mmt tee by the Mayor, to cooperate with a committee from the Chamber Of Commerce to work out the
Air -port details of a proposed^BOND ISSUE for the purpose of expanding and improving the CITY AIR
Sonds reported that the rpeommedation of the COMMITTEE was " that the City Council pass an Ord
ance calling,an elction to pass on a proposed BOND XSSUE of $100,000.00,of 20 year, 3%
Convertable Bonds, with a provision making them callable any time after ten years from
date of issuance,and:in order to ?rdvide for the payment of Bonds and Interest, a SPECIA
and DIRECT Tax of not to exceed 3;; MILLS on the dollar be levied;
Alderman Gregory introduced an Ordinance, entitled " AN ORDINANCE FIXING TII
TIME WITHIN WHICH A PETITION SEEKING A REFERENDUM ON A MUNICIPAL ORDINANCE MUST BE FILED
The Ordinance was read in its entirety by the Clerk, and alderman Gregoryl
a motion that the rules be suspended, and the Ordinance placed on its second reading,
motion was seconded by alderman McRoy, and was pa ssed unanimously by the Council.
The Clerk then read the Ordinance the second time, and after discussion,
lderman Bronson made a motion that the rules be further suspended, and the Ordinance
laced on its third and final reading, this motion was seconded by alderman Gregory, and
as passed unanimously by the Council.
The Clerk then read the Ordinance the third and final time.
The Mayor then put the question "Shall the Ordinance pass", and on roll call.,,by the
the following vote was recorded: AYES; Bronson, Banks, Gregory, Hosford, McRdy,Shook
Stubblefield. Nays, none.•Absent and not voting: alderman Sanders'; And the M9yor dec'
passed, as there were 7 Apes, and no Nays';

AN ORDINANCE FIXING THE TIME WITHIN WHICH A PETITION SEEKING A REFERENDUM
A MUNICIPAL ORDINANCE MUST BE FILED:
WHEREAS, it is deemed advisable that in order to know definitely when a Muni
cipal Ordinance is final, a period should be fixed limiting the time within which to fi
a petition to refer an ordinance of the City Council;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLiE,
AR KAP?SAS : •
SECTION I. That on and after the date of the passge of this Ordinance, any petition
to secure a referendum election on any measure passed by the City Council of the City of
Fayetteville, in order to be effective, must be filed within Thirty-one days after : the

passge of such measure'*',
SECTION 2. All ordinances and parts of ordinances in conflict herewith,
hereby repealed.
SECTION 3 . It is hereby ascertained and declared that because of the imper=
ative need for a definite time limit beyond which Municipal ordinances cannot be attacked, n:
and due to the fact that there are pending ordinances affecting the health and safety of
the City, an emergency is declared, and this Ordinance being necessary for the preservation
of the public peace, health and safety, shall take effect immediately on and after its
passge, approval and publication.

ECTION IN THE CITY OF FAYETTEVILLE# ARKANSAS, TO VOTE UPON THE QUESTION OF ISSUING
BONDS FOR ACQUIR12IG LAND FOR BUILDING AND EQUIPPING AN AIRPORT FOR SAID CITY.'
The Ordinance was read in its entirety by the Clerk, and alderman Gregory made

AN ORDINANCE CALLING AN ELECTION III THE CITY OF FAYETTEVILLE, ARKANSAS,TO VOTE
UPON THE QUESTION OF ISSUING BONDS FOR ACQUIRING LAND FOR BUILDING AND EQUIPPING AN AIR-
PORT FOR SAID CITY.
WHEREAS, the City of Fayetteville, Arkansas, is a City of the first class and
is authorized by Amendment No.13 to the Constitution to issue bonds for certain purposes,
by and with the consent of a majority of the qualified electors of said Municipality,
voting on the question at an election held for the purpose; and
WHEREAS, there is urgent need for the construction of additional airport facili
ities and the acquiring of land for the same to serve the needs of the City; said airport
to be located outside the c6tpora" limits of said City' eind it has been estimated that
the acquisition of the land and the construction will reasonably cost the sum of
$100,000.00; and
WHEREAS, it is the opinion of the members of the City Council that it is for
the best interests of the City of Fayetteville to issue bonds under said Amendment No.13
in order to secure the money to supply the City with these very urgently needed facil-
ities;
NOW, THEIE ORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLS,
ARKP_1`TSAS :
Section 1. That a special elf tion is hereby,called to be held in said City
on the 25th day of August, 1942, for tle purpose of voting upon the question of issuing -
$100,000.00 in improvement bonds dated September 1,1942, bearing interest at the rate of
not to exceed 3% per annum, and maturing serially on September 1 of each year as follows:
$42500 in each of,the years 1945 to 1948, inclusive;
5,000 in each of the years 1949 to 1952. inclusive;
5,500 in each of the years 1953 to 1955, inclusivq;
60000 in each of the years 1956 to 1958, inclusive;
60500 in the year 1959; amd
7,000 in each of the years 1960 to 1962, inclusive:
Said bonds shall bear interest at the rate of not to exceed (3%) per centum, per annum,
interest payable semi-annually on the first day of March and September of each year,
and the bonds may be sold with the privilege of conversion to a lower rate of interest
upon such terms that the City will receive no less and pay no more than it would receive
and pay if the bonds were not converted; and the bonds may contain provision making them
callable at any time after ten(10) years from date of issuances on the payment of par
plus accrued interest. And in order to provide for payment of the principal and interest
of the said bonds, a special and direct tax, sufficient to pay the principal and interest
of said bonds, not in excess of three -and one-half (32) mills on the dollar, in addition
to all other taxes, shall be levied by the City Council of the City of Fayetteville on
the real and personal taxable;, property within the City of Fayotteville:
Section 2. These bonds shall be issued for the purpose of securing money
for the acquisition of the land necessary, and the construction and equipment of a flying
field or airport within or without the corporate limits of the City; and the money secured
from the sale of said bonds shall never be used for any other purpose, except that the
expense of the bond issue may be paid from said funds.
Section 3. Said elsption shall be held and conducted and the vote thereof
canvassed and the result declared under the law and in the manner now provided for munic-
T ipal elections, so far as the same may be applicable, and the Mayor of the City of
Fayetteville is hereby authoridd and directed to give notice of such eloction by an
(advertisement published weekly, once a week, for four times in Northwest Arkansas Times,
a newspaper published in the City ofgFayetteville and having a bona fide circulation
therein, the last publication to be not less than ten days prior to the date of said
election, and only qualified voters of the City of Fayetteville shall have the right to
vote at said election. . .
Section 4. The result of said election shall be proclaimed by the Mayor
and his proclamation shall.be published one time in said nel paper and the result of said
el�tion as proclaimed by the Mayor shall be conclusive unless attacked in the courts
within thirty days after the date of such proclamation.

Section 5. In the event the result of,the election is in favor of the
bond issue IlL= XM = and the tax for said bond issue, the Mayor shall proceed to advert
tise the sale of the bonds as required by said Amendment No.13 to the Constitution of the

Section 6• It is hereby ascertained and declared that because of the fact that
here are not adequate facilities for the landing of modern large and fast flying airplanes
eeded in these times of war for the protection of the citizens of Fayetteville, it is
ecessary for the preservation of public peace, health and safety that this ordinance shall
ecome effective without delay, an emergency is declared and this ordinance shall be in
orce and take effect immediately upon and after its passage.

Alderman Gregory made a motion that the Council go into executive session,

Alderman Gregory made a recommendation that the SEWER SERVICE COM!.'ITTEE and
he WATER COMMITTEE be -abolished and the Mayor arnnint new committees for these two De-
artments, after some discussions the Mayor stated that he would abolish all STANDING
01,51ITTEES, effective, next Monday Night, July 27th,1942, and that he would at that time
e prepared to announce a new list of COMMITTEES*
There being no further business, alderman Gregory made a motion to adjourn,
econded by alderman McRoy, which was duly passed by the Council, and the Mayor declared

Owing to my present health and acting on the advice of my
ysician, that after a rest, I secure a less strenuous position, I am submitting herewith
d ask that you accept this letter as my resignation as Collector of the City Water Plarit,
become,effective Sept* 1,1942
I would like to request that an audit of my office be lad
e first part of August, so that I may take a needed vacation the last part of4t the month.
Regretting very much that I am forced to leave the Water Department, and assur
ou that I.shall always be interested in the up -building and welfare of the City and all
is Depattments, and will be of any service possible to the Department of which I have b
mployed since May 1.1930.
