.Fayetteville City Council met in regular session, Monday, May the 22nd, 1959.

Minutes of the regular meeting of May 15th, were read and approved.
The following bills were presented, after their approval by alderman Peal.. C}airman of t
auditing committee:'Jackson cafe $7.55, City Water Plant 4$0.60, Winkleman's rint shop
$p15.30, W.R..Spencer 4$2.75, Ross Seasly $p4.5¢, Ben Porter S17#50# Elmer Boyd $ 14.40, ugh
Pool- $16.00p A.F.Shumate $20.0o and Willie. Wilcox $12.00. Alderman Bronson made a motion
that the bills.be allowed, asapproved.iseconded by alderman Carter, which was duly pass
by the Council.
With reference to ordinance No.8 2 7 ( the Sound ruck ordinance), which was
passed at the regular meeting of May 15th, the Mayor declared the Emergency Clause
as there were 4 ayes and 2 Nays,

"AN ORDINANCE PROHIBITING THE USE OF SOUND TRUCKS ON THE STREETS OF THE CITY OF
FAYETTEVILIE, FACING PENALTIES FOR VIOLATIONS AND FOR OTHER PURPOSES."
WHEREAS, the use of electrical amplifying systems used on automobiles touring the
streets of Fayetteville has become a nuisance to the residents of said City , and
WHEREAS, it is the desire of the City of Fayetteville to prevent the use of so -c
sound trucks, and public address systems upon the streets of said City.
NOW,THEREFORE, Be It Ordained by the City Council of the City of Fayetteville:
SECTION ONE: It shall be unlawful for any person, firm or corporation to use loud
speakers,'sound trucks, public address systems, electrical amplifying systems or other
calculated to, or actually amplifying normal sounds; upon any sktddXA of the streets. of
the City of Fayetteville;provided however that amplifying"systems may be used when necc
nary for the public welfare, such necessity to be determined by the Mayor, who shall is
permit, if in his judgment such necessmty exists. Failure to secure the permit herein
provided shall be punishable as provided in Section Two df this Ordinance.
SECTION TWO: Any person, firm or corporation vidlating the terms'of Section One
ordinance shall be deemed guilty of a misdemeanor and upon conviction shall'be fined i
any sum not less than Five'Dollars ($5.00)nor more than Fifty D rs ($50.00), and ea
day of said violation shall be deemed a seperate offense.

SANITARY AND EFFICIENT METHODS FOR DISPOSAL OF GARBAGE, KITCHEN REFUSE, TIN CANS,DI
GLASS,,ETC., AND FOR OTHER PURPOSES,
The Ordinance was read in its entirety by the City Clerk, alderman Bronson iyove
that the rules be suspended, and the ordinance placed on its second reading, seconded
alderman Peal, and on roll call by the Clerk, received the following vote; Ayes: Brons
Carter, Hosford, Peal Sanders and Shook. Nays; none. Absent, and not voting: Gregory
Uckers and the Mayor declared, carried, asthere were 6 Ayes and no Nays.
The Clerk read the ordinance the second time, and after discussion, alderman B
moved that the rules be furtherysuspended, and the ordinance placed on its third and f
reading, seconded by alderman Hosford, which reeeived the following vote: Ayes; Bronso
Carter, Hosford, Peal, Sanders and Shook. Nays; None. Absent and not voting; Gregory a
Ucker.And the Mayor declared, carried, asthere were 6 Ayes and no Nays.

The Mayor then put the question. "Shall the Ordinance pass" on The Clerk calling the loll
the following vote resulted: Ayes: Bronson. Carter, XXX .9 Hosford and Peal. Nays: Saride4�s
and Shook. Absent and not voting: Gregory and Ucker. The Mayor. declared, carried., as there
were 4 Ayes and 2 Nays
No vote was taken on the Emergency Clause

or the Judge, Earl Hand as Acting Ohief of Police, Clyde Walters, as Fire Chief and as Buildinr�g

Aril. Collector, Alderman Shook made a motion that the reports be recedved and filed, seconded by
alderman Bronson, which was duly passed by the Council. I
Alderman Sanders moved that the Council go into executive session, seconded by alderman
Shook, which was duly passed by the Council, and the Mayor declared the 6Council in executive

go out of executive session, seconded by alderman Sanders, whit was regularly passed by
the Council, and the Mayor declared the Council in regular session,
There being no further business, alderman Peal moved to adjourn, seconded by alderman
Carter, which was ddu�ly passed by,the Council, and the Mayor declared the Counuil adjourined@
