Fayetteville City Council met in adjourned session, Tuesday, December 27th, 1938.
resent: Present; Mayor, A.D.McAllistee, City Clerk, J.Fd.McGehee, City Attorney, Price Dickson,
City Engineer, E`;T.Brown, Aldermen: Bronson,Carter, Gregory, Peale Sanders, Shook and
Ucker. Absent: Alderman Hosford.
SIinutes; Minutes of the regular meeting ,of December 19tho were read and approved.
The following bills were presented, after their approval by alderman Peal, chairman of
the auditing committee:: Jackson Cafe 4.9*00,Jones Truck line $6.39, Ben'Porter $17.501,
Bills* Bud Collins $4*000 Elmer Boyd $2.00; A.F*Shumate $20200�e Willie Wilcox $12.00y and
' Otho Shumate $4.00. Alderman Bronson made a motion that the bills be allOwed,as approve(

1 &62 ,Alderman Gregory introduced an ordinance, entitled "AN ORDINANCE TO FIX LICENSE
FEES ON TRUCKS' AND TO PROVIDE FOR THE APPLICATION 01 DISCOUNTS FOR LICENSE FEE ON ALL C1
UNDER CERTAIN CONDITIONS AND FOR OTHER PURPOSES.
The Ordinance was read in its entirety by the City Clerk* alderman Gregory move
the rules be suspended, and the ordinance placed on itssecond reading, alderman Carter

The Clerk tten read the Ordinance, the third and final time.

and Uckera bays; none. Absent and not voting: Hosforde and the Mayor ddeclare,d passed ,
as there were 7 Ayes, and no Nays.
Alderman Bronson moved that the emergency clause be adopted, alderman Shook
seconded the motion, and on roll call by the Clerk, the following vote resulted: Ayes;
Bronson, Carter, Gregory, Peale Sandwers, Shook and Ucker. Nays: none. Absent and not
voting; Hosford. The Mayor declared the emergency clause adopted, as there were 7 Ayes
and no Nays*
ORDINANCE N0. 821 +—
AN ORDINANCE TO FIX LICENSE FEES ON TRUCKS AND TO PROVIDE FOR THE APPLICATION
OF DISCOUNTS FOR LICENSE FEE ON ALL CARS UNDER CERTnIN CONDITIONS AND FOR OTHER PURPOSE!
BE IT ORDAINED by the Council of the City of Fayetteville, Arkansas:
SECTION'le Beginning on January 1, 1939, there shall be collected as a license
on trucks the fees fixed in the following schedule, to -wit:
One -Half ton,truck ... ....................... 5.00
Each Additional one- half ton .01.0400.0604.06000000*2.50
SSCTION 2* There shall hereafter be paid upon all trailers used in connection
with tractors the sum of $2.50 for each one-half ton of capacitj'.
SECTION 3e When any motor driven vehicle becomes subject to the payment of
license, after the expiration of the period in which discounts are allowed, the owner
of said motor driven vehicle may secure a license for the amount which would have been
due, had said vehicle been subject to,the payment of a license during the period of
discount next preceding the time said vehicle shall become subject to the payment of li
.Provided, however, that in order to secure a license at the discounted rate, in accorda
withthe provisions of this Section, the owner shall make applicationfor said license
within ten days after said vehicle shall have become subject to the payment of license,
and the City Clerk and Collector may demand Bill of Sale or such other evidence as he
deems proper in order to detemine whether or not application has been made within t�ffiXa,
said ten day period.
SECTION 4 . The license provided under the ordinances of the City ofFayettevi
and under this ordinance may be reduced for such time and from time to time aj ,the City
Council of the City of Fayetteville may determine to be just and proper and said reduct
expressed by a resolution duly adopted by sadd City Council in the manner now prescribe
by law.
SECTION 5. Where reference is made to capacity of motor driven vehicle in th
ordinance it shall refer to the rated capacity prescribed or suggested by the manufactu

ORDINANCE N0. 822.
AN ORDINANCE PRESCRIBING THE MANNER OF ASSIGNING PARTS OF THE PUBLIC STREETS OF
THE CITY OF FAYETTEVILLE, FOR CAB STKNDS AND PROHIBITING CABS FROM USING LOCATIONS OTHER
THhN THOSE ASSIGNED AND FOR OTHER PURPOSES.
BE IT ORDAINED, by the Council of the City of Fayetteville, Arkansas:
' SECTION 1. That the City Council of the City of Fayetteville shall as soonas
possible assign to tQxi cabs a suitable number Qf parking spaces in the City of Fayette•
ville, Arkansas, in such locations as in the judgment of the City Council willbest serve
the residents and businesses of the City of Fayetteville, Arkansas,.
SECTION 2. fihat the assignment of locations for cab stands shall be designated by
a resolution of the City Council aforesaid and that immediately after said stands are
assigned it shall be the duty of all cab operators within the City of Fayetteville to
use said stands so long as any of said cabs are parked on the streets of•the City of
Fayetteville. Prmvided, however that this Ordinance shall not prohibit the receiving
and discharging of fares, on call, in the normal conduct of their business.
SECTION S. Immediately after the passage of the resolution provided in Section%
two(2) hereof a/copy of said resolution shall be delivered to all persons, firms,
partnerships, and/or corporations ownimg and operating taxi cabs companies Within
the City of Fayetteville, Arkansas, in order that said persons, firms and/or corporatiot
may be fully advised as to the locations assigned to them.
SECTION 4. All cabs not actually in use shall be removed from the public streets
of the City of Fayetteville and shall not remain parked on said streets except in those
placesdAN designated by the City Council.
SECTION 5.
Immediately after the passage
of the resolution designating parking

the streets of Fayetteville,
Arkansas, except in thebse spaces

or for the purpose
of receiving or discharging
fares shall be deemed guilty of
a mis-
demeanor and shall
be punished by a fine of not
less than Five Dollars ($"5.00)
nor more
than Twenty-five Dollars
(4$25.00).
SECTION 6. All ordinances and parts of ordinances in conflict herewith are here'
repealed, and it appearing that there are two cab stands within one-half block of the
fire station and that said cabs create considerable congebtion, and this ordinance beim
neccessary for the immediat6 preservation of the public health,peace and safety, an M616'
emergency is hereby declared to,exist, and this ordinance shall be in full force and JJ
effect from and after its passge., approval and publication.

Alderman Gregory made a motion that City Engineer E.T.Brown be authorized to
make a survey of the City Air Port for the purpose of making a topographical map to,
to accompany the W -P -A Project to be submitted, alderman Sanders seconded the motion
which was duly passed by the Council.
Alderman Gregory made a motion that the Street Committee confer with the cab
drivers as to space to be allotted them under the provision of Ordinance no.•822.
alderman Carter seconded the motion, which was duly passed by the Council.
There being no further business, alderman Bronson moved to adjourn, 6di§M
