Fayetteville City Council met in regular session, Monday, August I5th I938.
Present;,MayoB, A.D.McAllister, City Clerk, J.W.McGehee,City Attorney, Price Dickson,
City Engineer, E.T.Brown and Aldermen: Bros on, Carter. Gregory, Hosf ord, Peal, Sanders.
Shook and Ucker.
The minutes of the regulat meeting of August 8th were read and approved.
The following bills were presented, of� r eir approval by alderman Peal, chairman

Motion was, made by alderman Gregory that the bills be allowed, las
approved, and that the City Clerk be instructed to draw warrants for the same , upon the proper X
funds, the motion was seconded by alderman Shook and was passed unanimously by the Council.
Earl Hand, Acting Chief Of Police, appeared before the Council, and asked for
one Special Police, to serve each Saturday after noon and Night, from 2 P.M. till 2 A. .
Alderman Bronson made a motion that his request be granted, alderman Peal seconded the
moticnK,which was passed inanimously by the Council.
The following reports for July, wergsread by the Clerk: Clyde Walters as Building
tsinspector and as Fire Chief, J.C.Massie, as Police Judge, Earl Hand,as acting Chief ofX
Police Roy Nix as Sewer Service Collector, J.W.McGehee,as City Collector and as City 6lerk.
Alderman Ucker made a motion, seconded by alderman Carter that the reports be
received and filed, which was duly passed by the CoTincil.
Alderman Ucker made a motion that a legal notice be prepared by the city Attorney
and mailed by the City Clerk to the Commissioners of Sewer Ikprovement District No. I
relative t(b repair of pavement on Rollston Ave. Motion was seconded by alderman Shook,
and was passed unanimously by the Council. ,

IMPROVEMENT DISTRICT NO I AUGUST I8th I938.
GENTLEMEN: At the request of the City Council, you are requested to repair Rollston
Street where the sewer district opened a ditch for the purpose',trepairs on the sewer line.
This repair must be done immediately. For your information, the City of Fayettevilles
material, with which this street may be repaired, and also has employees, experiencedlin
putting down this paving,and will be glad to sell yo the material at actual cost, and feels

Alderman Gregory introduced an ordinance, entitled "AN UEDiNANUBTV MZWU-Lnr,
ADEQUATE WATER FOR THE PROPER FUNCTIO14ING OF PRIVATE SEWER LINES:.
The ordinance was read in its entirety, by the City Clerk. Alderman Sanders
moved that the rules be suspended, and the ordinance be placed k gA on its decond
reading, alderman Hosford seconded the motion, which was duly passed by the Council.
The Clerk read the ordinance the second time, and after discussion, aldermarn
Bronson moved that the rules be further suspended and the ordinance be placed on its
third and final reading, alderman Peal seconded the motion, which carried unanimously.
The Clerk then read the ordinance the third and final time.
The Mayor then put the question "Shall the ordinance pass". On the Clerk calling
the roll, the following vote resulted; Ayes: Bronson, Carter,Gregory,Hosford,Peal,
Sanders Shook and Ucker.•Nays: None.
Alderman Gregory moved that the emergency clause be adopted, alderman Hosford
seconded the motion, and -on roll call by the Clerk, the following vote resulted; Ayes:
Bronson, Carter, Gregory,Hosford,Peal,Sanders, Shook and Ucker. Nays; None .
The Mayor declared the emergency clause adopted, as there were 8 ayes and no Nay

AN ORDINANCE TO REQUIRE ADEQUATE WATER FOR THE
Pio• II. PROPER FUNCTIONING OF PRIVATE SEWER LINES..
Ord, to WHEREAS, It has come to the attention of the City of Fayetteville that there
are private sewer lines connected to the sewer mains in the City of Fayetteville
f orce which do nots.have water connections and,

connections VnUNEAS it is recognized that a private or public sewer system will not oper
o the without an ade4uate supply of water and,

WHEREAS, it is neccessary for all sewer lines to be monnected at all times
with a sudtable supply of water.
NOW, THEREFORE,BE IT ORDAINED by the City Council of the City of Fayetteville,
Arkansas:
SECTION I. A13L sewers now or hereafter connecting to any sewer sys§em within t
City of Fayetteville, Arkansas, shall also connect to the water system of the City of
Fayetteville, Arkansas, for the purpose of securing the proper functioning of the
sewage system.
SECTION II. Said connections shall be made in the manner now prescribed by .
ordinances and by regulations of the City Water Department of the City of Fayetteville
Arkansas.
Section IIP• Any person, firm,or corporation failingror refusing to comply
with the terms of this ordinance shall be deemed guilty of a misdemeanor, and shall be
punished -by a fine of not less than One Dollar ($I.001) nor more than Fifty Dollars
($50.00),and each day the terms of this orddnance are violated, shall be considered a
a seperate offense.
SECTION IV, This ordinance shall be cumulative to all other ordinances of tY
City of Fayetteville, Arkansas, and shall repeal only such ordinances or parts of
ordinances as may be in direct conflict herewith.
SECTION V. Because of the unsatisfactory disposal of sewage in the City of
Fayetteville, Arkansas, which condition is a menace $o the public, health, and
safety of the residents of the City of Fayetteville, an emergency is hereby declared
and thins ordinance shall be in full force and effect from and after its passage, Ktw
approval and publication.

There being no further business, alderman Ucker made a motion to adjourn,
alderman Carter seconded the motion,�which carried unanimously and the Mayor
declared the Council adjourned.

Motion was made by alderman Bronson that the bills be allowed as approved,
and the City Clerk be instructed to draw warrants for the same upon the proper funds,
the motion was seconded by alderman Shook and was duly passed by the Council.

heavily loaded trucks passing near the Hotels at night.
No.II. From R.C.Frambers & Co. relative to combining the audit Of the City
Water Plant and the City General Records.
