Fayetteville City Council met in regular session Monday, December 13, 1937,
Present; Mayor A. D. McAllister, City Attorney Price Dickson, City Engineer C. E. Pierce, Alder.
men Bronson, Carter, Gregory, Hosford, Peal, Shook.. -'Absent; City Clerk Otoe Phillips,
Aldermen Sanders and Ucker. Alderman Bronson acted as Clerk.
Minutes of the regular meeting held December 6th, 1937, were read and approved.
Bills; The following bills were presented after their approval by Alderman Peal, Chairman of
the Auditing Committee; S. W. Bell Telephone Co. $58.18, Jackson Cafe 10.102 Dr Jas,
F. Lewis $3.00, N. W. Ark. Times --44.48, H. L. Tuck Super Service $y20.91, Salsbury Gen-
eral Shop $0.35, The Texas -Co. $4.00, Fayetteville Auto Supply Co. $1.90, Ed W. Powers
$2.00, Ben Porter.$17.50, A. F. Shumate $22.50, Willie Smith $2.00, H. L. Tuck Super
Service $1.68.. -Alderman Shook moved that the bills be allowed as approved and the Cler]
be instructed to draw warrants for same -upon the proper funds. The motion was seconded
by Alderman Carter and received the entire vote of the Council present.
ReportsI The following.reports for the Month of November were presented; J. C. Massie as Police
of Judge, M. E. Hand as Acting Chief of Police, Otoe Phillips as City Clerk and as Collec-
Officials;tor. Alderman Peal moved that the reports be received and filed. The motion was seconded
by Alderman Carter and received the entire vote of the Council present.
The matter of extra Police for the Pre -Xmas shopping rush was discussed. Alderman Gre
ory moved that the matter be left to the Mayor and Acting Chief of Police. The motion
was seconded by Alderman Carter and carried unanimously.

tion that the Mayor notify Mr. Hopson that the City of Fayetteville will entertain the
City Officials of Northwest Arkansas on Jan. 11th, 1938. The motion was seconded by

that the matter be referred to the Sewer Committee with instructions td) investigate and
report back Monday night. Alderman Hosford seconded the motion which was duly passed
by the Council.
The matter of a billing machine for the City Water Office was brought to the attention
of the Council.Mr. Hobson, Salesman, Mr. Bell, Auditor, and Mr. Cunningham of the Water
Office explained the need of such machine. After discussion the matter was deferred.

the Ordinance be placed on its second reading. The motion was seconded by Alderman

Carter, Gregory, Hosford, Peal, Sanders and Shook. Absent and not voting; Ucker. The
Mayor declared carried as there were 7 Ayes and no Nays. The Clerk then read the Ordi-
nance the second time. After discussion Alderman Bronson moved that the rules be furthe
suspended and the Ordinance be placed on its third and final reading. The motion was
seconded by Alderman Shook. On the Clerk's calling the roll the following vote resulted
Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook. Nays; None. Absent and
not voting; Ucker. The Clerk read the Ordinance the third and final time. The Mayor the

Alderman Gregory moved that the emergency clause be adopted. Alderman Peal seconded the
motion., On the Clerk's calling the roll the following vote resulted; Ayes; Bronson, Car
ter, Gregory, Hosford, Peal, Sanders, Shook, Nays; None. Absent and not voting; Ucker.
The Mayor declared carried as there were 7 Ayes and no Nays.

Ordinance No. 803,
An Ordinance to be entitled "An Ordinance to abolish the Board of Managers of the City
Water Plant and the several Water Improvement Districts operated in connection there-
with and for other purposes".
Whereas, a question has been raised as to the authority of the City Council to create
a Board of Managers for the purpose of operating and maintaining the City Water Plant
and the several Improvement Districts used in connection therewith and
Whereas, the validity of the Ordinancesof the City of Fayetteville creating said Board
of Managers has been questioned.
Now, therefore, be it ordained by the City Council of the City of Fayetteville, Ark-
ansas;
Section One; That the Board of Managers of the City Water Plant and the several Water
Improvement Districts in operation in connection therewith, be and said Board is here-
by abolished.
Section Two; All Ordinances and parts of Ordinances in conflict herewith are hereby
repealed and it appearing that under the statute said City Council has the authority
to operate said plant, an emergency is hereby declared and this Ordinance shall take
effect from and after its passage, approval and publication, and said City Council
shall take over and manage said plant from and after the effective date of this
Ordinance.

Alderman Sanders moved that the Council adjourn subject to call. The motion was second
ed by Alderman Bronson and duly passed by the Council and the Mayor declared the Coun-

Called Meeting,
Fayetteville City Council met Wednesday, December 22, 1937, in called session for
the purpose of selecting a Superintendent of the City Water Plant.

A number of applications were presented and considered. By mutual agreement the vote
was taken by secret ballot, the three la applicants receiving the most votes to be
balloted on again or until one applicant received a majority of the votes.
On the first ballot the following vote resulted; Edgar T. Brown 3, W. C. Smith 2,
F. A. Humphreys 1, Fletcher Thompson 1. On the second ballot the following vote re-
sulted; Edgar T. Brown 5, W. C. Smith 2.
Alderman Gregory moved that the election of Edgar T. Brown be declared unanimous.
Alderman Sanders seconded the motion which received the entire vote of the Council
present.
Alderman Sanders moved that the Water Committee and the City Attorney draw up terms
of.employment, listing duties for Superintendent and compensation therefor. The mo-
tion wqs seconded by Alderman Gregory and carried unanimously.
A motion to adjourn made by Alderman Bronson and seconded by Alderman Sanders was
duly passed by the Council and the Mayor declared the Council adjourned.
