BE IT ORDAINED by the City Council of the City of Fayetteville, Arkansas: SECTION ONE: All §hsoline pumps located on private, propertl which are capable of, or adapted to the servicing of motor vehicles while parked either on the public walkways or sidewalks, shall be licensed in the manner and for the amoun-rs now or here- after provided by Ordinance for Gasibline Curb Pumps. SECTION TWO: This Ordinance shall nottbe construed as permitting the extension of gasoline pump hose across any sidewalk within the City of Fayetteville, thereby obstruct- ing the Public Sidewalks. SECTION THREE: Any persons firm or corporation violating the terms of this Ordinance, or failing to pay the license, herein prescribed shall be -guilty of a misde eanor and punishable by a fine of not less than $19.00 nor more than $50.00. . SECTION FOUR: All Ordinance3 or parts of Ordinances in conflict herewith are hereby repealed; and it appearing that many persons, firms and corporations are using Gasoline Pumps for the servicing of motor -vehicles in the same manner as Curb Pumps, and are not paying the license required of Curb,Pump Operators, and this Ordinance being necessary for the preservation of the public health, peace and safety, an emerge cy is hereby declared to exist and this Ordinance shall be in full fot3ce and effect from and after its passage, approval and publication. REFERENDUM ' PETITION The City Clerk made a report on the new petition that had been filed asking,for a referendum on the Garbage disposal Ordinance, stating that the petition had 18 validl; signatures, and as only 12 were required, there was a sufficient number on,the petition'. The matter of calling a Special Election was discussed, but no action was taken'. There being no further business, alderman Hosford moved to adjourn, seconded by alderman Ucker, which w4s duly passed by the Council. and the Mayor declared the Council adjourned. Campbell St. The Mayor reported that the work of grading Campbell Avenue had been held up by Mr.J.R.Cooper, who claimed to have a deed to part of the Street, and it was decided work h ld up for the City Engineer, the City Attorney and the Mayor to check into the matter before proceeding further. Alderman Bronson introduced an Ordinance,entitled,"AN ORDINANCE•PROHIBITING THE SALE, OFFERING FOR SALE OR FIRING OF FIREWORKS WITHIN THE:CITY LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSASs PRESCRIBING PENALTIES FOR VIOLATIONS AND FOR OTHER PURPOSES. The Ordimiance was read in its entirety by the City Clerk, alderman Gregory made a motion that the rules be suspended and the Ordinance placed on its second reading alderman Peal seconded the motion,which received the unanimous vote of the Counuil, and the Mayor declared carried, as there were 8 Ayes, and no Nays. The Ordinance was read the second time by the Clerk, and after discussions alderman Gregory made a motion that the rules be further suspended, and the Ordi"miance placed on its third and final reading, seconded by alderman Hosford, which recedved the unanimous vote:of the Council, and the Mayor declared carried, as there were 8 Ayes.And _ no Neys The Clerk then read the Ordinance the third and final time. The Ordinance was read in its entirety by the City Clerk,alderman Bronson made a motion that the rules be suspended, and the Ordinance placed on itsssecond read- ingalderman Carter seconded the mopion, which received the unanimous vote of the Counci and the Mayor declared carried, as there were 8 Ayes, and no Nays. This motion was seconded by alderman Hosfordo and reeeived the unanimous vote of the Council. AldermanUcker made A motion that the rules befurther suspended, and the Ordinance placed on its third and final reading, seconded by alderman Bronson, which re ceived the unanimous vote of the Council. and the Mayor declared, carried, as there were 8 Ayes'* amid no Nays. The Ordinance was read the third and final time by the Clerk. The Mayor then put the question "Shall the Ordinance pass"and on roll Dal by the Clerk received the following vote: Aves: Bronson, Carter, Gregory, Hosford,Peal, Sanders, Shook and Ucker. Nays. None. And t6 Mayor declared passed, as there were 8 Ay and no Nays s; 1 Alderman Shook moved that the emergency clause be adopted, secondeg by alderman Carter, and on roll call by the Clerk received the following vote: Ayes* ronsoi, Carter, Ure ory, Hosford, Peal, Sanders, Shook and Uckere and the Mayor declared the emergency cause adopted, as there were 8 Ayes; and no Nays;
