Fayetteville City Council met in regular session, Monday Oct.3Ist,I938.
Present: Mayor,A.D.McAllister, City Clerk, J.W.McGehee, City Attorney, Brice Dickson,
City Engineer, E.T.Brown, Aldermen; Bronson, Carter, Gregory, Hosford, Peal, Sanders,
Shook and Ucker.
Minutes -of the regular meeting of October 24th were read and approved.
The following bills were presented, after their approval by alderman Peal, chairman of

Alderman Bronson made a motion that the bills be allowed, as approved, and that
the City Clerk be instructed to draw warrants for the same upon the proper funds, alderman
Ucker seconded the motion, which was duly passed by the Council.
Bernal Seamster appeared before the. Council and presented apetition Of the
.Industrial Finance Co., requesting a.permit to re -roof and make minor 'repairs on a
warehouse building, located on lot I5F in block 6 County Court Plat, on which , the Building
Inspector had refused to issue a permit.
Alderman Sanders made a motion that the request
be granted, alderman Ucker seconded the motion, and on roll call by the Clerk, the fol-
lowing vote resulted;Ayes; Sanders and Ucker. Nays: Bronson, Carter, Gregory, Hosford,
Peal, and Shook.
And the Mayor declaredthe motion lost as there were 2 Ayes, and 6 nays.
Alderman Bronson made a motion that the Fire Chief and the Fire Committee ask
for at least three bids on some Fire Hose, and report back to the Council, alderman Peal
seconded the motion, which was passed unanimously by the Council.
There being no furtheP business;, alderman Bronson made a motion to adjourn,
seconded by alderman Hosford, which was duly passed by the Council*
and the Mayors declared the Council adjourned.

After discussion, alderman Gregory moved that the recomendation of the Finance Committee
be accepted „seconded by alderman Peal, and upon the question being put before the Council
the following vote resulted; Ayes: Aldermen ; Bronso �ArCa;rter, Gregory, Hosford, Peal,)
anders, Shook and Ucker. Nays:none. The Mayor declare �s �he�e were 8 ayes and no nays.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE' ARKANSASO
SECTION ONE: That the rate of Taxes for the Cit GENERAL FUND purposes, for the
year I938, be, and the same is hereby declared to be E' dills on each dollar of
assessed valuation of all real and personal property within the corporate limits of the
City of Fayetteville, Arkansas, as shown by the assessment books for State and Coumty
purposes, and that the same is hereby levied: and the Mayor and City Clerk are hereby
authorized and directed to certify this levy to the County Clerk of Washington County,
Arkansas, to the end that the same be placed on the Tax Books and collected with

Center The Mayor reported the matter of having complaints from the Highway Department
(Parking relative to the Center Parking on the Square and more especially on the south
on South side, since that is a part of the Highway, and it was decided to discontinue)
side of Squarthe Center Parhing,on the south side. '
Alderman Gregory made a motion that the City Buy Two Copies of the new City
Bly Two Directory which is to come out about February Ist 2939, one for the Police
Copies of Department and one for the City Clerk's office., alderman Shook seconded the m. %
w{DirectorlC m otion, and on roll call the following vote resulted: Carter* Gregory, Hosford
Peal, Sanders, Shook and Ucker. Nays none. Abseny and not voting: Boson,
and the Mayor declared the motion carried.
Repair Sewer The matter of the Sewer Line on Storer Street still leaking, was reported,
and after discussion, aldermanSanders made a motion that the City make a temporary
oStorer repair, seconded by alderman Hosford, on which,the following vote resulted:Ayes;
Street Bronson,Hosford, Peal,Sanders, Shook, and Ucker.Nays: Carter and Grggor

Alderman Ucker made a motion that the City Attorney be instructed to draft
a Ten _DDaz Notice to the Commissioners of Sewer Improvement District No.I and
.and Annex No. I to Sewer Improvement District No. I, as a prerequisite to removal
from office, alderman Peal seconded the motion , which received -the rollowing
vote: Bronson, Carter, Gregory, Hosford, Peal, Shook and Ucker. Nays: Sanders,
and the Mayor declared the motion carried,as there were 7 Ayes and 3XKYXX I Nay,
Alderman Gregory introduced an ordinance, entitled " AN ORDINANCE DECIARINy.
CERTAIN PROPERTY WITHIN THE CITY OF FAYETTEVILLE�s ARKNSZS',, TO BE A NUISANCE AND
MENACE TO PUBLIC HEALTH AND SAFETY: ORDERING ITS REMOVAL AND FOR OTHER PURPOSES.
The Ordinance was read in its entirety by the City Clerk. Alderman Bronson
moved that the rules be suspended, and the ardinance placed on its second reading
Alderman Carter seconded the motion, which received the following vote:Bi$sam,
Carter, Gregory, Hosford, Peal, Sanders and Shook. Nays; Ucker. and the .Mayor
declared passed, as there were 7'ayes. and one nay. The Clerk read the drdinance
$h eosecond time, and after discussion , Alderman Gregory moved that the rules be
further suspended, and the Ordinance pled on its third and final reading.
Alderman Pea; seconded the motion, which received the following vote: Ayes:
Bronson, Carter, Gregory, Hosford, Peal, Sanders, and Shook. Nays; Ucker.
And the Mayor declared the motiom carried, as.�there were 7 Ayes.and I nay.
The Clerk then read the Ordinance,the third and final time .
The.Mayor tjlen put the question, " Shall the Ordinance pass% On the Clerk
calling the roll, the following vote resulted; Ayes: Bronson, Carter, Gregory,
Hosford, Peal and Shook. Nays : Sanders and Ucker. And the mayor declared passed,
as there were 6 Ayes and 2 Nays:,
Alderman Gregory moved that the emergency clause be adopted, alderman Carter
seconded the motion, and on roll call by the Clerk, the following vote resulted:
Ayes: Bronson, Carter,,Gregory, Hosford, Peal, and Shook. Nays: Sanders and Ucker
The Mayor declared'the'Emergency Clause adopted, as there were 6 Ayes. and 2 Nays.

TO BE A NUISANCE AND MENACE; TO PUBLIC HEALTH AND SAFETY; ORDERING ITS REMOVAL AND FOR
OTHER PURPOSES.
WHEREAS4 the owner of the following described property to -wit:
A part of Lot Fifteen (I5), Block Six (6), County Court Addition to the City of Fayette
•ville, Arkansas, described as beginning at a point, which is I45 feet South, and I32 fe
West of the Northeast Corner of said Lot Fmfteen (I5); and running thence South, to the

NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNUIL OF THE CITY OF FAYETTEVILLE,

The Mayor reported that the " House Keepers Aid" Project had asked that the Counv'il
r:furnish LIGHTS and GAS for their department this winter, after some discussion, alderman
Ucker mae a motion tat the Mayor appoint a committee to investigate the proposition,lwith
power to act,.alderman.Shook seconded the motion. which was passed unanimously, and the
following committee was appointed:BFoson, Peal and Shook.
Alderman Gregory made a motion that the Council recommend to the Board of Public
Affairs, that they purchase One Thousand 0(1000) feet of Paregon Fire Hose from

Lafayette Street, to Dickson Street, it was decided to put in another request or a
