Present: Mayors A.D.McAllister, City Clerk, J.W.McGehee; City Attorney, Price Dickson, City Engineer, E.T.Brown, and Aldermen: Bronson, Carter, Hosford, Peal, SAndersip Shook, and Ucker. Procter Johhson and John Ballard appeared before the Council on behalf of the American Legion and the D.A.V., who are sponsoring a carnival on the "Stone" lot this week, and asked that the Council rescind the price of the privilege tax for same. And alderman Ucker made a motion that their request be granted, alderman Sanders seconded the motion, which was passed unanimously by the Council, and the Mayor so declared. Prof. Merrivveather appeared before the Council, and presented the proposition of paving Cleveland street and Garland avenue, and askedfor aid from the City, to the amount of $626.00, to be applied on the cost of paving Garland ave., with the under- standing that XNDM the County would pay the same amount,and balance to be paid by the property owners. Alderman NDN Bronson made a motion that the matter be referred tdo the Mayor, City Attorney, and the chairman of the street committee for investigation, and report at,the next regular meeting of the Council. This motion was seconded by alderman Peal, and on roll call by the Clerk, was passed unanimously. The report of the Commissioners of Pairing District No. 35 was read by the Clerk i and after discuss ion by the Council,it was decided to defer action to ne-ft regular meeting of the Council. A letterN was read by the Clerk, from the Civic Committee of Chamber of Cpmmerce�who had been appointed to secure options on tracts of land, proposed to be used tM sites for Parks;. This report showed, that the committee had secured prices on two proposed sites,with two others to,V hard from at an early date. Amotion was made by alderman Sanders and seconded by., cker that the report be received and filed, and on roll call by the 61erk was passed unanimously. A letter was read by the Clerk, from -the Department of Public Utilities, addressed to the "Mayor of Fayetteville", Arkansas, notifying him of a hearing, to be held in Litt16 Rock, Ark., in the offices of the Department off Public Utilities, on Friday,July 29th, I9383at 2.30 P.M., with reference to the application of the South Westerin Gas & Electric Co., and the Oklahoma Gas & Electric Co. for a certificate of convenience and necessity, to construct a 66,000 volt transmission line, between Fayetteville and Vanburen, Arkansei City Inspctor, Clyde Walters, reported that a vacancy had occurred on the Electrical �! Examining Board, caused by F.L.Morgan of the South Western Gas & Electric Co, having been transferred from here, and suggested, that Marvin Murphy of the South Western Gas & Electric Co.,be appointed to take Mr.Morgan's place. alderman Ucker made a motion that Marvin Murphy be appointed, seconded by alderman Carter, and on the questio being put before the council, received the unanimous vote, and the Mayor so declared. Aldermmn Sanders introduced an ordinance entitled " AN ORDINANCE TO PROVIDE MORE SANITARY AND EFFICIENT METHODS (FOR DISPOSAL OF GARBAGE, KITCHEN REFUSE, TIN CANS,' DISCARDED GLASS, ETC .,AND FOR OTHER PURPOSES". The Clerk read the Ordinance in its entirety, the first time Alderman Sanders Moved that the rules be suspended and 'rhe. Ordinance placed on its second reading*This motion was seconded by alderman Carter, and upon the Clerk calling the roll, tj3e following vote resulted; Ayes: Aldermen Broson,Carter, Hosford, Peal,Sanders, Shook and Ucker. Absent and not voting:Alderman' Gregory. The Mayor declared the motion carried, as there were 7 Ayes. and no Nays. Alderman Shook made a motion yhat the Ordinance Committee prepare an Ordinanc e)(tend ing the Fire Zone on the North side of Dikkson Street, beginning at Rollston Street and extending East, to the West line of Dyke Bros* property, and extending North from ' Dickson Street, a distance of I8I.8 Ft., over this area. Alderman Ucker seconded the motion, which was duly Passed by the Council. Companies , appeared before the Council, with a pro -I posed plan for Zoning the City, and requesting that an Ordinance be passed, to fix said Zones, and to establish a fixed Taxi Cab Fare within said Zones. After discussion by the Council, alderman Gregory made a motion that City Attorney, Price Dickson file Ali written opinion, within Two Weeks, as to whether or not the Council has the � h X authority to pass an Ordinance 9f this kind. Alderman Carter seconded the motion, and on roll call by the Clerk was passed unanimously. The question of the Commissioners of Water Improvement District # 2 came up for discuss- ion, and alderman Gregory made a motion , that the City Clerk send a written notice tol each member of the Commissioners of Water Improvement District # 2, requesting that they X appear before the Council, next Monday Night, August the 8th, at 8 oclock, to discuss the condition of said district. I The motion was seconded by alderman Hosford, and on roll call by the Clerk, was passed unanimously. COPY OF MOTION FOLLOWS: _ Commissioner of Water Improvement District m 9 pear Sir: Due to the fact ,that so many complaints are being made to the Council about the condition of IUKhX Water Improvement District # 2, and,since the request for a financial statement of this district,which was made at the rgular meeting of the Cou July the I8th,has not been complied with, a motion was passed at the meeting of the Council, Tuesday Night, August the 2nd, instructing the City Clerk; to mail a written request to each member of Water Improvement District n 2, to appear before the Counci next Monday Night, August the 8th; at 8 oclock, for the purpose of discussing the con- dition of said district. Geo.Pappas of theMajestic Cafe, appeared beforeK the Council „ and stated that he had started to erect aframe building,on the back of his lot,not knowing that it was in the "Fire Zone",but that he had been stopped by the Building Inspector, and was asking per sion of the Council,to go ahead and complete the building. After discussionby tthh Council, alderman Gregory made a motion, to refer the matterto the building X inspector, alderman Peal seconded the motion, and on roll call by the Clerk, was passe unanimously. • The proposed Ordinance, relating to the disposal of garba e,tin cans, refuse etc., whi was left on its second reading,at the regular meeting of She Council July 25th, -,came u -fbr discussion, and alderman Bronson made a motion that it be referred to the Ordinanc Committee and City Attorney. This motion was seconded by alderman Sanderbk, and on .roll call by the Clerk, the following vote resulted; Ayes: Bronson, Hosford,Sanders an Shook. Nays: Carter, Gregory, Peal and Ucker. There being 4ayes and 4 nays, the Mayo then cast his vote against the motion, and declared the motion lost. it Alderman Carter then made a motion to refer the matter to the 9i Street Committee, seconded by alderman Gregory, and on roll call by the Clerk, the following vote resulted; Ayes: Carter, Gregory, Hosford, Peal and Shook. Nays: Bronson, Sanders and Ucker. And the Mayor declared, passed, as there were 5ayes and 3 nays. The Mayor presented the matter, of complaints being made, about !'Bad Odors" originating from the Jerpe Dairy Products Co., also the matter of complaints about the proposed insallation of a "Gr est Mill in th "V/ G aha er " a d a o' t a co it consisting of Alderman Sanders ana Hod drrd aaW r�i� a oi•neny, Prpi�e�i��son, �Se�Rgli with the Mayor, to confer with Gilbert Swanson, manager of the Jerpe Dairy:p: Products Co. relative to the complaints about his plant, and also to confer with Mr Graham about the proposed installation of the Grist Mill in his building.
