Fayetteville City Council met in regular session, Monday, March 9th, 1942. I

Minutes of the regular meeting of March 2nd, were read and approved.
The following bills were presented, after theirapproval by alderman Banks,
of the auditing committee:

Alderman Bronson made a motion that the bills be allowed, as approved,seconded by alde
Stubblefield, which was regularly passed by the Council.
The Clerkpresented the following reports: Roy Nix, as Sewer Service Collector, Chas.Sa:
as Acting Chief of the Fire D partment, Henry A.George, as Building Inspeotor,for::month
J.W,MoGehee, as Collector andeas Clerk for the.months of January and FebrFary,alderman
Sanders made a motion that the reports be received .and filed, seconded by.alderman McRo;

Mr.C.D.Atkinson appeared before the Council in the interest of Mrs J.A.Adams ani
children, with reference to some bonds of the City Water Plant, held. in ESCROW by the
Mollroy Bank & Trust Co., and after dioeussdon, alderman Bronson introduoed.the-folldwi:
RESOLUTION, alderman Gregory moved its adoption, seconded by alderman Sanders, and on r
call by the Clerk,received the unanimous vote of the Qouncil, and the Mayor declared, a
as there were 7 Ayes, and no Nays#
RES OLUT ION.
BE IT RESOLVED by the City Council of the City of Fayetteville, Arkansas,that It
security placed in escrow by J.A.Adams and Nora B.Adams which consists of Water Revenue
Bonds of the City of Fayetteville, be and the same are, hereby released and Mcllroy Ban
and Trust Company, the escrow agent, is hereby ordered and directed to deliver -said bon
to the persons entitled ti the same,free and clear of any claims of the City Water Plan
or the Water Improvement District. The consideration of this resolution is the assumpt
of payment by the State of Arkansas of the Bonds outstanding in Road Improvement Distri
No. 2 of Washington County, Arkansas as indicated by ,the letter.of F.A.Storey, Jr., sup
vdsor of the Refunding Board, which letter was addressed to Mr.C.D.Atkinson of Fayettev
Arkansas, stating that all of the Road Improvement District No.2 bonds have -been paid,
which letter is attached hereto.
Passed and approved,,this 9th, day of March, 1942.

Alderman Stubblefield introduced an Ordinance, entitled "AN ORDINANCE TO PROVIDE MORE
SANITARY AND &'FICIENT METHODS FOR DISPOSAL OF GARBAGE#KITCHEN REFUSE, TIN CANS,DISCAR]
GLASS, ETC., AND FOR OTHER PURPOSES.
The Ordinance was read in its entirety by the Clerk, and alderman Gregory
made a motion that the rules be suspended and the Ordinance placed on its second readi
this motion was seconded by alderman Stubblefield, and on roll call by the Clerk was p
unanimously by the Council.
The Clerk then read the Ordinance the second time, and after discussion#alderman
Bronson made a motion that the rules be further suspended, and the Ordinance placed on
third and final reading; this motion was seconded by alderman Banks, and on roll call
the Clerk, was passed unanimously by the Council
The Clerk then read the Ordinance the third and final time .
The Mayor then pint the 4uestion "Shall the Ordinance pass", and on roll call by the C
the following vote was recorded: Ayes; Bronson,Banks, Gregory, MoRoy, Sanders, Shook
Stubblefield. Nays: None. And the Mayor declared Passed, as there were 7 Ayes, and no

Alderman Banks moved the adoption of the emergency'clause, seconded by ald
Shook,.and on roll call by the ClQrk, the following vote was recorded Ayes; Bronson,
Gregory,.MoRoy, Sanders,, Shook.:an&+Stubblef ield. Nays None. Absent and not voting, He
And the Mayor declared adopted, as t4ere were 7 Ayes, and no Nays

The question of the increase in use Ot bicycles and the need 4 or.'-pazking arrangement f
the same came up for discussion, and alderman Gregory made a motion that the matter be

AN ORDINANCE TO PROVIDE MORE SANITARY AND EFFICIENT METHODS FOR DISPOSAL OF
GARBAGE,KITCHEN REFUSE,TIN CANS,DISCARDED GLASS*ETC.sAND FOR OTHER PURPOSES.
WHEREAS. Ordinance No.828 was enacted by the City Council of the City of Fay-
;etteville, on May 29,1939, and was thereafter referred to"the electors at the election
held on the first Tuesday in April, 1940, at which election said ordinance received a
majority of the votes cast and was declared adopted, and
WHEREAS, In accordance with terms of said ordinance said City Council entered
into said contract for carrying out the said terms of the said ordinance, and
WHF.REAS,On the 16th day of June, 1941, a new garbage disposal ordinance was
passed by.said City Council, being Ordinance No. 859, which ordinance repealed all other
ordinances In conflict therewith and by its -terms became effective on June 17th,1941,and
WHEREAS, A petition containing a requisite number of, qualified electors was
filed with the proper officials calling for an election on said Ordinance No.859swhich
petition was filed on June 30, 1941, and
WHEREAS, On the 19th day of January,19420 Ordinance Noe859 was repealed by
the City Council of the City of Fayetteville „ Arkansa, and
VIHEREAS, There is confusion as to which ordinance, if any, now controls the
collection of garbage, kitchen refuse, etees
NOW,THEREFORE,BE IT ORDAINED by the City Council of the City of Fayetteville,
Arkansas:
SECTION ONE, the City Council of the City of Fayetteville, Arkans4shall con-
traet,with some responsible person, -firm or corporation to collect, haul and dispose of
all garbage, kitchen refuse, tin canssdiscarded glass, etc., and provide in said contract
the manner in which said garbage,refuse and rubbish shall be collected, hauled and dis-
posed of; and shall require that such person, firm or corporation give bond with good
and sufficient surety in any sum not less than One Thousand Dollars (1,000.00) to be
approbed by the Mayor of the City of fayetteville; conditioned that said garbage collector
shall perform the conditions and requirements set forth in said contract, which shall
contain a provision that the garbage collector shall be required to collect all garage
within the City of Fayetteville,without cost either ,to the City or residents of said City.
SECTION TWO,No person, firm,or corporation shall collect any garbagekitchen
refuse, tin cans,discarded glass, etc., until and unless he shall have first made applimi
cation to the City Council, of the City of Fayetteville, setting forth the .proposed methods
of`collecting# hauling and disposing of said garbage and shall have received the approval
of said'City Council and entered into a contract with the City of Fayetteville, upon such
`terms and conditions as may be agreed upon, and having posted'bond as required in Section
One of this Ordinance;and any person, firm or corporation collecting, hauling or disposing
of $arbage,kitehen refuse, tin cane, discarded glass, etc., without fmrst having received
the approval of said City Council and having posted bond as herein required shall be deem-
ed guilty of a misdemeanor, and shall be punished by a fine of not less than $5e00, nor
more than $50.00, and each day of such collection, hauling and disposal shall constitute
a seperate of fense,provided, however, that this sect Un s1vL11 no%, apply to any person
hauling or disposing of his own tin eans,br'oken glass, etc., ekeel3t garbage, so long as
the hauling and disposing of by such individual does not constitute a nuisance or create
unsanitary conditions; provided further that all tin cans, broken glass and other kitchen
refuse except garbage shall be deposited at the dumping ground provided by the City of
Fayetteville.
SECTION THREE, There is hereby levied a tax or fee to be known as
"Refuse`Disposal Tax" to be paid by residents or businesses availing themselves of the
services herein provided as follows, to -wit:
For each residence
$1= per annum
For each Hotel, Restaurant or
Boarding House $2.50 per annum.
SECTION FOUR, The tax or fee provided in Section three hereof shall be
collected by the person, firm • or corporation contracting to collAct the garbage, refuse,
etc.; and upon failure or refusal of any person availing himself of the services herein
provided, the garbage collector may refuse to collect, haul or dispose of said tin cane,
and other refuse, except garbage, until'said tax is paid, provided further that upon
failure to pay said tax or fee, the City of Fayetteville may, at its election,order the
garbage collector to collect, haul and dispose of said refuse and any personsf irm or
corporation who shall permit refuse,tin cans, broken glass and other rubbish to accumulate
on their own property except for the purpose of facilitating the collection of same by the
garbage and refuse collector; or deposit said refuse,tin cans, broken glass and other
rubbish on any other property within the corporate limits of the City of Fayetteville,
shall be deemed guilty of a misdemeanor and upon convictioh thereof shall be punished by
a fine of not less than Five Dollars ($5.00) nor more than Fifty Dollars ($50.00) and
each day said tin canssetce, are permitted to remain on the owner's premises or each time
said tin cans,etces are deposited on other property withih the City of Fayetteville in •
violation of this ordinance shall constitute a seperate offense.
Section Five, Garbage shall be kept in a seperate container from other
kitchen refuse adch as tin oanss discarded glass, etcey the garbage container to be tight-
ly�.cover®d, equipped with handles and kept in a place accessible and convenient to the
garbage and refuse collector in order to facilitate handling. No glass,metal or poison-
ous substance shall be placed in the garbage containers.
SECTION SIX, All Ordinances and parts of Ordinances in conflict here-
with are hereby repealed.
SECTION SEVEN, Due to the unsatisfactory methods used in the collect-
ion, hauling, and disposing of garbage, kitchen refuses tin cans, etc., all of which
causes inconvenience and creates a menace to the public health of the residents of the
City of Fayetteville, and this Ordinance being necessary for the preservation of the
Public Health, peace and safety of -the residents of the City of Fayetteville, Arkansas,
an emergency is hereby declared andLthia Ordinance shall be in full force and effect from
and after its passage, approval publication. Passed and approved this 9th, day of

.942 National Municipal Year Book, this motion was seconded by alderman Shook, and was
passed unanimously by the Council•
The Clerk presented the 3rd Annual report Of Street Improvement District No.47,
a alderman Sand'srsl made a pdtion that the report be referred to the auditing committee
conded by alderman Hosford, which was passed unanimously by the Council,
There being no fubh®r business, alderman Hosford moved to adjourn, seconded
alderman Mcnoy, which was duly passed by the Counoil, and the Mayor declared the Counbil

Ceudcil.
There being no further business, alderman McRoy moved to adjourn, seconded by
