Magoi Pro -tem The clerk then called the roll, and noted the following present: City Clerk, J.w.MeGehee, City Attorney Price Dickson, City Engineer E?T?Brown, and aldermen; Bronson, Banks, Gregory, Hosford, McRoy, Peal, sanders and Shook. Minutes of the regular meeting og May 13th, were read and approved. A copy of the letter written by Mr.O.J.Hall, chairman of the Boapd of Com- missioners of Street Improvemet District No.46, addressed to Mrs Francis McDgnald, letter of District President of the Tri- Delta wilding Corporation,explaining in detail, the O.J.Hall method used by �tbe:LB6ard of Assessors in arriving at the amount of the assessment plat recd & filed on each piece pf property in this district was bresented,and alderman Shook made a mot that the letter be received and filed, seconded by alderman Peal, which was passed Una imosly by the Council. Alderman Gregory introduced an ordinance entitled " AN ORDINANCE FILLING A VACANCY ON THE BOARD OF CIVIL SERVICE C OMI+I ISS IONERS OF THE CITY OF FAYETTEV IL? E,ARKA NSAS . The Clerk read the Ordinance in its entirety, and alderman Gregory made a motion that the rules be sudpended and the Ordinance placed on its second reading, this motion was seconded by alderman Peal, and received the umanimous vote of the Council. The Clerk read the Ordinance the second time, and after discussion, alderman Sanders made a motion that the frules^beefurther suspended, and the Ordinance placed on its third and final reading, this motion was seconded by alderman Bronson, and received the unanimous vote of the Council. The Clerk read the Ordinance the third and final time. •The Mayor then put the question " Shall the Ordinance pass", and on roll call by the Clerk, the following vote was recorded: Ayes:Bronson, Banks, Gregory, Hosford, McRoy Peal, Sanders and Shook. WHEREAS, a vacancy has occurred on the Board of Civil Service Commissioners of the City of Fayetteville,by reason of the expiration of the term of Hal Douglass,and WHEREAS, the Civil Service Commission has been notified in writing to fill said vacancy and have not filled said: vacancy and the time prescribed by law has expire( for the filling of said vacancy, and the City Council of said City of Fayetteville is authorized to fill said vacancy under said circumstances; NOW,THEREFORE,BE IT ORDAINED,by the City Council of the City of Fayettevilli Arkansas, that Hal Douglass be and he is hereby appointed to succeed himself as a membe3 of the Board of Civil Service Commiss-loners of the City of Fayetteville, Arkansas. Council. for the purchase of which, the Council ad authorized a warrant for $100.00 to be drawn with the undera.tanding that the Southern Memorial Association would pay the balance, amounting to $250.00, and would then deed the ground to the City, to be used as a Park or a Play -ground. Mrs.Hight stated that she wanted.theeTitle to the ground to remain in the Southern Memorial Association, and after discussion, alderman Gregory made a ro.. motion that a Committee be appointed to meet with a Committee from the Sopthern Memoria', Association to work out some agreement that would be satisfactory to the City and to th Southern Memorial Association, this motion was secanded by alderman Hosford, and receiv the unanimous vote odf the Council. F The Meyor appointed on this Committee: the membe. of the inane Committee, together with the ity,Attorney. , I 456 1 F Alderman Bronson.moved to go intib executive session, secondelk by alderman Sanders, which ` was passed unanimously and the Mayor declared the Council in executive session, after discussion of various administrative matters, alderman Holford moved to go out of executive session, seconded by alderman Sanders, vihich was duly passed by the Council, and the Mayor declared the Council in regular session. Alderman Gregory, chairman of the committee, appointed to investigate facilities for handling and the disposal places offered by the Bidders on the Garbage Disposal Contractmade a detailed report of their investigations, and after discussion, alderman Sanders made a motion that the same committee be retained to make further investigation, and that they be given power to act in making a contract for the garbage disposal, this !!,C) motion was seconded by alderman Hosford, and received the unanimous vote of the Council. The following bills were presented, after their approval by alderman Peal, chairman of the auditing committee: J.Shelley $7.00, Ben Porter $20.00, Elmer Boyd $13,20, Hugh Pool $91500 Clarence Rice $10.009 Hugh Elderton 611.00, A.F.Shumate $20.00 and Otho Shumate $1290091 Alderman Bronson made a motion that the bills be allowed, as approved, seconded by alderman Gregory, which was regularly passed by the Council. onneman Mr. W.F.Sonneman appeared before the Council and asked for a permit to move a ermit house from the corner of Dickson & University, across D3okson Street to a Lot purchased from U Miss Lina Reed, alderman Gregory made a motion that the Permit be granted, when the require.=npts ove menta of the natural proceedure had been complied with, and that the Cityy, cooperate with Ouse Mr.Sonneman and his contractor in every way and that the City furnish 2 Policemen to handle the traffic while the house was being moved, this motion was seconded by alderman McRoy, and'was passed unanimously. Proctor Johnson, representing the American Legion and D.A.V. sponsored Snooker merican Parlor, appeared before the Council, and asked the Council to amend the Ordinance controll- egion ing Snooker Parlors; to give them power to limitcihennumber in the City, but after discussion, sks no action was,takene ounc it o amend City Attorney, Price Dickson reported that the Suit of Earl Hand V9. the City of rdinance Fayetteville, had been compoomised, on the following terms, Viz:that the City pay Earl Hand the sum of $245.00 for his claim against the City for salary from August 15th, 1939 to arl Hand June lst,1940, and that the City agree to put Earl Hand Back to work as Patrolman, June 1st, 1940 ase Alderman Greory made a motion that this agreement be ratified by the Council, and that a ompr.p- warrant for 9245.00 be drawn, and paid through the Circuit Court, in full settlement of the sed salary claim of Earl Hand from August 15th,1939 to June 1st, 1940, this motion was seconded' by alderman Hosford, and received the unanimous vote of the Council.' Mrs Cruse Acting Mayor Samders, reported that he and Mayor McAllister had conferred with offer Mrs.Beulah Cruse, relative to a Right-of-way across her property on West Maple `'treet, And that to sell she had made a proposi$ion to sell.the City 5 feet across her property for the sum of 5 ft. $250.00, and the City to build, a retaining wall for her, after discussion, it was decided to across postpone action till next meeting, and in the mean time the Committee woukd make further' property investigation. A letter from Major Edward K. Hooper was read by the Clerk, protesting the National action of the Council, in contemplating requiring the active members of the National ward Guards to procure a City license for their privately owned cars, alderman Gregory made a motion not to that the letter be received and filed, and that the matter be referred to the Uity Attorney buy for investigation, this motion was seconded by alderman McRoy, and was passed unanimously by City the Council, (later, the City Attorney reported, 1hat according to SECTION 9288 POPES DIGEST, License Cars with National Guard License are exempt from tate and City License) Alderman Gregory reported that the Committee appointed to make the Garbage Dis- posal contract, had made a verbal contract with H.G.Vdard, and that he reported that he Would be ready to start operating by July lst, 1940.
