HomeMy WebLinkAbout1938-08-22 Minutesf 34.9 Alderman Gregory introduced an ordinance, entitled "Ali ORDINANCE TU EE(clUltlh ADEQUATE WATER FOR THE PROPER FUNCTIO14ING OF PRIVATE SEWER LINES':. The ordinance was read in its entirety, by the City Clerk. Alderman Sanders moved that the rules be suspended, and the ordinance be placedon its decond reading, alderman Hosford seconded the motion, which was duly passed by the Council. The Clerk read the ordinance the second time, and after.discussion, alderman Bronson moved that the rules be further suspended and the ordinance be placed on its third and final reading, aldermab Peal seconded the motion, which carried unanimously. The Clerk then read the ordinance the third and final time. The Mayor then put the question "Shall the ordinance pass". On the Clerk calling the roll, the following vote resulted; Ayes: Bronson, Carter,Gregory,Hosford,Peal, Sanders Shook and Ucker.•Nays: None. Alderman Gregory moved that the emergency clause be adopted, alderman Hosford seconded the motion, and on roll call by the Clerk, the following vote resulted; Ayes: Bronson, Carter, Gregbry,Hosford,Peal,Sanders, Shook and Ucker. Nays; None . The Mayor declared the emergency clause adopted, as there were 8 ayes and no Nay ORDINANCE N0. 9,II. AN ORDINANCE TO REQUIRE ADEQUATE WATER FOR THE No. SII. The minutes of the regPlar meeting of August I5th, were read and approved. The following bills were presented, after their approval by alderman Peal, chairman of the auditing committee, Faubus Cafe $6,30; Skelley Oil Co.$5.36, Ben Porter 17,50, Bud Collins $I2.002 Elmer Boyd $I0.00, Emmett Boyd $8.00, Herschel Holloway 6.00,'Jim Younger $5.002 Geo. Bond $4.00, A.F.Shumate4$20.00, and Willie Wilcon $12,00. Motion was made by alderman Bronson that the bills be allowed as approved, and the City Clerk be instructed to draw warrants for the same upon the proper funds the motion was seconded by alderman Shook and was duly passed by the Council. The following communications were read by the Clerk: No.1. From an "Interested Visitor" suggesting a remedy for noises caused by heavily loaded trucks passing near the Hotels at night. NO.II. From R.C.Frambers & Co. relative to combining the audit Of the City Plater Plant and the City General Records. .. WHEREAS, It has come to the attention of the City of Fayetteville that there Ord, to are private sewer lines connected to the sewer mains in the City of Fayetteville orce which do nod have water connections and, water connections WHEREAS it is recognized that a private or public sewer system will not opera o the without an adeAuate supply of water and, s ever . WHEREAS, it is neccessary for all sewer lines to be wonnected at all times with a suiltable supply of water. NOVI, THEREFORE,BE IT ORDAINED by the City Council of the City of Fayetteville, Arkansas: SECTION I. All- sewers now or hereafter connecting to any sewer system within th City of Fayetteville, Arkansas, shall also connect to the water system of the City of Fayetteville, Arkansas, for the purpose of securing the proper functioning of the sowage system. SEC^1ION II. Said connections shall be made in the manner now prescribed by . ordinances and by regulations of the City Water Department of the City of Fayetteville Arkansas. Section III-. Any person, firm,or corporation failing -or refusing to comply with the terms of this ordinance shall be deemed guilty of a misdemeanor, and shall be punished -by a fine of not less than One Dollar ($I.00)) nor more than Fifty Dollars ($50.00),and each day the terms of this ord4nance are violated, shall be considered a a seperate offense. SECTION IV, This ordinance shall be cumulative to all other ordinances of th City of Fayetteville; Arkansas, and shall repeal only such ordinances or parts of ordinances as may be in direct conflict herewith. SECTION U. Because of the unsatisfactory disposal of sewage in the City of Fayetteville, Arkansas, which condition is a menace -yo the public, health, and safety of the residents of the City of Fayetteville, an emergency is hereby declared and thins ordinance shall be in full force and effect from and after its passage, K approval and publication. After discussion of the communication from Frambers & Co., it was decided that the Idayor should write them and ask for more definite informatkon as to plan and pri of proposed audit. Alderman Grgory made a motion that the communications be received and filed, alderman Peal,SecondedA the motion, which was passed unanimously by vote of the Counc -The Mayor presented the proposition of the University of Ark.having alarge sto tank for sale, also one by the Fayetteville Ice Co., Alderman Gregory made a motion that the propositions be referred to the Stree Committee -for investigation, withpower to act Aldermah Hosford seconded the motio which received the unanimous vote of the Council. Alderman Shook seconded the motion. whmch was duly passed by the Council. Alderman Sanders made a motion to accept the proposal of R.C.Frambers &.Co. to make the combined audit of the City Water Plant and the City General Records, fo; the sum of $250..•00. Alderman Peal seconded the motion, which was passed unanimous by the Council, Alderman Sanders made a motion thajc the amount of $I50.00 be allowed to pay for the "Allbright lot." at the corner of "Ida"and "Greg" Street for the use of the State Highway Department. Alderman Peal seconded the motion, and on roll call by the Clerk, was passed unanimously. • There being no further business, alderman Sanders moved to adjourn, Seco; by alderman Bronson, which was duly passed by the Council, and the Mayor declared Council adjourned.
