Fayetteville City Council met in regular session, Monday, March 27th, 1939.
Present: Mayor, A.D.McAllister, City Clerk, J.,61!.McGehee, City Attorney, Price Dickson,
City Engineer, E.T.Brown, aldermen: Bronson, regory, Hosford, Peal, Sanders, Shook
and Ucker. Absent: Alderman Carter. I -
Minutes of the regular meeting of March 20th, were read and approved.
The following bills were presented, after their approval by alderman Peal, chairman of
the auditing committee: Jackson Cafe $10.60,J.Shelley $p12.00,Lile Allen $12.509
H.C.Trail $10.00,Lyons Machinery Co.$3.06,Philli s Motor Co.$97.84 Skelley Oil Co. 46901,

Alderman Sanders made a motion thajs the bills be allowed, as approved, seconded by alder
Bronson, which was duly passed by the Council.

XXTyajxr"Xi X) A communication was read from the Board of Trustees of the City Hos-
pital,lwhich contained the followingXZQibZdtXbKXXX.
Alla a meeting of the Trustees of the Fayetteville City Hospital held on March 22,1939,
Phe following resolutionbwas unanimously adopted:
"That whereas B.H.Stone is now a non-resident of this State,thereby making it impos
>ible for him to attend any of the Board meetings of the Fayetteville City Hospital, there
'ore, that he be, and is, declared no longer an active trustee but shall be known as an
ionerary Trustee of such Board of Trustees of the City of Fayetteville City Hospital,
ind the Secretary shall advise the Mayor of the City of Fayetteville of this change and
isk thht such vacancy be filled by the Mayor and XX-dX Ciby Council of the City of Fayette-
rille"

i Alderman Ucker made a motion that the communication be received and filed, secobded by

lderman Shook, which was passed unanimously by the Council.
Annex of Bates The matter of refunding the City Water Bonds came up,for discussion, and it was de
ed to postpone action till next meeting.
Addition I The Council discussed the poss(bbiItity of extension of the City limits to the Bates
postponed. pdditimn, but decided to postpone acti6n for the present time.
Alderman Gregory introduced an ordinance, entitled " AN ORDINANCE RELATING TO
EEPING, RUNNING AND MAINTAINING OF CERTAIN nMUSEMENTS.

The ordinance was read in its entirety by the City Clerk, alderman Brohson moved
hat the rules be•suspended, and the ordinance placed on its second reading, seconded by
lderman Shook, and on roll call by the Clerk , received the following vote:Ayes; BDonsoi
regory, Hosford,-Peal, Sanders, Shook and Ucker. Absent and not voting: Cartero and the
ayor'declared, carried, as there were 7 Ayes and no Nays.
The Clerk read the ordinance the second gime, and after discussion, alderman Gregor
oved that the rules be further'suspended, and the ordinance placed on its third and fins
reading, seconded,by alderman Hosford, which received the following vote: Ayes: Bronson,
regory, Hosford,•Peal, Oanderes, Shook and Ucker. Absent and not voting: Cartdr, and the
Mayor declared, carried, as there were 7 Ayes and no Nays.
1.The Clerk read the ordinance the third and final time.
The Mayor then put the question " Shall the Ordinance pass". On the Clerk calling
the roll, the following vote resulted: Ayes: Bronson, Gregory, Hosford, Peal, Sanders,
Shook and Ucker•. Absenjti and not voting Carter. "nd the Mayor declared , carried, as
there were 7 Ayes, and no Nays.

AN ORDINANCE RELATING TO KEEPING,RUNNING AIJD MAINTAINING OF CERTAIN AL4US'EMENTS.
BE IT ORDA INED'AND ENACTED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS;
SECTION 1.' That insofar as Ordinance No.734, entitled:
" AN ORDINANCE RELATING TO CERTAIN OBJECTIONABLE AMUSED:?ENTS",
Passed and approved April 20, 1931, shall prohibit or make it unlawful for any associt;
either incorporated or not incorporated, of students and/or faculty of the University
of Arkansas, .located oh the Campus of the University of Arkansas, to keep, run, mainta'I
or be interested or connected with the keeping, running, or maintaining of billiard
and pool tables for hire at such location,it shall be and the same is hereby repealed;)
and insofar as such Ordinance•as amended shall make mt unlawful to permit a mmnor under
the age of eighteen (18) years to loiter, play or participate in such amusements,when
carried on as herein set out,it is hereby repealed;
SECTION 2'r Any such association of students, and/or faculty,with a place of bus-
iness located on the Campus of the University of Arkansas shall be permitted to play,
participate or soperate such games, but such places shall be under the supervision and
superintendency of a responsible person or persons and no such games shall be permitter
to 'operate either for hire or without hire at any place 4here such supervision or
superintendency.is not present;
SECTION 3 All ordinances or parts of ordinances in conflict herewith are here
repealer
SECTION 4. If for any reason, any portion of this Ordinance shall be held inval'
such ualidikyX invalidity shall in no wise affect the remaining portions thereof, whid
are valid, but such valid portions shall be and remain in full force and effect.

Alderman Sandmtrwuced the following Resolution, amid moved its adoptiongiffiich motion
was seconded -by alderman Peal, upon the roll call there were seven"(7)votes in the
affirmative, alderman Carter being absent and not voting.the Mayor thereupon declared the
Resolu#ion adopted, said resolution is in words as follows. towit:

Be it lnesolved•by the Ciyy Counuil of the City of Fayetteville, that the City
Attorney be and hegis hereby authoPed and directed to take such steps or -action as may
be necessary to condemn'all property or damage to same as may be miecessary_to enable the
completion of the Lafayette Street Overpass Project' over the Frisco Rail Road.

alderman Sanders moved -its adoptions The motion was seconded by alderman Ucker, and
