Present: Mayor, A.D.McAllister, City Clerk, J.W.McGehee, City Attorney Price Dickson, City Engineer, E.T.Bro1•wn, aldermen; Bronson, Carter, Hosford, Peal, Sanders, Shook and Ucker. Absent: Alderman Gregory. , The proposed Rental and Purchase Contract with Kern -Limerick, Inc. for a Crusl�ng and Screening Plant was read by the Clerk, alld after discussion, alderman Sander: made a motion that the ISayor and the City Clerk be authorized to sign said contract, thi: motion was seconded by alderman Bronson, and on roll call by the Clerk received the unanimdus vote of all members of the Council present; RENTAL AND PURCHASE CONTRACT This contract made and entered into on this the day of I• Iovember,1939,by and between Kern -Limerick „ Inc.and the City of Fayetteville, W ITIIESSETH: For and in consideration of the _payment of Five Hundred Dollars ($500.00) at the time and in the manner hereinafter mentiomed and the further sum of twenty (20Ii) cents per cubic yard of material produced by the Plant hereinafter described,to be paid by the City of Fayetteville to Kern -Limerick, Inc.; Kern -Limerick, Inc. agrees to deliver to tht City of Fayetteville F.O.BY Fayetteville one Cedar Rapids one piece crushing and screen- ing plant,size 9 x 36 crusher complete 4aith 10 ft. by 48 in* revolving screens in all sizes up to two inch all mounted on roller -bearing steel'wheels complete with necessary conveyers, steel bin and power to drive complete outfit. This plant now located at Ozark, Arkansas, to be completely overhauled and further equipped with new screen and short conveyer,the entire outfit. to be in first class mechanical condition V..i�h the usual warranties applying to new equipment. The City of Fayetteville agrees that when said crushing and snreening plant is in place and ready to begin operation that it will pat to Kern=Limerick, Inc. the sum of Five Hundred Dollars ($500.00), and that in consideration of the payment of $500.f the City of Fayetteville shall be permitted to crush 2500 cubic ,yards of material before further payments are due and thst after the first 2500 cubic yards of material have been produced by said plaint, the City of Fayutteville will pay to Kern -Limerick, Inc. the sum of twenty (20) cents per cubic yard of material produced by said plant to be determined by records of the City of Fayetteville as to production. These payments shall be con, sidered as rental for the use of said i.iachine and shall continue for a period of three i yoars, and the City of Fayetteville shall have the right and option at any time during a the term of this contract to purchase said crushing and screendng equip:nent�aT and for the sum of $5,690.00 and all payments made on the rental contract shall be applied on the purchase price of said equipment in the event the said equipment is purchased and in the event of purchase, interest shall be figured on the unpaid balances at the rate of six (6)per cent per annum. Payments shall be made on the first day of each and every month after 2500 cubic yards of material have been produced by said pant, and it isagre that said plant will be set up inplace and ready for'eperfttIM by January 1, 1940. Rescind actiom Alderman Sanders made a motion that the action taken by the Council on last oh South Monday Night, October 30th, with reference to location of sidewalks on South Locust Locu t Street Street, be rescinded,seconded by alderman Bronson, and on roll call by the Clerk,receive the following vote: Ayes: Bronson,HoNsford,Peal, Sanders, Shook and Ucker.Nays: Carter. Absent and not voting: Gregory. And the Mayor declared, carried, as there were 6 Ayesq and one Nay. To es ablish Alderman SRnders made a motion that the line for the sidewalk be establishe Line for as shown by the Red Lines on the Plat submitted, by E.T.Brown, City Engineer, of South Sidew lk on Locust Street, rron7 South Street to Fourth Street, this motion was seconded by alderman S.Locl,st Ucker, and on roll call by the Clerk, received the following vote: Ayes; Bronson, Hosford, Peal,Sanders, Shook and Ucker. Absent and not voting; Gregory. Nays: Carter. and the Mayor declared the motion carried, as there were 6 Ayes. And one Nay.
