The question of settlement of The Municipal Court expense, with the County Judge came
came up for discussion again, and alderman Sanders made a motion that the matter be referred
to the Finance Committee, City Attorney and the Mayor, with power to act, this motion was
secomded by alderman Banks, and was passed unanimously by the Council.
Alderman Bronson moved to go into executive session, seconded by alderman
Banks, which was passed unanimously, and the Mayor declared the Council in executive
session, after discussion of various administrative matters, alderman �iregory moved to g
out of executive session, secon°,��,d� by alderman Stubblefield, which was passed unanimously
and the Mayor declared the Council in regular sessions
Alderman Banks, chairman of the Fire Committee,reported that in answer to
lanhattan the advertisement for bids to be dubmi4tted on 650 feet of 22 inch Hose and 350 feet of.7.'
%o. 1-4 inch hose, the following firms had submitted bids: Campbell & Bell' The Automotive In

Fire and Hewitt Rubber Corporationp and after studying the bids from every angle, that the Cc

motion that the recommendation of the Committee be approved and the order given to
Manhattan Rubber Manufacturing Division, this motion was seconded by alderman Sanders, a

Alderman Sanders, chairman of the Street committee, reported with reference

Alderman Gregory, chairman of the Building Committee, stated that he had con-
ferred with the Secretary of the Masonic Lodge, with reference to their request to leas;
the East 21 of the third floor of the Administration Building,and was informed that the
Lodge would appoint a Committee at their first regular meeting, to confer with the Bldg.
Committee.(of the Council)
A petition, signed by a number of Property owners and Citizens, was presented,
and read by the Clerk, asking that a Bridge be built acrIss the "Town Branch" on South
Washington Avenue,alderman Bronson made a motion that the Petition be received and filed,
and referred to the Street Committee.. this motion was seconded by aldermam Gregory, and

The Ordinance was read in its entirety by the Clerk, an n e made a motion that the
rules be suspended, and the ordinance placed on its second reading, this motion was sec-
onded by alderman Gregory, and was passed unanimously by the Council.

Alderman Stubblefield introduced an Ordinance, entitled, " AN ORDINANCE
TO PROVIDE FOR THE DISPOSAL OF WASTE MATTER OF ALL KINDS AND TO PROVIDE FOR THE KEFPING
CLEAN OF THE STREETS AND ALLEYS OF THE CITY.
The Ordinance was read in its entirety by the Clerk, and alderman Gregory made a motion
that the rules be suspended, and the ordinance placed on its second reading, this motion
was seconded by alderman Hosford, and received the unanimous vote of the Council.
The Clerk then read the Ordinance the second time, and after discussion,
alderman Gregory made a motion that the rules be further suspended, and the Ordinance
placed on its third and final reading; this motion was seconded by alderman Sanders, and
was passed unanimously by the Council.

The Clerk then read the Ordinance the third and.final time.
The Mayor then put the question, " Shall the Ordinance pass", and on roll call by the
Clerk, the following vote was recorded : Ayes; Banks, Gregory, Hosford, McRoy,Sanders
and Stubblefield. Nays; Bronson and Shook. And the Mayor declared, passed, as there were
6 Ayes, and 2 Nays.
Alderman Gregory moved the adoption of the emergency, seconded by alder
Sanders,and on roll call by the Clerk, the following vote was recorded: Ayes; Banks,
Gregory, Hosford, McRoy, Sanders, Shook and Stubblefield. Nays; Bronson. and the Mayor
declared the emergency clause adopted, as there were 7 Ayes, and 1 Nay.

AN ORDINANCE TO PROVIDE FOR THE DISPOSAL OF WASTE MATTER OF ALL KINDS AND
TO PROVIDE FOR THE KEEPING CLEAN OF THE STREETS AND ALLEYS OF THE CITY.
{ BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS:

SECTION I. For the purposes of this ordinance waste matter shall be d
ed into two classes as follows:
Class 1. Edible matter such as table wastes
Peeling$,,rinds, etc., commomly called garbage.
Class 2. Non -edible matter, including tin cans,
glass, ashes,scrap ].umber, leaves,waste paper,
tree and shrub cuttings, floor sweepings,
discarded containers, coffee grounds, etc.,
�SECTION 2. Administration of this ordinance shall be under the general super_.,
\wj visionof the Mayor, who shall. make such rules and regulations as may be deemed necessary+
from time to time for the proper and efficient administration of this Ordinance, and which
may be changed from time to time to meet changing conditions as circumstances may arise ,I
and whichwhen adopted by resolution of the Council, shall have the force and effect of 1'w,
SECTION 3. Fees for the waste disposal service shall be fixed by the Mayor
upon an equitable7F_sis,'sTall be effective upon approval by the Council and shall. be pays
able in odvance to the collecting officer designated; %provided that fees shall in no evnt
%J exceed $7.50 per an•rnim for residential service, or $60.00 per annum for busimess service.
It is expressly declared to be the intent of this ordinance that only such fees shall be
assessed and collected as will provide funds for the administration of this ordinance, a d
that all revenues arising hereunder shall be used exclusively for waste disposal, street and
alley cleaning, and weed cutting.
In the case of enterprises engaged in canning,process-
ing or manufacturing, or of any public school, college or university or other tax supported
I enterprise, special agreements for waste disposal may be made without regard tothe limitp.

al by the Council.
SECTION 4. All waste materials collected shall be disposed of under the
direction of theayor or_ supervisor according to the best interests of the City,
Subject to approval by the Council, waste in class 1 may be disposed of
by contract for collection under terms and conditions set forth by the City;it may be col-
lected by the City and sold; or otherwise disposed of.
Waste in class 2 shall be disposed of at the City dump,provided that any which may have a
junk value may be salvaged and sold under.rules to be set forth by the Council.
SECTION 5. The placing of leaves, ashes or other substance in gutters or
in any other place where ey will or might be washed into a public drain or sewer, or so
obstruct the flow of water as to dam it up or divert it into the streets or alleys, is here-
by declared to be a misdemeanor and punishable by a fine not to exceed $25,00.
The keeping or creation of unsanitary or unsightly exterior premises or
portion thereof is hereby declared to be a misdemeanor and punishable by a fine of one
dollar, and in addition the offender shall be required to pay the fee for public collec-
�• tion of waste matter.
It is, hereby declared to be a misdemeanor for any person not authibr-
ized by the City to molest or scatter .or carry away any of the wasfbe materials from any
r_ container specified under this ordinance and same shall be punishable by a fine not to
e7(ceed $50.00.
It is hereby declared to be a misdemeanor for any person to burn
trasff. or papers or other matter within fifty feet of any bui$ding used for budiness pur-
poses. Any person violating this section of the ordinance shall be subject to a fine not
to exceed $50.00.
d It is hereby declared to be a misdemeanor for any person to leave Food
scraps, rinds or peelings on the public streets of the City of Fayetteuille and any person
found guilty of doing so will be subject to a fine in any amount not to exceed $50.00
It shall be unlawful for any person, owner or occupant of �property � y
to dump or permit to be dumped anywhere within the limits of the City of Fayetteville an�r
waste material or matter to be used as fill, provided that this shall not apply to dirt or
stone. Any person so violating this provision of the ordinance shall be guilty of a misde-
meanor and may be punished by a fines. not to exceed 150.00
Nothing in this ordinance shall be construed to prevent any person)
from hauling off waste matter in their••»wn conveyance provided some suitable means is used
to prevent scattering or loss by wind from the conveyance. Any person may 'sell or give
away waste containers if the terms and conditions of this ordinance are otherwise compliied
with. II
There being no further business, alderman McRoy moved to adjourn, seconded by alderman
oxford, which was duly passed by the Council, and. the Mayor de371ared the Council adjourped.
