Fayetteville City Council met in regular session Monday ,August the Ist, I938;

The minutes.of the regular meeting of July the hth were read and approved..
Alderman Gregory made a motion that the Council adjourn till Tuesday, August the XIX
2 ond, atn 8 oclock P.P,4. Alderman Bronson seconded the motion, which passed unanimous,-
ly, and the Mayor so declared. I.

Fayetteville City Council met in adjourned session, Tuesday, August 2 ond, 2938.

The following bills were presented, after their approval by
alderman Peal, chairman of the auditing committee. Southwestern Gas & Elec-

A motion was made by alderman Shook that the bills be allowed,
as approved, and that the City Clerk be instucted to draw warrants for the same , uponl
the proper funds. The motiom was seconded by alderman Bronson, and was duly passed by
the Council,
A committee represe�(ting the Tam Companies , appeared before the Council, with a pro -1
posed plan for Zonir� the City, and requesting that an Ordinance be passed, to fix said
Zones, and to establish a fixed Taxi Cab Fare within said Zones, After discussion
by the Council, alderman Gregory made a motion that City Attorney, Price Dickson file Ali
written opinion, within Two Weeks, as to whether or not the Council has the X%)§XXI
authority to pass an Ordinance Qf this kind. Alderman Carter seconded the motion, and `
on roll call by the Clerk was passed unanimously.
The question of the Commissioners of Water Improvement District # 2 came up for discuss-
ion, and alderman Gregory made a motion , that the City Clerk send a written notice tol
each member of the Commissioners of !Vater Improvement District # 2, requesting that they K
appear before the Council, next Monday Night, August the Sth, at 8 oclock, to discuss
the condition of said district. I The motion was seconded by alderman Hosford,
and on roll call by the Clerk, was passed unanimously.

om* of about the condition of I,LAhX Water Improvement District # 2, and,since the request for
ater Dista financial statement of this district,which was made at the rgular meeting of the Cou
no.2 July the I8th,has not been complied with, a motion was passed at the meeting of the
Council, Tuesday Night, August the 2nd, instructing the City Clerk,' to mail a written
request to each member of Water Improvement District # 2, to appear before the Counci
next Monday Night, August the 8th, at 8 oclock, for the purpose of discussing the con-
dition of said district.

Geo.Pappas of theMajestic Cafe, appeared beforeK the Council „ and stated that he had
started to erect aframe building,on the back of his lot,not knowing that it was in the
"Fire Zone",but that he had been stopped by the Building Inspector, and was asking peri
sion of the Council,to go ahead and complete the building. After discussion by th(
Council, alderman Gregory made a motion, to refer the matter, to jhe building A mi
inspector, alderman Peal seconded the motion, and on roll call by the Clerk, was passe(
unanimously.

The proposed Ordinance, relating to the disposal of garbsge,tin cans, refuse etc., which
was left on its second reading,at the regular meeting of the Council July 25th, -,came up
-for discussion, and alderman Bronson made a motion that it be referred to the Ordinance
Committee and City Attorney. This motion was seconded by alderman Sanderd', and on
.roll call by the Clerk, the following vote resulted; Ayes: Bronson, Hosford,SRnders and
Shook. Nays: Carter, Gregory, Peal and Ucker. There being 4ayes and 4 nays, the Mayor,
then cast his vote against the motion, and declared the motion lost.
Alderman Carter then made a motion to refer the matter to the (X[ Street Committee,
seconded by alderman Gregory, and on roll call by the Clerk, the -following vote resulted;
Ayes: Carter, Gregory,•Hosford, Peal and Shook. Nays: Bronson, Sanders and Ucker.
And the Mayor declared, passed, as there were 5ayes and 3 nays.
The Mayor presented the matter, of complaints being made, about :'Bad Odors" originatin
from the Jerpe Dairy Products Co., also the matter of complaints about the proposed
insallation of a "Grist M'll" in th "W G aha er " a d a o' t� a co it
consisting of Aldermen anders anR Hod Bird anR �i� A �'otne , Prpi�e�t son, age gg
with the Mayor, to confer with Gilbert Swanson, manager of the Jerpe Dairyrr• Products C
relative to the complaints about his plant, and also to confer with Mr Graham about t
proposed installation of the Grist Mill in his building.

Alderman Gregory intrmduced an ordinance, entitled " AN ORDINANCE,EXTENDING A PART OF
THE FIRE ZONE OF THE CITY OF FAYETTEVILLE, ARK."
The Ordinance was read in its entirety, by the City Clerk, Alderman Bronson moved that
the rulesbe suspended, and the Ordinance be placed on its second reading. Alderman
Carter seconded the motion, which was duly passed by the Concil.
The Clerk read the Ordinance the second time, and after discussion, alderman Sanders
moved, that the rules be further suspended, and the ordinance be placed on its thlnrd
and final reading, alderman Hosford seconded the motion which,carried unanimously.
The Clerk then read the ordinance, rhe third and final time.
The Mayor then put the question, "Shall the Ordinance pass". On the Clerk calling
the roll, the following vote resulted; Ayes:Bronson, Carter, Gregory, Hosford, Peal,
Sanders, Shook and Ucker. Nays; none.
Alderman Shook moved that the emergency clause be adopted, alderman Peal seconded
the motion,and on the Clerk calling the roll, the following vote resulted; Ayes:
Bronson, Carter, Gregory, Hosford, Peal,Sanders, Shook and Ucker. Nays; None: The
Mayor declared the Emergency Clause carried, as there were 8 Ayes and no Nays.
ORDINANCE N0. BIO.
"AN ORDINANCE EXTENDING A PART OF THE FIRE ZONE OF THE CITY OF FAYETTEVILLE, ARK."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section I� The fire zone of the -City of Fayetteville.,Arkansas is hereby extended, t
include the following territory, To -Wit:
Beginning at the intersection of the East
line'of Rollston Avenue, and the North line of Dickson street, and running thence,
North -along the East line of Rollston Avenue I83.8 feet; thence East, 4I8 feet:
thence Suuth, to the North line of Dickson Street; Thence West,along therth line of
Dicksoft street to the place of beginning.
Section Two: All ordinances and parts of ordinances in conflict herewith ar
hereby repealed.

Section Three: In view of the fXdXK expansionof the business area on Dickson
Street, and the desire to erect business buildings, and this ordinance being necces
Bary for the preservation of the pJAce, health and safety of the residents of the C

full force and effect, from and after its passage, approval and publication.

Motion made by alderman Bronson that bhe bills be allowed, as approved, and that

Bert Watson appeared before the Council and asked relief from fines for over -
parking. After discussion by the Council, alderman Peal made a motion that the
matter be left to the discretion of the Police Judge, alderman Carter seconded
the motion, and on roll call by. the Clerk, was passed unanimously.
Dr.Turner appeared before the Council and made a statement relative to the
unsanitary conditions existing in certain parts of theCity, and alderman Peal made N
a motion that the ordinance relating to Sewer connections, be amended to include
Dr. Turn r "Water" connections, to the end that said ordinance, when amended, would go a long
about way toward correcting the unsanitary conditions mentioned by Dr. Turner. This mo -

The Commissioners of Water Improvement District # 2 appeared before the Council,
in response to a written request from the Council, for them to do so, and after a
