Present: Mayor, A.D.McAllister, City Clerk, J.W.McGehee, City Attorney, Price Dickson, City Engineer,E.T.Brown, Aldermen: Bronson, Carter, regory, osford, Peal, Sanders, Shook and Ucker. Minutes of the regular meeting of May 22nd were read and approved. The folllowing bills were presented, after their approval by alderman Peal, chairman of thr auditing committee: Jackson cafe 69.45, Lyle Allen $)21:50;Dr:Richard Miller -2.00, Lyons Machinery Co.$20.08, $17 Ben Porter .50, A,F.Shumate $20.00, Willie Wilcox u2.00, $doss Seasly $`p3.60, Elmer Boyd $14.40, Hu h Pool 8.00, Geo. Bond $p10.25, and Ben Porter 561.75. Alderman Carter made a motion the the bi is be allowed, as approved, seconded by alderman Bronson, which was duly passed by the Council. The Garbage Disposal Ordinance, which was -passed at hhe regular meeting of May 22nd, came up for discussion, and alderman Gregory made a motion that the Emergency clause be adopted, seconded by alderman Peal, and on roll call by the Clerk, received the following vote: Ayes: Bronson, Carter, Gregory, Hosford, Peal, Shook and Ucker. Nays: Sanders. and the Mayor declared the emergency clause adopted, as thele were 7 Aye: and 1 Nay. ORD INA NC E N0. 8-2-8 AN ORDINANCE TO PROVIDE MORE SANITARY AND EFFICIENT METQDS FOR DISPOSAL OF GARBAGE,KITCHEN REFUSE,TIN CANS, DISCARDED GLASS, ETC., AND FOR OTHER PURPOSES'. WHEREAS, present methods.used in collection, hauling and disposal od garbage have proven to be very unsatisfactory, and WHEREAS, hauling of tin cans, discarded glass and other rubbish has been very unsatisfactory to residents of the City of Fayetteville, WHEREAS, accumulations of gargage Dnd refuse for long periods of time create unsanitary conditions withib the City of ayetteville; NOW, THEREFORE,BE IT'ORDAINED by the City Council of the City of Fayetteville, Arkansas: SECTION ONE. The City Council of the City of Fpyetteville,Arkansas, shall con- tract with some responsible person, firm or corporation to collect, haul and dispose of all garbage, kitchen refuse, tin cans, discarded glass, etc., and shall provide in said contract the manner in which said garbage, refuse and rubbish shall be collected, hauled and disposed of* and shall require that suchperson, firm or corporation give bond with good and sufficient surety in any sum not less than One Thousand Dolleas (81,000.00) to be approved by the Mayor of the City of Fayetteville; conditioned that said -garbage collector shall perform the conditions and requirements set forth in said contract, which shall contain a provision that the garbage collecthr shall be required to collect all garage within the City bXg of Fayetteville, without cost either to the City or residents of said City. SECTION TWO. No person, firm or corporatidm shall collect any garbage, kitchen refuse, tin cans, discarded glass, etcp.4 until and unless he shall have first made appli cation to the City Council of the.City of Fayetteville, setting forth the proposed methods of collecting, hauling and disposing of said garbage.and shall have received the approval of said City Council and entered into a contract with the City of Fayetteville, upon such terms and conditions as may be agreed upon, and have posted bond as required in Section One of this Ordinance, and any person, firm or corporation collecting,hauling or disposing of garbage, kitchen refuse, tin cans, discarded glass,etc.,without first having.haying,received the approval of said City Council and having posted bond as herei required shall be deemed guilty of a'misdemeanor, and shall be punished by a fine of not less than $5.00 nor more than $50:00, and'each day of such collection,' hauling and dis- posal shall constitute a separate offense.Provided, however, that this section shall not apply to any person hauling or disposing of his,own tin cans, broken,glass, etc., so lon as the hauling and dispoding of same by such individual does not constitute a nuisance or,cregte unsanitary conditions* provided further that all tin -cans, broken glass and other.kitchen refuse except garbage shall be deposited at the dumping ground provided by the City of Flyetteville. SECTION THREE. There is hereby levied a tax or fee to be known as "REFUSE DIS- POSAL TAX" to be paid by residents or businesses availing themselves of the services herein provided as follows, to -wit: For each esidence .... :.......:........$1.00 per annum For each otel, Restaurant or Boarding House ........................2.5@ per annum SECTION FOUR. The tax or fee provided in Section 'Three hereof shall be collecte by the person, firm or corporation contracting to collect the garbage, refuse, etc.,; and upon failure or aefusal of anyperson availing himself of the services herein pro- vided, the garbage collector may refuse to collect, haul or dispose of said tin -cans and other refuse until said tax is paid. Provided further that.upon failure to pay said tax or fee; the City of Fayetteville may, at its election, order the garbage collectob to collect, haul and dispose of said refuse, and any person, firm or corporation who shall permit refuse, .tin -cans, broken glass and other rubbish to accumulate on their owr property except for the purpose of facilitating the collection of same by the garbage collector,or deposit said refujQ,tin-?ans, b oke lass aid of er rebiek� on any other property within the corporate its o FayetEevii 19, shal� be eeme gui ty of A mis- demeanor and upon conviction thereof shall be punished by a fine of not less than Five Dollars ($5.00) nor more than Fiftj Dollars ($50.00) and each day said tin -cans, etce are permitted to remain on the owners premises or each time said tin -cans, etc are dept ited on other property within the City of Fayetteville in violation of this ordinance shall be considered a separate offense. Garbage,shall be kept in.a separate.container from other kitchen efuse such as tin cans.. discarded glass.etc.; the garbage container to be tightly covered. quipped with handles and kept in a place accessible and convenient to the garbage and efuse collector in order to facilitate handling. Alderman Bronson made a motion that the bills be allowed, as a seconded by alderman Ucker, which was duly passed by the Coubeil. quite a number of owners of Meat Markets and Restaurants appeared before the Council and asked for an adjustment on the fees -charged for license. after discussion, alderman Sanders made a motion that a committee of three be appointed to confer with Dr. Roy Turner -to see if a satisfactory adjustment could be worked out and report next Monda Night, this motion was secondedE by alderman Peal,which'was regularly passed by the Cou and the Mayor appointed the following committee; Sanders, Bronson and Peal. Miss Suzanne C.Lighton'appeared to ask the Council to take some action to require the Jerpe Dairy Products Co: to l IfdXAl itJYa iA76%x to eliminate Odora which she said were adversely affecting property owners and business houses on Dickson and nearby Streets. The Mayor asked a committee, consisting of aldermen ; Sanders, Hosford and Uc and City Atorney, Price Dickson to confer with the Plant owners to see if something can worked out to eliminate the odors, which are said to'tome from a buttermilk condenser. Alderman Aronson introduced an.ordinance, entitled " AN ORDINANCE TO AMEND TION ONE OF ORDINANCE N0. 7 4 6. OF THE CITY OF FAYETTEVILLE, ARKANSAS: The ordinance was read in its entirety by the City Clerk, alderman Bronson m t the rules be suspended and the ordinance placed on its second reading, seconded by Ucker, which was regularly passed.by the Council. The ordinance was read the second time by the Clerk, and after discussion, all Sanders moved that the rules be further suspended, and the ordinance placed on its thdrd and final reading, seconded by alderman Peal, and on roll call by the Clerk was passed unanimously.
