HomeMy WebLinkAbout1938-06-24 Minutes3.3.9 Fayetteville City Council met in regular session Monday June 20, 1938. Present: Mayor A. D. McAllister, City Clerk, J. W. McGehee; City Attorney, Price Dickson; City_ Engineer.; E. T. Brown; Aldermen: Bronson, Gregory, Hosford, Peal Shook and Ucker. Absent: Carter and Sanders. Mintues: Mintues of the regular meeting of June 13th were read and approved with the exception of the following corrections, viz.- As to the motion of Mr. Ucker to have attorney draft Ordinance repealing Ordinance No. 665; As to the first reading oOrdinance #808 and as to Ordinance #808 being presented by Alderman Gregory instead of City Attorney Price, Dickson. Bills: The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee: J. W. Shelley, p5.75; S. W. Bell Telephone Comppany, $54.75; Salsbury General Shop, $1.00; Coles Cafe, $10.60; Alexander Typewriter I%ompany, .$.60.00; Ozark Grocer Company, $2.20; N. 1,11: Arkansas Times, $7.20; Skelly Oil Company, 40.75; Salsbury General Shop, $5.00; The Automotive, Inc., $0.51; Cloe'.Hazlett; 14.00; Dave Rose, 011.50; City Water Plant, $24.15, George Bond, "4.25; Harold Boyd, X5.2.5; Elmer Boyd, 12.00; Emmett Boyd, $12.00; Bud Collins, x;12.00; Herschel Holloway, $3.50; Ben Porter, $17.50; Bill Swaney, $2.00; A. F. Shumate, $20.00; Billie Wilcox, $11.00; Alderman Bronson moved that the bills be allowed as approved and that the Clerk be in- structed to draw warrants for same on the proper funds. The motion was seconded by Alderman Shook and carried unanimously. City Clerk, J. V1. McGehee read a peitition from Webb H. Williams asking permission to install a Gasoline Pump and sign at the Phillips Motor Company. Alderman Bronson . moved that dbbion on the petition be postponed until the next regular meeting. Alder- man Ucker seconded the motion which carried unanimously. The following motion was presented by Alderman Bronsons "Due to the fact that there is an apparent ill feeling and a general lack of harmony between the members of the Sevier Commission of Sewer Improvement District #1 and of the i*Me# to Sewer Improvement Distr' #1 and that such ill feeling and lack of harmony among the members of the commission is prejudicial to the best interests and the proper conduct of the Affairs of said Improvement Districts.* I move that the City Clerk be instructed to write a letter to each member of the said Commission enclosin a copy of this motion and requesting their resigination at their earliest convenience. Alderman Gregory seconded the motion which was unanimously passed by the Council. The matter of insurance for employees of the Water Department was discussed. Alderman Bronson moved that the matter be referred to the Permanent Insurance Committee. The motion was seconded by Alderman Hosford and received the unanimous vote of the Council. A motion to adjourn by Alderman Gregory, seconded by Alderman Bronson was duly passed by the Council. The Mayor declared the Council adjourned. r APPROVED ATTEST Q yy �— City Glerk Mayo." Fayetteville City Council met in call session Friday, June 24, 1938 for the purpose of considering agreement and proposals of the Arkansas State Highway Commission in connect ion with the proposea Lafayette Street over -pass to be built by the Highway Commission. Present: Mayor, A. D, McAllister, City Clerk, J. P1, McGehee, City Engineer, E. T. Brown, City Attorney, Price Dickson and Aldermen: Bronson, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Absent: Carter. Mayor McAllister stated the purpose of the meeting, after which Mr. Poe of the Highway ,Department, presented the proposals of the Highway Commission. After a general dis- cussion of the plans and probable costs to the city, the following resolution was pre- sented by Alderman Sanders who moved its adoptionp Alderman Gregory seconded the moticm which received the following vote: Ayes: -Bronson, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Absent and not voting: Carter. The Mayor declared the resolution carried as there were seven Ayes and No Nays. I /U� "RESOLUTION" WHEREAS, the State Highway Commission of the State of Ahkansas is desirous of constructing State Highway near and through the City of Fayetteville and is desirous of routing the traffic through the City of Fayetteville over such streets as may be desig- nated and marked as State & Federal Highways by the Arkansas State Highway Commission and across all intersecting streets. and WHEREAS, the -State Highway Commission of the State of Arkansas is desirous of re- ceiving_Fede-ral aid for the improvement of said highway; and WHEREAS, the Bureau of Public Roads of the Department of Agriculture of the United States of America will not participate in the construction of said highway until and ue unless the City of Fayetteville will agree to refrain from .permitting enroachments upas the right of way of said above mentioned route, and until and unless the City of Fay- etteville will agree to refrain from passing ordinances or laws fixing unreasonable speed limits on the said above mentioned route, and until and unless the City of Fay- etteville will agree to rey�rain from erecting signs, semaphores and signals that *ill give preference to local r4455utes or that will hinder or delay traffic on said above route. THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the City of Fayette- ville that, for and in consideration of the State Highway Commission of the State of Arkansas and the Bureau of Public Roads of the Department of Agriculture of the United k States of America constructing said highway adjacent bo the City of Fayetteville and routing the traffic through the City of Fayetteville over such streets as may be de- signated and marked as State and Federal Highways by the Arkansas State Highway Commis- sion and across all intersecting streetsp it hereby agrees with the State Highway Commission of the State of Arkansas and the Bureau of Public Roads of the Department of Apriculture of the United States of America that it will not in the future permit c. 1 i , 340 encroachments upon the right of way of said above mentioned route, nor will it pass any ordinances or lags fixing unreasonable speed limits on the above mentioned route, nor will it allow the erection of signs, semaphores and signals that will give perference t( local routes which intersect with said above mentioned route, nor that will slow up, hir der or delay traffic on said above mentioned route. The motion was seconded by Alderman Bronson, which received the following vote: Ayes: Bronson, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Absent and not voting - Alderman Carter. Je1cA-l-list( Mayor of City of Fayetteville be and he is hereby authorized and directed, for and in the name and behalf of the City of Fayetteville, to sign the name of said City to that certain agreement between the City of Fayetteville and the Arkansas State Highway Commission relative to the construction of Lafayette Street overpass, passed and adoptei the 24th day of June, 19,388 by this Council. Motion by Gregory and seconded by Shook that the Street Committee be instructed to pre- pare the papers necessary to acquire the Fulbright property at a cost of $3500.00, the deed, abstract and check of the City to be held in escrow, pending the letting of the contract by the Highway Department. Upon the question being put before the Council it resulted in a unanimous vote in favor of the same. There being no further business, Hlderman Shook moved to adjourn.
