The Council of the City of Fayetteville, in Washington County, Arkansas, met in
adjourned session at the Council chambers in the City Administration Building of the Ci
f Fayetteville at 8:00 O'clock P.M.September 30, 1942, in accordance witha motion pas
t the regular meeting of September 28, 1942, and so declared by the Mayor.
The meeting was called to order by the Mayor, and the roll being called by t:
lerk, there were present: Mayor Geo.Vaughan, City Clerk J.Vl.McGehee, City Attorney
Price Dickson; and the followingf,aldermen:Bronson, Banks, Gregory, McRoy, Shook and

Stubblefield. Absent aldermen Hosford and Sanders.
Mayor Vaughan submitted his report on the sale at auction of the $160,
of airport bonds which was held at 3:00 P.M. on September 22,1942, at his office, pursu;
to the notice duly published by himp alderman Bronson made a motion that the report be
received and filed, this motion was seconded by alderman Gregory, and.was passed unani-
fously by the Council. .
Alderman Gregory introduced a Resolution approving Mayor Vaughan's
report of the sale of the $100,000 of airport bonds, which was held at 3:00 P.M. on
September .9 942*
The Resolution was read in its entirety by the Clerk, and alderman
regory made a motion that the rules be suspended, and the.Resolution placed on its sec-
nd reading, this motion was seconded by alderman Banks, and was passed unanimously by
he Council.
The Clerk then read the Resolutdon the second time,,gnd after discuss,

was passed unanimously by the Council.

"There were present with me the members of the Airport Committee, the City
Attorney and the City Clerk.
"Before the bidding began, all bidders present agreed they would accept the
approving opinion of either Mr.Wallace Townsend or Messrs. Rose, Loughborough,Dobyns &
Houses
"The following final bids were received, conditioned on delivarY of the
executed bonds by November 1,1942, or otherwise at the option of the buyer.
"A syndicate composed of the First National Bank of Fayetteville, Arkansas;
McIlroy Bank & Trust Company of Fayetteville Arkansas; and the Citizens Bank of Fayette-
ville, Arkansas,bid 105.34 cents on the dollar and accrued interest.
"A syndicate composed of. Hill, Crawford & Lanford, Inc.) Southern Securitie's

And, WHEREAS, the Council has examined said Creport and finds that the same
should be approved;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fayette
ville, Arkansas:
Section 1. That the said report of the Mayor be and itcis hereby approved,
and he is hereby authorized to enter into a contract with the syndicate composed of Hill
Crawford & Lanford, Inc., Southern Securities Company, Cherry -Villareal & Company, and
Mallory Williams & Company for the sale of the said airport bonds for the price and on
the conditions set out in said report.

Section 2. It is hereby ascertained and declared that because of the fact tha
there are not adequate facilities for the landing of modern large and fast flying airpla
needed in these times of war for the protection of the citizens of Fayetteville, it is
necessary for the preservation of public peace, health and safety that this Resolution
shall become effective without delay, an emergency is declared, and this Resolution steal
be in force and take effect immediately upon and after its passage.

,AN ORDINANCE PROVIDING FOR THE 'ISSUANCE OF BONDS BY THE CITY OF' FAYETTEVILLE
RKANSA$,FOTHE PURPOSE OF THE ACQUISITION OF THE LAND NECESSARY, AND THE CONSTRUCTION

WHEREAS, By ordinance duly passed on the 20th day of July, 19420there was
submitted to the qualified electors of the City of Fayetteville, Arkansas, .the question
Nether it should issue $100,000 of bonds at a rate oftinterest•not to exceed three (3%)
per cent, but convertible to a.lower rate of interst on such terms that the City should
pay and receive substantially the same amount of money as upon a three per cent bond issy
for the purpose of the acquisition of the -land necessary, and the construction and equip,'

WHEREAS, due notice of the election was given as required by law, and ate said

WHEREAS, after due advertisement for the time and in the manner required

tteville, said bonds were offered for sale at public auction, at the -office of its Mayor$
t 3:00 o'clock P.M., on the 22nd day of September, 1942, and at said sale a syndicate
omposed of -Hill., Crawford & Lanford, Inc., Southern Securities Company, Cherry -Villareal
Company, and Mallory Williams & Company, all of Little Rock, Arkansas, bid and offered
he price of 105.86 cents on the dollar and accrued interest to date of delivery, and this
eing the best bid, said bonds were sold to said purchasers at that price; and..
WHEREAS, the said purchasers have elected to convert said bonds into the
issue of $109,500 of bonds, more fully described hereinafter, -on which the Council finds
that the City will receive and pay substantially the.same sum as upon $100,000 of three
per cent bonds at the price bid, said conversion being according to the Universal Bond
Value Tablas.

Section 3. If default is made for.thirty days .in
the payment of any interest coupon, and the holder of the bond to which it is
attached may declare the same immediately due and payable.
Section 4. The Mayon and City Clerk are hereby authorized and direct-
ed, when they have executed said bonds, to turn them over to the purchasers, upon receipt
of the purcase price of $1050860 and accrued interest in cash, and the proceeds of said
bands shall be used for no purpose except for the purpose of the acquisition of the land)
necessary, and the construction and equipment of a flying field or airport within or with-
out the corporate limits of the City, and the expenses of issuance; provided, however,
that for the purpose of providing for the interest that will become due on said bonds onI
marchl,1943, being before the first installment of the tax herein levied will be collected
and available, there shall" -be and there is hereby set aside out of the proceeds the sum
of $10150; and the City Treasurer is hereby directed to deposit said sum with the
Union National Bank of Little Rock, Arkansas, and the said deposit shall be preserved by c:

The construction fund shall be reimbursed from

SECTION 5. In order to pay the bonds as they mature, with interest thereon,
here is hereby levied upon all real and personal property,within the City of Fayettevil:
tax of Three (3) mills for each of the years 1942 to 1961, inclusive,being a sum suffi
ient to meet said bonds and interest as they mature, with five per cent added for unfor
een contingencies; and the City Clerk is directed to transmit a certified copy of this

Section 7. When the amount herein appropriated by the said City Council is
sufficient in any year to pay the next twelve months' installments of principal and
iAterest of the said bonds and to pay any installments of principal and interest which
may be past due and unpaid, and has been set aside and deposited with the said Union
National Bank of Little Rock, in trust for the purpose of paying -said principal and
interest, the said City Council may thereupon appropriate any surplus of all collections
of taxes or other funds over the principal and interest requirements in any ,year for re=
tirement, at par and accrued interest, at any interest paying date on and,'.after Septem-
ber 111952, of any outstanding and unmatured bonds of this issue, calling them in inverse
numerical order. The City Clerk shall publish once a week for two weeks before the date
of such redemption in some nespaper of general circulation published in Little Rock,
Arkansas, and having a general circulation in the State of Arkansas, a notice of :inten-
tion to call such bonds, such noticelto give the number or numbers of bonds to be called,
to notify the holders thereof to present the same to the paying agent for payment; at
par and accrued interest, to give the date on and after which the bonds are to be present.'

The Clerk ppresented'the Sept. reports of V.James Ptak;•as M.Judge for the City, Henry
George as wilding Inspector and as Acting Chi2f of the Fire Department, and Police Chief
Dan Allen presented the report of the Police Department, alderman Bronson made a motion that
the reports be received and filed, seconded by alderman Stubblefield. which was passed
unanimously by the Council.
Co. The bill of Swofford & Co., amountingrtog$235.00, for preparing the Specie.
audit of the Water Department, was presented, and alderman Hosford, chairman of the Wat
Committee, made a motmon that the billebe allowed, seconded by alderman Stubblefield,
which was passed unanimously by the Council.
The Clerk read a communication from Police Chief Dan Allen, in which he a
vised the Council that Taylor Hannah was ho longer carried on the records as a member o
the Police Department, that no Resignation had been furnished, bu t Mr Hannah had advis
him (Mr Allen) of his intention of accepting a job at New Port; Ark., and since Mr.Hann
been absent without leave for five,days, he was automatically suspended as a member of
the Department, effective October 1, 1942,
The Bill of Vial Ile Townsend,,Attorney at Little Rock, in the sum of $125
for preliminary work done in preparing the papers connected with the City Airport bond
issue, was presented, and after discussion, alderman Gregory made a motion that the bil
be approved, with the provision that it be paid out of the proceeds of the bond sale, a
charged as expense of the bond issue,this motion was seconded by alderman Shook,and was
passed unanimously by the Council.
There being no further business, alderman McRoy moved to adjourn, secon
by alderman Bronson, which was duly passed by the Council, and the Mayor declared the
Council.adjourned,
