day of July, 1943. _ Approved There being no further business, alderman McRoy moved to adjourn, seconded by lderman Gregory, which was duly passed by the Council, and the Mayor deckared the Counc 3journed.
