Alderman Gregory moved to go into executive session, seconded by alderman Peal
which was regularly passed by the Council, and the Mayor declared the Councillin
Executive session, after discussion of various administrative matters, alderman Bronson
moved to go out of executive session, seconded by alderman Hasford, which pias passed
unanimously by the Council, and the Mayor declared the Council in regular session:

Fayetteville City Council met in regular session, Monday, April 22nd,1940
he absence of the Mayor was noted, and alderman Shook made a motion that alderman
ayor Danders be elected Mayor Pro -tem, this motion was seconded by alderman McRoy, and was
bsent assed unanimously.
The roll was called by the Clerk,and the following answered present: Bronson, Banks,
eRoy.Peal, Sanders and Shook. Absent: Mayor, EcAllister,aldermen, Gregory and Hodford
Minutes of the regular meeting of April 15th, were read and approved.
The following bills were presented, after their approval by alderman Peal, Chairman of
the auditing committee: J.W.Shelley $15.25, Benyorter $20.00, Elmer Boyd $14.40, Hugh
Pool $9.00, Clarence Rice $,13.00, Herschel Holloway $10.00,A.F.Shumate $20.00 and
Otho Shumate $12.00.Alderman Bronson made a motion that the bills be allowed, as approv
seconded by alderman Shook, which was regularly passed by the Council.
Alderman Peal, chairman of the auditing committee, reported that they had

Alderman Gregory made a motion that the mills be allowed; as approved, seconded
by alderman Hosford, which was regularly passed by the Council.
The report of Activities of Milk Control Inspectors for period ending March 31,
1940, and the report of A.D.McAllister, as Ex -officio Chief of the Fird Department
for the month of Burch, were read by the Clerk, and alderman Sanders made a motion that
the reports•be received and filed, seconded by alderman.Pea.1, which was duly passed by
the Council: 4LZ
J.E.Brewer appeared before the Coun it and requested the Council to sus-
pend the License fees for a Carnival to be held in the near future, and sponsored by
the Veterans of Boreign Wars., after discussion, alderman Sanders made a motion that
the request be granted, seconded by alderman Peal, and on roll call by.the Clerk the
following vote was recorded: Ayes: Bronson, Banks, McRoy,Peal and Sanders. Nays:
Gregory, Hosford and Shook. And the Mayor declared carried, as there were 5 Ayes and
3 Nays.
The Mayor presented the matter of several property owners buiding retaining
walls too close to the Street, and after discussion, alderman Peal made a motion to
0.1 that the Ordinance Committee be ins`trizc$e�d to draw up an Ordinanse requiring property
owners to obtain a permit before building any retaining wall on the property line, this
motion was seconded by alderman McRoy, and recemved the unanimous vote of the Council.

Alderman Gregory introduced an Ordinance entitled " AN ORDINANCE AUTHORIZING THE
BOARD OF PUBLIC AFFAIRS TO PURCHASE A FIRE TRUCK FOR THE FIRE DEPARTMENT OF THE CITY 0
FAYETTEVILEE, ARKANSAS, AND FOR OTHER PURPOSES. F

The Ordimance was read in its entirety By the Clerk, and alderman made a motio
the rules be suspended and the Ordinance placed on its second reading,seconded by aide
Peal, and on roll call by the Clerk receibved the unamimous vote of the Council.
The Clerk read the ordimace the second time, and after discussdon,alderman Hos
made a motion that the rules be further suspended, and the Ordinance placed on its thin
and final reading, this motion was seconded by alderman Peal and was passed unanimously
by the Council.
The Clerk then read the Ordinance tYfe third and final time.
The Mayor then put the question 'Shall the Ordinance pass" and on roll call by the
Clerk the following vote was recorded: Ayes; Bronson. Danks. Gregory, Hosford? McRoy,
Peal, Sanders and Shook. Nays; None. And the Mayor declared passed, asthere were 8 Ayes
and no Rays.
Alderman Gregory.moved the Emergency clause be adopted_, seconded by alderma
Shook, which receiveed the unanimous vote of the Council, and the Mayor declared, adopt
as there were 8 Ayes and no Nays.

AN ORDINANCE AUTHORIZING THE BOARD CF EUBLIC AFFAIRS TO PURCHASE A FIRE TRU
FOR THE FIRE DEPARTMENT OF THE CITY OF FAYETTEVILLE, ARKANSAS AND FOR OTHER PURPOSES.
WHEREAS, the Board of Public Affairs of the City of Fayetteville, Arkansas
has recommended the purchase of a Fire Truck for the Fire Department of the City of
etteville,Arkansas. in accordance with'the recommmendation of the State Fire Preventi
Bureau, to the end that insurance premiums may ultimately be reduced in' the City of
Fayetteville, and
WHEREAS, the Board. od Public Affairs has estimated that the cost of such
will be approximately $3,000.00;
NWJ, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEV
ARKANSAS;
SECTION I. The Board of Public Affairs is hereby authorized and instructed
advertise for bids on the purchase of a Fire truck of the general type recommended by
the State Fire Prevention Bureau,and to let the purchase contract to the lowest 1.04,e6po
bidder at a cost not to exceed $3,000.00. ,
SECTION . II. This ordinance being necessary for the preservation of the pu
health, peace and safety, an emergency is hereby declared to exist and this ordinance
be in full force and effect from and after its passage, approval and publication.
Passed and approved this 29th day of April, 1940.
