V 451 , The following reports for the Month of January, were read by the Clerk; J.C.Massie Janu as Police Judge, Earl Hgnd as actig Chief of l!�olice, Clyde Walters, as Fire Chief and Reports as Building Inspector,R oy Nix as Sewer Service Oolletor, J.W.McGehee as City Collector and as City Clerk. Alderman Bronson made a motion that the reports be received and filed seconded by alderman Ucker, which received the unanimous vote of the Council The Clerk read a commmnication from P-.M.Brickey of Sherman, Texas, asking information Letter, about relatlive, to a Franchise for the operation of a RjaX City Bus line, in the City of City Bus Line Fayetteville. Alderman Gregory made a motion that the matter be referrddto the Street Committee, with power to act, seconded by alderman Hosford, which was duly passed by the Copneil. Clean up Week discussion, Mayor presented the proposition of "Clean up !'leek" for the City, and after discussion, Alderman Sanders made a motion to have the "Clean up !'leek", and to leave the setting of the time, to the discretion of the Mayor, alderman Peal seconded the motion which received the unanimous vote of the Couneil. Vi.C.Irihitfield appeared before the Council, and asked for "Special Parking Priveleges" in front of his place of business on NidthEast Street , after discussion, it was decide al to take no action. Alderman Gregory amd Mayor McAllister made a report on the trip of the committee to Little Rock that day in the interest of the Gasoline Turnback bill for the Cities, but expressed a doubt as to the success of their trip. AN ORDINANCE TO PROVIDE FOR THE EMPLOYMENT, SUSPENSION AND DISCHARGE OF MEMBERS OF THE EOLICEE DEPARTMENT AND FIRE DEPARTMENT OF THE CITY OF FAYETTEVILLE, REPEALING ALL LAWS OR ORDINt%NCES IN CONFLICT HEREWITH AND FOR OTHER PURPOSES. WHEREAS, under the terms of Act 28 of the Acts of the General Assembly of the State of Arkansas for the year 1933, a so-called civil service was set up for the police and Fire Depattments of Cities of the First Class, and WHEREAS, under Section 18 of said Act the question of whether or not any • City shall operate under said act, may be submitted to the electors of such City for approval or rejection, and WHEREAS, under the holding of the Supreme Court of Arkansas in the case of Stockburger Vs. Cruse, 191 Ark.page 822, that Court said that Section 18 of said Act wa; in recognition of the rights of municipalities to regulate their own affairs under Amendment No.7 to the Constitution of the State of Arkansas, and V'iHEREAS,under the authority of said 6ection 18, the question of whether or 1 said Act should apply to the Police and Fire Department of the City of Fayetteville, was submitted to the electors of the City of Fayetteville, Arkansas, at the ai}nuq election held in April, 1934, at which election said Azt was approved by a majori y of those voting on the question and by said approval became effective as 'to the Police and Fire Departments of the City of Fayetteville sand WHEREAS the approval of said Act 28 by the voters of Favettev lle wa s an approval as is contemplated by Amendment No.7 to the Constitution of the tate Arkansas, and 390 0$DINANCE N0. 825 CONTINUED. The Mayor shall supervise the conduct of all membersof the Police aiudXP�a and Fire Departments of the City of Fayetteville and shall choose and appoint the Chief of the Police Department and the Chief of the Fire Department who shall hold their offices until the following election for Mayor, and umtil their successors are appointed by the incoming Mayor, unless sooner removed for cause; provided thisSection shall not prohibit the Mlaymr from choosing and appminting a Chief of Police and a Chief of the Fire Department for a period less than the term for which the Mayor is elected. SB6TION 11. The Mayor shall have the right to suspend for inefficiency, misconduct, or neglect of duty, the Chief of W61X AX the Police Department and Chief of the Fire Department until the next regular,or adjourned, or special meeting of the City Council; at which meeting he shall lay the matter before the City Council, and unless his action be approved and the Chief be removed from office at such meeting within five days thereafter, by a vote of a majority of the Council elect,the.suspension shall cease; provided , no officer shall twice be suspended for the same cause. SECTION 111, The Chiefs of Police and Fire Department may suspend for inefficiency or misconduct any subordinate, in their depai3tments, and it shall be Y.XgXdvtyX their dutyl. tc forthwith report their action to the Mayor with reasons for suspensions, with recommen- dations, and the Mayor shall have power on recommendation alone of the Chiefs of the tIllice and Fire Department to remove any subordinate member of the police and fire departments.) SECTION lVe This ordinance is hereby declared to be severable,and if any part,'section, paragraph,sentence, clause or phrase of this ordinance is held to be unconstitutional orl in violation of any state law, if applicable, the remaining parts of this ordinance shall not be affected thereby. SECTION V`. All lawspparts of laws, ordinances or parts of ordinances in conflict herewith are hereby repealed aired especially Act 28 of.the Acts of the General Assembly for the ,year i9330appraved by the voters of Fayetteville at the general election held on April 3, 1934;and it appearing that there is much confusion in the Police and Fire Departments _ of the City of Fayetteville, because the present system of operating the rolice and FdLre Departments are not designed for, and adaptable to conditions within the City of Fayetteville and much dissension and justifiable criticism has arisen by reason of the short -comings hof Act 280 approved by the voters; and this ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and tj}ils ordinance shall take effect and be in full force from and after its passage, approval and publication. ATTEST •�V_�j �� APPROVED to •dX • 4 � The Mayor presented the proposition of Mr. John Bynum with reference to selling a Roof Coating for the hoof of the Fire Department Building,alderman Peal made a motiom thate matter be referred to the#Fire Committee, with power to act, seconded by alderman Ucker, whieh was passed by the unanimous vote of all members present. (being 7 in number) Messrs. Rainey and Allen appeared before the Council and presented a proposition to refund the "Callable" Bonds of the City Water Department, and after discussion it was decided to postpone action till next regular meeting og the Council. The Mayor asked approval of a warrant issued to,J.K.YGregory for $19.67, for expense bN of a Cmmmittee to Little Rock, March 13th in the interest of the Gasoline Turn -back for the 6ities, also one issued to E.T.Brown for a Committee to Little Rock on the same date inthe interest of the City Air Port, for $ 20.10, alderman S%ook made a motion that the Warrants be approved, seconded by alderman Peal, which was duly paased by the iouncil.
