Alderman Peal made a motion that the emergency clause be adopted, seconded by alderman Shoolk, amd on roll call by the Clerk, the following vote resulted: Ayes; Bronson, Hosford, Peal, Sanders, Shook and Ucker. Nays; None. Absent and not voting; Carter and Gregory: And the Mayor declared the emergency clause adopted, as there were 6 Ayes and no Plays. r ORDINANCE N0. 8 2 9 • AN ORDINANCE TO AMEND SECTION ONE OF ORDINANCE NO. 7 4 6 Did' THE CITY OF FAYETTEV ARKANSAS. BE IT ORDAINED, By the City Council of the City of Faye tteville,Arkansas; SECTION ONE: Section One of Ordinance no.7 4 6e is hereby amended to read as folia " That hereafter buildings of frame construction, veneerdd outside with brick, stone or other non-combustible material, and to be used as residences or apartments or apartment houses, may be erected on lots within the first fire zone, provided they are not located in the main business districts, or in such location as to•prevent any likely expansiom of said main business district or districts of the City of Fayetteville, Arkansas: and also provided that the buildings are constructed in compliance with the rules, rggulatio and other requirements described hereinafter in this Ordinance "@ SECTION TWO: All or and parts of ordinances in conflict herewith are heret repealed, and confusion having arisen as to the construction of Section One of Ordinance no.7 4 6. and this Ordinance being necessary for the preservation of the public peace, hea and safety, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage, approval and publication. VETO MESSAGE As Mayor of the City of F§yetteville, I hereby exercise my right of Veto and hereby Mayor vetos Veto Ordinance No. 8 2 9 of the City of Fayetteville, Arkansas for the following reasons Ordinance No.8 2 9. l.The Ordinance does not express terms which I consider to the best in#erest of the residents of the City of Fayetteville 2. The Ordinance is ambiguous. 3. G.C,Dakon's The Mayor presented the request of G.C.Dakon that the City re-imburse him for request having the Sewer cleaned out at his place, which he claimed was --G= City Property, after discussion, the matter was referred to Sewer Committee, The Cierk read a letter from the Farm Security Administration, relative to the alterations to be made on the Office rooms on the third floor of,the Administration building, and after discussion, alderman Sabders made a motion that the matter be r6fer to the building committee, seconded by alderman Bronson, which was passed unanimously b the Council. Alderman Bronson moved that th9 Council go into executive session, seconded alderman Peal,which was duly passed by the Council, and the Mayor declared the Council executive session, after discussidn of various administrative affairs, alderman Ucker moved that the Council go out of executive session, seconded by alderman Hosford, which ceived the unanimous vote of the Council, and the Mayor declared the Council in regular session. Representatives of the Bonding Firm of S.J,Raney & Sons, of Little Rock were resent to discuss the possibility of issuing revenue bonds for the purchase of the Elecnric ight PlAnts and presented opinions of some Attorneys that such ab issue would be legal.l- Alderman Shook made a motion that the matter be referred to the Utility Committee for further investigation, seconded by alderman Ucker, which received the unanimous vote of the Council. With reference to the Referendum Petition on Ordinance No*B28, the,City Clerk made the following report: TO HON. Alderman Gregory introduced an Ordinance, entitled " AN ORDINANCE TO EFINE THE'TERM °GASOLINE CURB PUMPS" AS USED 'IN 'ORDINANCE N0,7' 4 O.OF THE ORDINANCES OF THE CITY OF'FAYETTEVILLE,ARKANAS. I' The Ordinance was read in its entirety by the City Clerk, alderman Sanders moved that the rules be suspended and the ordinance placed on its second reading, seconded by lderman Peal, which received the entire vote of all members'of the Council, present.and Ithe Mayor declared carried, as there were 7 Ayes amd no Nays. The Ordinance was read the second time by the Clerk, and after discussion alderman Ucker made a motion that SECTION 11* be amended to read as follows: All ordinances or parts of ordinances in conflict herewith are hereby repealed and it appearing that Public Property is being used by private enterprise and evadin the terms of Ordimace No. 740 n emergency is hereby decladed to exist and this o¢'dinance shall be in full force and effect from and after its passage, approval and publication.
