338 Present Minutes: Bills: Dues in Arkansas M-&nicipa League cupat Tax Police vacation Emerge Clause Fayetteville City Council met in regular session Monday June, 13, 1938. Mayor, A. D. McAllister; City Clerk, J. Vie. McGehee; City Attorney, Price Dickson, City Engineer, Be T. Brown, Aldermen: Bronson, Carter, Gregory, Hosford, Peal, Sanders Shook and Ucker. • The minuted of the regular mebting of June 6, were read and approved. The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee: Ozark Grocer Company, $3.75; Mrs. Loretta Sexson, 130.00; H. C. Trail, $16.00; We E. Evans, $1.00; Ben Porter, $17.50; Bud Collins, $p12.00; Emmet .Boyd, $10.00; Herschel Holloway, $2.25; A. F. Shumate, $20.00; Billie Wilcox, $12.00; Walter S. Duggans, $1.81. Alderman Bronson moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funds. The motion was seconded by Alderman Ucker and carried unanimously. Alderman Hosford moved that the balance of the dues for this year (to September 1st) in the Arkansas Municipal League, amounting to $40.00, be paid and that we continue 1 membership in the same for one year from September 1, 1938 to September 1, 1939. Upc the Clerk calling the roll, the following vote resulted: Ayes: Bronson, Gregory, Hosfo Peal, Shook, Nays: Carter, Sanders, Ucker. The Mayor declared carried as there were five Ayes and three Nays. r W. E. McWhorter -and Roy Wood appeared before the Council askin g that the Council pass an Ordinance for an Occupation Tax for the City of Fayetteville. After some discussion by the Council, Alderman Sanders moved that the Mayor appoint a committee of three to check into the matter and refer it back to the Council as soon as possible. Alderman Carter seconded the motion which received the unanimous vote of the Council. After discussion of the.Ordinances pertaining to Apartment Houses, Alderman Ucker moved that the City Attorney prepare at once an Ordinance repealing Ordinance No. 665 and maks reaffective the provisions of Ordinance -oto. 610. Alderman Carter seconded the motion which received the unanimous vote of the Council. Mr. W. F. Thomas representing the Southwestern Gas & Electric Company, was present and explained the new rate now in effect and said that the change was so small as to be scarcely noticeable; a saving of about 13� to the average customer. The matter of allowing the police a vacation was discussed. Alderman Ucker moved that they be allowed two weeks vacation provided they arranged to take it by September 1st. Alderman Peal seconded the motion which received the unanimous vote of the Council. The Ordinance referred to above was introduced by Alderman Gregory and entitled " AN ORDINANCE PROVIDING AND REGUTATING THE ©ONSTRUCTION, ERECTION AND BUILDING OF APARTMENT HOUSES, REPEALING CONFLICTING ORDINANCES APD FOR OTHER PURPOSES". The Clerk read the Ordinance in its entirety. Alderman Gregory moved that the rules be suT ended and the Ordinance be pilaced on its second reading. alderman Hosford seconded the motion which was duly passed by the Council, and the Clerk read the Ordinance the second tope. After discussion Alderman Sanders moved that the rules be further suspended and the Ordinance be placed on its third and final reading. Alderman Shook seconded the motion, which carried unanimously. The Clerk then read the Ordinance the third and final time. The Mayor then put the question, "Shall the Ordinance pass". On the Clerk calling the roll the following vote resulted. Ayes: Bronson, Carter, Gregory, Hosford, Peal Shook and Ucker. Nays: Sanders. The Mayor declared the Ordinance passed as there were seven AyeE and one Nay. %X.: rr Alderman Gregory moved that the Emergency Clause be adopted. This motion was s by Alderman Bronson and received the unanimous vote of the Council. ORDINANCE N0. 808. "ANT ORDINANCE PNOVIDING AND RFGULATING THE CONSTRUCTION, ERECTION AND BUILDING OF IvIENT HOUSES, REPEALING CONFLICTING ORDINANCES AND FOR OTHER PURPOSES." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION One.. Permits for the construction, building or erection of apartment Houses shall be granted only in the manner provided in ORDINANCE No. 610 or the Ordinances of the City of Fayetteville, Arkansas, which provided for publication of application for. permit, and reference to the City Council in the event protests were filed with the Building Inspector within the time provided in said ORDINANCE No. 610. SECTION Two.- All ordinances or parts of ordinances in conflict herewith and particular. ly ORDINANCE No. 665, are hereby repealed; and this ordinance being necessary for the preservation of tTT�e peace, health and safety of the residents of the City of Fayettevil: an emergency is hereby declared and this ordinance sharil be in full force and effect from and after its passage, approval and publication Passed and approved this 13th day of June, 1938, ATTEST_ G�v: Cly Ulerke Published in the Northwest Arkansas Times June 14, 1938.
