The absence of Mayor Vaughan was noted, on account of the serious illness of his his Father-in-law, Irir.D.S.Clark, and alderman 6ronson made a motion that.alderman Sand be elected Mayor• -Pro -tem, this motion was seconded by alderman Shook , and on roll cal by the Clerk, was passed unanimously. The Clerk then called the roll, and noted the following members present: City Clerk J.W.McGehee, City Attorney Price Dd:ckson; aldermen; Bronson, Banks, Gregory McRoy, Sanders and Shook. Absent: aldermen; Hosford and Stubblefield. Minutes of the regular meeting of August 11th, were read and approved. Alderman Sanders made a motion that the lst installment (Annual) for the year 1941 in the Paving Improvement District Ifo 46 for the cost of paving the intersections, amounting to $99.56, be allowed, this motion was seconded by alderman Bronson, and rete the unanimous vote of the Council: ' Alderman Sanders made a motdon that A.F.Shumate, Foreiyan of the 9treet Clea, Department, be given a week's vacation, with pay, this motion was seconded by alderman Stubblefield, and was passed unanimously by the Council. Alderman Gregory introduced an Ordinance, entitled " AN ORDINANCE CREATING THE OFFICE OF INSPECTOR OF LIQUIFIED GAS DISTRIBUTION SYSTEMS, INSTALLATIONS AND APPLIATCE WITHIN THE CORPORATE LIMITS OF THE CITY OF FAYETTEVILEE, ARKANSAS, PROVIDING CERTAIN REG- ULATIONS IN CONNECTION WITH THE INSTALLATION AND SERVICING OF SUCH SYSTEMS AND FOR OTHER PURPOSES. The Ordinance was read in its entirety by the Clerk, and alderman Sanders mde a motion that the rules be suspended, and the ordinance placed on its second reading, s 0- ended by alderman Banks, and on roll call by the Clerk, was passed unanimously. The Clerk then read the Ordinance the second time, and after discussion, a man Bronson made a motion that the rules be further suspended and the ordinance placed its third and final reading, this motion was seconded by alderman Stubblefield, and rec the unanimous vote of the Council. The Clerk then read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass", and on roll call by the Ole the follwing vote was recorded: Ayes; Bronson, Banks, IdRoy,Sanders and Stubblefield. Nays: Gregory. Absent and not voting: Hosford and Shook. AN ORDINANCE CREATING THE OFFICE OF INSPECTOR OF LIQUIFIED GAS DISTRIBUTION SYSTEMS, INSTALLATIONS AND APPLIANCES WITHIN THE CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS, PROVIDING CERTAIN REGULATIONS IN CONNECTION WITH THE INSTALLATION AND SERVIC- ING OF SUCH SYSTEMS AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE$ ARKANSAS: OFFICE SECTION 3. The of City Inspector of Liquified petroleiun Gas Installations, Equipment and Appliances is hereby created, and the City Building Inspector is hereby designated as the Liquified Petroleum Gas Inspector with full power and authdrity to do and perform all acts hereinafter set forth. SECTMON 2. Any person,firm or corporation desiring to install liquified petR1 gas systems on any premises within the City of Fayetteville, Arkansas, shall first file with the City Clerk a sworn statement that he isaduly bonded manufacturer, jobber or retailer, selling and installing liquified gas containers and appliances in accordance with Act 276 of 1941, and the Rules and Regulations prescribed 15y the Boiler Inspection Department.Before making any installation, such dealer shall pay to the City Clerk an inspection fee of $10.00 for each installation and shall make application to the liqui- fied petroleum gas inspector for a permit to install such system, and the inspector aft ascertaining that said inspection fee has been paid shall issue a permit to install sai liquified petroleum gas sryrstem..Befdre said system may be placed in operation, a Final certificate of inspection must be issued by the City Inspector after inspection is com- plete, but before the system is charged with gas. SECTION 3. No installations of liquified petroleum gas containers, appli- ances or systems shall be made except by plumbers or gas fitters who have been regularl; licensed by the City of Fayetteville, after they have secured from the City Inspector a certificate of qualifications in the handling of liquified petroleum gases; nor shall any person operate any vehicle containing a tank for' liquified petroleum gases,or act a: helper on such vehicle, without first having secured a•certificate of qualification•in the handling of liquified petroleum gases from City,Inspector, provided that nothing in this section shall. apply to liquified petroleum gas transports passing through the City of Fayetteville and not stopping for local servdce or installation of containers, apuli, antes, or systems. SECTION 4. In making ibstallatiohs of °liquified petroleum gas systems the Inspector shall be guided by the rules and regulations promulgated by'the State Boiler Division of the Department of Labor applicable to liquified petroleum gas installation and equipment and failure to comply with such rules and repillrtions will b FU�,Ljustification for the Inspector refusing to issue a final certificate �� licant; provided , however, that whenever the Inspector shall deem it advisabl Or necessary he may make inspections of any liquified petroleum gas tanks and syste s within the cor porate limits of the City of Fayetteville and if said system is not being maintained or constructed in conformity with the rules and regulations hereinabove mentioned he may revke the final certificate and such system shall not be put in use until the require- ments of the Inspector shall have been met. SECTION 5. It shall be unlawful for any person, firm or corporation, thei agents, servants or employees conducting a liquified petroleum gas business to permit to remain in the City limits any trucks or tanks charged with liquified petroleum gas lomger than is necessary to service customers residing inside the City of Fayetteville and under no circumstances shall any tank trucks be permitted to remain within the City of Fayettevdlle except for the purpose of going to or returning from the customer's pre ises. SECTION 6.,It shall be unlawful to bring in, install or transport over tW Streets of the City of Fayetteville any homemade tank or container built for the us of liquifide petroleum gas, and all tanks or containers used for liquified petroleum ga shall be approved by the Inspector before they'may be used in connection with any liqui fied petroleum gas distribution system or unit. SECTION 7 . All tanks used for liquified petroleum gas shall be buried a least two feet below the surface of the ground and shall not be nearer than ten feet to any building or structure within the corporate limits of the City of Fayetteville; pro- vided, bowever,that said tanks may be located closer than two feet to the,surface of th ground if the rules and regulations of the State'Boiler Division of the Department of Labor of the State of Arkansas are complied with. SECTI014 8. It is hereby made the duty of every person in the City of Fayetteville, Arkansas, upon discovering that the liquified petroleum gas is escaping into the atmosphere from any tankior container, stationary or otherwise, at any point within the City'of Fayetteville to immediately notify the Fire Depattment of the City of Fayetteville. SECTION 9. It shall be unlawful to store within the corporate limits of the City of Fayetteville, Arkansas, any liquified petroleum gas tank or container. SECTION 10. Violation of any of the Rules and Regulations of the Boil Inspection Department regarding the transportation,storage, servicing,hand.ling,install ation, or repair of liquified petroleum gas containers, appliances, products, or syste shall be deemed a violation of this ordinance. SECTION 11. Any person, firm or corporation violating any of the t of any of the sections of tliis ordinance shall be deemed gumlty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than $500.00. SECTION 12. All ordinances or parts. of ordinances in conflict here- with are hereby repealed,and it appearing that unless this ordinance becomes immediatel effective the public health, peace and safety of t,the residents of the City of Fayette- ville shall remain in jeopardy, an emergency is hereby declared to exist and this ordi- nance shall be in full force and effec# from and after its passage, approval and pub- lication.
