Fayetteville City Council me8 in regular session, Monday June 17th,1940.
Present: Mayor A.D.McAllister, ity..Clerk J.W.McGeh e,City Attorney Price Dickson,
City Engineer E.T.Brown, Aldermen: Bronson, Banka. regory, Hosford, McRoyr,Peal,
Sanders and Shook.
Minutes of the postponed megular meeting of June 11th, and the adjourned meeti
of June 13th, 1940, were read and approved.
The following bills were presented, after their appreval by alderman Peal,
chairman of the suditing vommittee:

Alderman Shook made a motion that the bills be allowed; as approved, seconded by alder-
man Hosford, which was regularly passed by the Council:1
Prof. Burt Farlow appeared before the Council and stated that the property
Request owners on Buchanan Avenue had the money in the bank to pay for the'paving on their

worklto Street, and requested the Council to endeavor to have their Project statpted as soon as
start on possible.
Buchanan Ave And the Mayor informed him that it was his understanding that the W.P.A.
officials planned to start the paving project on Buchanan Avenue and.that of Street
Improvement District No 46, at the same time`:
The Committee;"that had been appointed td inspect the site of the proposed
Buildingbuildings on Lot 1, Block 2pbjt.Nord Addition, for which a Building Permit had been re -
permit quested, made their report, without recommendations, and after discussion, alderman
denied Hosford made a motion that the request for a bolding permit for a'2- story Apartment
on Wolf House and a 4 -Car Garage, proposed to be erected on Lot 1, Block 2,Mt. Nord Addition,
Property be denied, this motion was seconded by alderman Peal, and on roll call by the Clerk,
the following vote was recorded: Ayes; Gregory, Hosford, Mcroy, Peal and Shook, Nays:
Bronson, Banks and Sanders. And the Mayor declared the permit denied, as there were
5 Ayes, and 3 Nays*

Alderman Gregory introduced an Ordinance, entdtled " AN ORDINANCE FIXING
BUILDING LINES IN RESIDENTIAL DISTRICTS AND FOR OTHER PURPOSES.
The Ordinance was read in its entirety by the Clerk, and alderman Gregory
made a motion that the rules be suspended, and the Ordinance placed on its second read-
ing, this motion was seconded by alderman Hosfprd, and on roll call by the Clerk receive
the unanimous vote of the Council.
The Clerk read the the'Ordinance the second time, and after discussion, the
Ordinance was left on its second reading`;
Advertise Alderman Bronson made a motion that the Clerk advertise for bids for the
for bids construction of a sidewalk on South. Locust Street, in front of Lot 8, in Block 38,
to cols_tr�uct Original Town, this motion was seconded by alderman Peal, and on roll call by the Clerk

S.Locust t. gys: Sanders. And the Mayor declared passed, as there were 7 Ayes, and 1 Nay;
There being no further business, alderman Hosford moved to adjourn, seconded
by alderman Shook; which was duly passed by the Council, and the Mayor declared the
Council adjourned.

Present: Mayor A.D.MoAllister, City Clerk J.W.McGehee,ity Attorney Price Dickson,
City Engineer E.T.Brown, and aldermen; Bronson, Banks, Hosford, kcRoy, Peal, Sanders
and Shook. Absent: alderman Gregory.
Minutes of the regular meeting of June 17th, were read and approved.
The following bills were presented, after their approval by alderman Peal, chairman of
the auditing committee: Jackson Cafe $3.45,Southwestern Gas & Electric CO. 10;54 and
$10.67,Johnson & McBrttde $56.92, Magnolia Petroleum Co. $3.83, Ben Porter $20.00, Elmer
Boyd $15.00,Hugh Pool $9.00,clarence Rice $14.00,Hal Elderton $13.50, Robert Porter
$14.00, A.F.Shumate x'620.00, and Othm Shumate $12.00. Alderman Sanders made a motion
that the bills be allowed, as approved, seconded by alderman Bronson, which was regulap
ly passed by the Council.
Mas Reports The following reports for the month of May were read by the Clerk: Clyde Walters
Filled. as Building Inspector, A.D.McAllister as ex -officio Chief of the Fire bepartment and
as ex -officio Chief of Police.V.James Ptak, as Municipal Judge for the City and for
the County, Roy Nix, as Sewer Service Collector, and J.W.MeGehee, as Collector and as
City Clerk. Alderman Hosford made a motion that the reports be received and filed,
seconded by alderman Peal, which was passed unanimously by the Council.
The question of some property ovmersliving outside the CityLimits, desiring
to connect with the City Sewer.syst�m, was discussed, and alderman Sgnders made a mods!

This motion was seconded by alderman Hosford, and received the unanimous vote of the

The Mayor then put the question " Shall the Ordinance pass", and on roll call by the (
the following vote resulted= Ayes- Bronson, McRoy, Peal and Shook. Nays - Banks, Hosfc
and Sanders. Absent and not voting- Alderman Gregory. And the Mayor.declared the Ordir
passdd, as there were 4 Ayes, and 3 Nays.
Alderman Bronson then moved the adoption of the emergency clause, seconded
Peal, and on roll call by the Clerk, the following vote was recorded: Ayes- Bronson,Bt
Hosford, McRoy, Peal and Shook: Nays- Sanders. Absent and not voting Gregory. And the
Mayor declared , adopted, as there were 6 Ayes, and 1 Nay.

AN ORDINANCE TO FIX BUILDING LINES IN RESIDENTIAL SECTIONS OF THE CITY OF
FAYETTEVILLE, PROVIDING PENALTIES, AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of'the City of Fayetteville, Arkansas:
SECTION I. That no building shall be erected within'the residential district of
the City of Fayetteville, Arkansas, closer than twenty (20) feet to the property line
adjoining any street within the City of Fayetteville, Arkansas; provided, however, that
if a building line in any particular block in the residential district of the City of
Fayetteville is located more than twenty feet'from the property line adjoining any street
within the City of Fayetteville, then the building line shall remain.as it is established
by buildings already in place. Provided further that residences.now located closer to the
street than herein permitted may be repaired in the manner now or hereafter provided by the
ordinances of the City of ayetteville. .
SECTION 2. No out -building, garage or other structure shall be erected on any
lot in the residential section of the City'of Fayetteville closer to the street than th
residence in connection with which it is used.
SECTION 3 No building perfnit shall be granted either for new ennstruction e
for major repair of present construction if the proposed construction or repair is near
to the street than the building line hereinabove provided. Provided, however, that noth
in this ordinance shall prohibit the erection of a residence or out -building closer tha
twenty feet to the property line adjoining any street within the City of_Fayettevill6,0
if said residence and out -buildings are to be constructed on a corner lot having a widt
or frontage as the case may be of fifty feet or less, and in the'event itis desired-tc
erect a residence with its usual out -buildings on a lot of fifty feet or less, the appl
cation to so construct such residence and Out -buildings used in connection therewith sh
be referred by the Building Inspector to the City Council of the City:ef.Fayetteville
after he has given due notice of the application as in cases•provided for the erection
of business buildings in residential districts and property owners owning property in t
immediate vicinity may enter their protests in like manner as now provided by the ordir.
of, the City of Fayetteville for':entering protests against the erection of business or c
mercial buildings in residential sections,,but protests of property owners shall not be
necessary to invoke the jurisdiction of the City Council and all construction shall be
begun only after the City Council has spepifically authorized such construction by mots
or resolution duly adopted, and the Buildig Inspector shall not issue a permit for suei-
construction until after he is authorized'fo do so by the City Council aforsaid.
SECTION 4 .Any person, firm or corporation violating the terms of this ordir
shall be.deemed guilty bf a misdemeanor and upon -conviction thereof shall be punished t
of not less than Twenty -Five ($25.00) nor more than One Hundred Dollars ($100.00) and e
day the terms of this ordinance are villated shall be considered as a seperate offense;
in addition thereto,the City may at its election remove any building od part of buildir,
or require the property owner to remove said building erected or repaired in violation
terms of this ordinance.
SECTION 5 . Whereas, it is apparent that building lines within the City of
Fayetteville are not uniform, and that many residential sections have been materially
damaged by a lack of uniformity and that unless this ordinance becomes immediattely eff
ave there will be a,continual damage to the residential sections of the City of Fayette
ville; an emergency is hereby. declared to exist and this ordinance shall be in full for
and effect -from and after .its,passage, approval and publication., ,
Passed and approved this 24th day of June,1940. ,
