In all cases where a permit is,required under the terms of this rdinance, the City Engineer shall establish the line upon which the retaining wall is tc e built and any person, firm or corporation and or any employee, agent or servant of ny person, firm or corporation who shall erect a retaining wall within the City of ayettevil•le, Arkansas, without first having secured a permit from the City Engineer afoi aid, or who shall construct a wall nearer*lto the Street or sidewalk line than the ocation fixed by the City Engineer shall be guilty of a misdemeanor and upon convmction hereof shall be fined in any sum not less than Five Dollars($5.00) nor more than Twenty ive Dollars ?"($25,00); and, in addition thereto, may by the Court be ordered to remove aid retaininJ3 wall and failure to comply with said order shall be treated as a contempt f Court and punished as such. SECTION 3 . All ordinances or parts of ordinances in conflict herewith are hereby repealed and it appearing that lM retaining valls have been and will continue.ito be erected or constructed on City property in the absence of regulation to the contrary, an emergency is hereby declared to exist, and this ordinance shall be in full force and effect from and after its passage, approval,and publication. The Clerk read the protest of the Tri- Delta Building Corporation to the Protest of assessment placed on their property in Paving District No.46, and Mr:O.J.Ha11, chairman Tri Tri -Delta -Delta of the Board of Commissioners was present, and explained in detail the plan used by the Board of Assessorsin determining the amount of assessment plLcede on each piece of propert; 0.46 in this District, and after comparison of the Tri-belta assesst�nt with the assessments refused. on property of similar size and value, the Council decided that the Tri -Delta assessment was not out of line, it was also noted that the Protest was filed 3dayslla,te, but that the Council had given ttrc8risiderationyannrway, and Mr O.J.Hall was requested to write the Tri -Delta Building dorporation , and explain to them the method used in determining their assessment , and the City Clerk was instructed to notify them that their protest - had been filed late, but that it had been given consideration any way. Alderman Gregory introduced an Ordinance entitled "AN -ORDINANCE LEVYING ASSESSMENT OF BENEFITS IN S'EREFT IMPROVEMENT DISTRICT N0. 46 OF THE CITY OF FAYETTEVILLE ARKANSAS: The Clerk read the Ordinance in its entirety, and alderman Bronson made a motion that the rules be suspended and the ordinance placed on its second reading, thi motion was seconded by alderman Shook, and on roll call by the Clerk, received the unanimous vote of the Council. The Clerk then read the ordinance the second time, and after discussion, alderman Sanders made a motion that the rules be further suspended, and the ordinance placed on its third and final reading, this motion was seconded by alderman Hosford and on roll call by the Clerk, received the unandimous vote of the Council. The Clerk then read the ordinance the third and final time. The Mayor then put the question " Shall the Ordinance pass", and on roll call by the Clerk, the following vote was rgcorded: Ayes; Bronson, Banks, GregoryH sford, McRoy, Peal, Sanders and Shook. AN ORDINANCE LEVYING ASSESSMENTS OF BENEFITS IN STREET IMPROVEMENT DISTRICT N0. 46 OF THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, two-thirds in value of the property holders owning property adjoining the locality to be affected and situated in Street Improvement District No.46,organizedl for the purpose -of grading, draining, paving, curbing and guttering and otherwise improv- ing streets within said districto bave.,- petitioned the Council of the City of Fayetteville, Arkansas, for the constructiob of said improvement, and that the cost thereof shall be assessed upon the real property of said district according to benefits received;.e•nd ;;;}: WHEREAS, said benefits received by each and every block, lot and parcel of real property situated in said district equals or exceeds the local assessment thereon, and WHEREAS, the estimated cost of said improvement to the district is Thirteen Thousand Dollars ($13,000.00); THEREFORE, IT ISrORDAINED by the City Council of the City of Fayetteville.. Captain Jack Phillips appeared before the Council arid:.phesented thedpropog.ition,_7.' that the Southern Memorial Association wanted to purchase a tract of land 140 Ft.x 40OF extending from Willow Street to the Confederate Cemetery, which would be suitable for a Park or Play -ground, he stated that this tract of land could be bought for the sum of $ but that the Southern Memorial Association only had $250.00, and asked the Council to p :the balance, amounting to $100.00, with the understanding that the Southern E1emorial As tionr%Wouldndeed,:tt`4 the tract of land to the City, to be used as a Park or Pla ygreund. It was also pointed out that the Southern Memorial `association had erected a concrete bridge across the Street leading to the Cemetery at a cost of approximately $400.00 , and in the discu Sion, it was pointed out that if the S.M.A had not paid for this bridg that the Street Department would have been called -on to pay for it, and after discussie alderman Sanders made a motion that a 14arrant for $100.00 be drawn on the Street Depart mentfor the purchase of this tract of land, this motion was secomided by alderman Bronse and on roll call by the Clerk, received the unanimous vote of the Council i. Alderman Hosford presented the request of Lewis & Cost for a part of the In of the City, and alderman Sanders made a motion that -the request be referred to the In Committee to ihvestigatfand make recoIImendations, this motion was seconded by -alderman and received the unanimous vote of the Council• The bids for the garbage disposal were o elned and read by the Clerk, which showed that the following bids were made; Andy Jones 1.00, Joe S.Viilson $1900,9 H.G.Ward and Oscar Wilson $25.00, and Lester Elliott 750.00, alderman Gregory made a m, that the bids be referred to a Committee to be appoimted by the Mayor, for investigatioi of facilities for hauling and disposal places offered by each bidder, this motion was s, by alderman Hosford and received the unani}nous vote of the Council. The Mayor appointed on this Committee:Aldermen; Gregory, Mchoy and Shook to be assisted by the Mayor, City Attorney and Health Officer.
