Brown, Ald- ermen Bronson, Carter, Gregory. Hosford, Peal, Sanders, Shook, Absent; Mayor A. D. Mc- Allister and Alderman Ucker. Alderman Gregory moved that Alderman Sanders be elected Mayor pro tem to serve during Mayor YcAllister's absence. Alderman Hosford seconded the motion which carried b:the following.'votdy.+yes;_Bronson;cCarter, Gregory; Hosford, Peal, Shook. Nays; Sanders. Alderman Sanders w:=.seated. as Mayor pro tem. Minutes of the regular meetings held January the 3rd, 1938, and January 10th, 1938, were read and approved. The following bills were presented after their approval by Alderman Peal, Chairman of the Auditin Committee; Winkelman Print Shop $5.61, S. T. Bell Telephone Co. $58.49, Coles Cafe ;3.55, N. 4Y. Ark. Times N4.83, Emmett Boyd $10,25, Bill Hayes $5.50, Bud Collins $3.75, Ben Porter $17.50, Harper Brush Works $30.34, A. F. Shumate $20.00, Earl Hand $1.60, Ozark Gro Co. 113.75, Alderman Bronson moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funds. Alderman Shook seconded the motion which carried unaninously. Alderman Gregory moved that the bill held over from last meeting for $25.00 for tires sold the Street Dept by the Fire Dept be reduced to $15.00 and allowed. Alderman Peal seconded the motion which received the entire vote of the Council. The report of goy Nix, Sewer Service Collector, covering the period from October, 1936, to October, 1937, was read by the Clerk. Alderman Gregory moved tha` the report be re- ceived and filed. The motion was seconded by Alderman Peal and was duly passed by the Council. D. Id. Allen of the State Police Dep't appeared before the Council urging the Council to pass an Ordinance giving the Police Judge ce-)tain rights relative to State duties. City Attorney Price Dickson stated to the Council that the Police Judge is given the right or power by statute to act as Justice of the Peace. Alderman Gregory moved that the City Attorney so inform the Police Judge. Alderman Hosford seconded the motion which carried unanimously. A number of coal dealers were present asking the Council to pass an Ordinance regulati selling of coal and operation of coal yards. They were advised to agree as to desired regulations and to present same to XNA in writing to the Council. The matter of issuing free City car licenses was again discussed. Alderman Bronson ma a motion that no free City car licenses be issued. Alderman Gregory seconded the moti On the Clerk's calling the roll the following vote resulted; Ayes; Bronson, Gregory, Hosford, Peal, Sanders, Shook, Nays; Carter. Absent and not voting; Ucker. The Mayor declared carried as there were 6 Ayes and 1 Nay. A motion to adjourn made by Alderman Hosford and seconded by Alderman Shmok was duly passed by the Council and the Mayor declared the Council adjour d. Attest;_ Approved; City Clerk. Alderman Hosford sec- onded the motion which carried unanimously. Minutes of the regular meeting held January 17, 1938, were read and approved. F. Shumate x"20.00, Buc Drain $6.00. Alderman Bronson moved that the bills be allowed as approved a -7d the Clerk be instructed to draw warrantes for same upon the proper funds. The motion was seconded, by Alderman Peal and carried unanimously. The following reports for the month of December were presented; Clyde Walters as Builc ing Inspector, J. C. Massie as Polioe Judge, M. E. Hand as acting Chief of Police, Otc ;Phillips as City Collector and as City Clerk. Alderman Ucker moved that the reports be received and filed. The motion was seconded by Alderman Shook and was duly passed by the Council. Alderman Hosford of the Insurance Committee made a report as to the additional premium on pay roll liability as to rates etc. stating that classifications seemed to be regu- lar and recommending payment. Alderman Bronson moved that the report be accepted and the bill of $329.17 be paid. The motion was seconded by .Alderman Peal and received the entire vote of the Council present. An Ordinance was introduced by Alderman 9ronson entitled "An Ordinance prohibiting parking of certain motor vehicles in restricted zones, fixing penalties and for other purposes". The Clerk read the Ordinance the first time in its entirety. Alderman Ucker moved that the rules be suspended and the Ordinance be placed on its second reading. The motion was seconded by Alderman Carter and received the entire vote of the Council present. The Clerk then read the Ordinance the second time. Present Bills: r: 821 Alderman Sanders of the Street Committee reported relative to XX petition as to two hour parking limit on certain streets, and recommended that no change be made. Alder- man Carter moved that the report be accepted. Alderman Peal seconded the motion which received the unanimous vote of the Council. The Mayor called the attention of the Council to the fact that an amendment KKXT)5 to Ordinance No. 789 would be necessary to stop issuing free license to employes. After discussion Alderman Carter moved that the Clerk be instructed to comply with Section 10 of Ordinance 789 with regard to free license. Alderman Peal seconded the motion. On the Clerk's calling the roll the following vote resulted; Ayes; Bronson, Carter, Peal, Sanders, Nays; Hosford, Shook, Ucker. Absent, and not voting; Gregory. The Mayor declared carried as there were 4 Ayes and 3 Nays. A motion to adjourn made by Alderman Bronson and seconded by Alderman Hosford was duly passed by the Council and the. W, Shelley x'12.50, Republic Printing Co. $2.00, Coles Cafe $7.40, Lyle Allen $2.50, Ben Porter 517.50, Bud Collins $7.50, Emmett Boyd $6.75, Bill Wilcox $4.001 A. F. Shumate $'20,100, Montgomery -Ward $69.30. Alderman Bronson moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funds. The motion was seconded by Alderman Gregory and received the unanimous vote of the Council. The Ordinance now on its second reading was carried over till next meeting night. The Commissioners in Improvement Districts No. 38 & 39 notified the Council that a vacancy existed on the Board of Assessors of said Districts and requested that G. Co Smith be appointed to fill the vacancy. Alderman Carter moved that G. C. Smith be appointed assessor in Improvement Districts Ifo. 38 & 39 to fill existing vacancy. The motion was seconded by Alderman Bronson and carried unanimously. The motic was seconded by Alderman Peal, and received the unanimous vote of the Uouncil. k Ordinance entitled "An Ordinance prohibiting parking of certain motor vehicles in restricted zones, fixing penalties and for other purposes" on its second reading was discussed. Alderman Ucker made a motion seconded by Alderman Peal that the Ordinance be placed on its third and final reading. This motion was duly passed.by the Council and the Clerk read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance Pass," On the Clerk's calling the roll; the following vote resulted: Ayes: Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Nays: None. The Mayor declared the Ordinance passed as there were eight Ayes and no Nays. Alderman Gregory moved that the Emergency Clause be adopted. This motion was seconded by Alderman Carter and upon the Clerk's calling the roll the following vote resulted: Ayesl: Bronson,Carter, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Nays: None.
