McMullen No. 2 was read by the Clerk, alderman Sanders made a motion that his resignation'be acc
resigns seconded by alderman Hosford,which received the unanimous vote Of the Council.
W*1N.Hudson Alderman ganders made a motion that WoNoHudson be appointed as Commissioner in
.appointed Water Improvement District No,2 to fill the vacancy caused by the resignation of Jodie
Com.Water McMullen, this motion was seconded by alderman Ucker and received the unanimous vote

The first Annual report of the Commissioners of, Street Improvement District No,
Alnnual was presented, and alderman Sanders made a motion that the report be'referred to the
report auditing committee, which received,the unanimous vote of the Council.

Miss Pearl Porter appeared before the Council and registered a complaint about
the cleaning of Center Street, and after discussion, aldeman Gregory made a motion-.tha.t
the merchants be notified to clean up their places of business and warned to keep them
clean, as the Ordinance pertaining to keeping business places clean would be enforced
and that the Street committee be instructed'to try to work out some plan whereby the
alleys may be cleaned on a regular schedule. This motion was seconded by alderman Hosfo.
and received the unanimous vote of the Council.
There being no further business, alderman Bronson moved to adjourn, seconded
alderman Sanders, which was duly passed by the Council, and the Mayor declared the Coun
ad,jpurned.

by alderman Branson, which wase regularly passed by the Council.
The question of the payment of the $slarypog the Municipal Judge came up fo
discussion, and alderman Sanders made a motion that a committee be appointed together
with the kyor to confer with the Uounty Sudge'regarding the County's part of the sal
of the Municipal Judge, this motion was seconded by aderman Peal, and received the u
vote of, the Council. The Mayor appointed the follow in ,jtt $ronsods Peal and Carter:
Alderman Peal made a motion that the Mayor be authQrized to arrange for th
annual Spring cleahing, this motion was seconded by Alderman Crtar and received the
vote of the Concil.
The Mayor reported that M.S.Gabbard wanted to purchase some Ash Trees out
at the City Dump ground, alderman Sanders made a motion that the Mayor be authorized"
to make an investigation as to the location of the trees and use his discretion as to
making the salesthis motion was seconded by alderman Hosf ord and was regularly passed
Council.
Need of repairs for the City Jail and tge request of the City Library for.

Alderman Bronson introduced the followin Resolution
WHEREAS, the question of administration of Init a ve Or ante No. 1 has been dis-
cussed and
WHEREAS, in the event of its adoption by the people on April 2, 1940, the City
Council desires to clarify the question of administration of the terms of said ordinance
NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of,,,,Fayetteville,
Arkansas, that in the event Initiative Ordinance No* l'of the City of Fayetteville is
adopted.by the people, the tax or license to be charged, where a person, firm or corpo-
ration is engaged in more than one classified business operated on the same premises
or in•;,the same building; shall be. the tax applicable to the major business conducted
by .said person, firm or corporation and only one tax shall be collected.
Aldermah:*.Shook made a motion that the Resolution be adopted, seconded by aldbrman
Peal, and on roll call by the Clerk the following vote was eecorded: Ayes: Shook and
Peal. Nays: Bronson garter, kosford, Sanders and Ucker. And the Mayon declared the
Resolution rejected , as there were 2 Ayes and 5 Nays.
There being no further business, alderman Brohson moved to adjourn, seconded
by alderman Posford, which was duly passed by the Council, and,the Mayor declared the
Council adjourned., ,

Alderman Bronson made a motion that the bills be allowed, as approved, seconded by ald-
erman Carter, which was regularly passed by the Council.
W.E.MeVihorter W.E.Mc4ihorter, Hal Douglass ,Ralph Lewis and Hugh Lawson appeared before the
Hal Douglass Council to ask that they pass a Resolution as to the administration of the proposed
RalphlLewis Initiative Ordinance„� hich•is to be voted on at the general election April 2nd,1940
Hugh -Lawson The Mayor presented the request of Mrs.Dr.Ellis that the Council allow the
amount of $5.00 each month for five months, beginning April 1st to be &PP110.4 on,the
Esplanade upkeep.of Arkansas Avenue. Alderman Gregory made a motion that the request be allowed,
allowed $5.00 seconded by alderman Hosford,•which received the unanimous vote of the Councile

alderman Bronson, which was regularly passed by the Council, and the Mayor declared the
Council in executive session, after the discussion of various administrative matters.

which was passed unanimously by the Council, and the Mayor declared the Council in
regular session.
Fmre Committee Alderman darter, chairman of the Fire Committee,reported that the comx5
instructed to mittee found that they could buy a 12 ton truck, panel job with all equipment neccessar
purcha a to be included, t a considerable reduction from the regukar list price, and made a
Fire ruck motion that the Council purchase the 1-i ton truck equipped, as outlined by the committe
and to comply with the recommendation of the Fire Prevention Bureau, this motion was
seconded by alderman Hosford, ,and on roll call by the Clerk, received the following'
vote: byes; Branson, Carter, Gregory, Aosford, Peal, Shook and Ucker. Nays: Sanders#
And the Mayor dedlared, carried, as there were 7 Ayes and 1 #ay.
Alcorman Bronson made a motion that the Fire Committee be instr�uucted
to follow the usua roceedure in making the purchase of a 12 ton truck for the Fire
Department, to be Kuipped as outlined by the report of the Fire Committe, this motion
was seconded by alderman Gregory, and received the unanimous vote of the Council*
Alderman Hosford introduced the following Resolution, and moved its
adoption, secomded by alderman Peal -and on roll call by the Clerk received the follow-
ing vote: Ayes.; Carter, Hosford, Pealk Sanders, Shook and Ucker. Nays: Bronson and
Gregory. And the Mayor declared the esolution adopted, as there were 6 Ayes, and 2 Nay
n R E S O L U T I O N
WHEREAS, it has been called to the attention of the City Council of the
City of Fayetteville that there are certain ambiguities in proposed Initiative Ordinanc
No ll.of the City of Fayetteville with respect to the administration of said ordinance
in the event of its adoption:
NCNi,THEREFORE BE IT RESOLVED by the City Codncil of the City of Fayette
villa, that,in the event of the adoption of Initiative Ordinance No 1. by the qualifi
electors of the City of Fayetteville, at the general election on April 20 19400 it wi
be administered in an equitable manner as free from discrimination as possible, and e
one person, firm or corporation operating a business in one location which may have
more than one classification under the strict terms of said ordinance, will not be
charged on all classifications according to the present schedule of the proposed
ordinance.
