Co., appeared before the Council urging the Council to employ more men on the police force and stating that a force of two men at night and two men on day duty could not adequately police a City of 10,000. No action was taken. Dr. Roy J. Turner, district health officer, and H. L. Woodward, district sanitarian, outlined plans for more extensive health and sanitation inspections in the City and County as soon as the Washington County full time new health unit is established. Both assured the Council thet they would work in co-operation with the City health officer. Sevier Fayetteville City Council met in regular session Monday, November 22, 1937, Protests; belonging to W. E. Bates and Fulbright Investment Co. were discussed. The Sewer Present; Mayor A. D. McAllister, City Clerk Otoe Phillips, City Attorney Price Dickson, City Eng - C. E. Pierce, Aldermen Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook and Ucker. this parcel be reduced to $50.00. Alderman Carter moved that the Committee recommenda- Commiss- Minutes of the regular meeting held November 15th, 1937, were read and apnroved. Bills; The following bills were presented after their approval by Alderman Peal, Chairman of Shelton the Auditing Committee; S. 111. Bell Telephone Co. x$59.96, Jackson Cafe $14.20, Emmett Claim; Boyd $$4.00,.Ben Porter $17.50,'A. F. Shumate $22.501, Alderman Bronson moved that the bills be allowed as approvedl and the Clerk be instructed to draw warrants for same upon Allowanc the proper funds. The motion was seconded by Alderman Carter and carried unanimously. Monthly T. E. Shelton be paid $$200.00 in full and final settlement for architechtural services Reprts; The following reports were presented for the month of October; Clyde Walters as Fire i Chief and as Building Inspector, J. C. Massie as Police Judge, M. E. Hand as Acting Driving Chief of Police, and Otoe Phillips as City Collector and as City Clerk. Alderman Greg- While ory moved that the reports be received and filed. Alderman Ucker moved that the Ordinance Committee draft XKX X34XK"X a legal Ordinance covering above Ordinances so that the Collector may be able to make collections. Alderman Sanders seconded the motion which carried unanimously. A motion to adjourn made by Alderman Sanders and seconded by Alderman Ucker was duly passed by the Council and the Mayor declared the Council adjourned. Attest; Approved; City C1 rk. Mayor. Fayetteville City Council met in regular session Monday, November. 29, 1937. Present;) Mayor A. D. McAllister, City Clerk Otoe Phillips, City Attorney Price Dickson, City F ineer C. E. Pierce, Aldermen Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Minutes of the regular meeting held November 22, 1931, were read and approved. Sevier I Protests against Benefit Assessments in Sewer District No. 1 on certain properties Protests; belonging to W. E. Bates and Fulbright Investment Co. were discussed. The Sewer Committee reported that on investigation they believed these properties equitably assessed with properties of like value with the exception of lots 3 &3A SW SW 16-16- 30 belonging to Phipps Lbr Co. and assessed at $200.00. The Committee recommended that this parcel be reduced to $50.00. Alderman Carter moved that the Committee recommenda- Commiss- tion be accepted and that the Phipps property be lowered to $50.00. Alderman Sanders ioners seconded the motion which carried unanimously. Shelton The Committee recommended that the report be received and filed and the Commissioners Claim; The Mayor stated that the Shelton claim for archibd�chtural services on City Admin- istration Building being a balance of $$375.00 could be settled in full for $200.00, Allowanc and avoid court procedure. After much discussion Alderman Gergory made a motion that for T. E. Shelton be paid $$200.00 in full and final settlement for architechtural services cars rendered the City. Alderman Peal seconded the motion. On the Clerk's calling the roll the following vote resulted; Ayes; Bronson, Gregory, Hosford, Peal, Shook, Ucker. Driving Nays; Carter, Sanders. Alderman Ucker moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funds. The motion was seconded by Alderman Hosford and carried unanimously. Commiss- ioners The final report of Improvement District No.81 was reported on by the Auditing Cmmittee Dist #31 The Committee recommended that the report be received and filed and the Commissioners be discharged. Alderman Bronson put this in the form of a motion which was seconded by Alderman Ucker and duly passed by the Council. Allowanc The matter of expenses allowed representatives when sent on City business was discussed for Alderman Ucker ved that 4� per mile be allowed for use of car when representative is cars sent on busin&gptrtaining to City affairs. Alderman Bronson seconded the motion which carried unanimo sly and the Mayor so declared. Driving While Alderman Gregory introduced an Ordinance entitled "An Ordinance prohibiting the opera - Drunk tion of vehiarles by persons under the influence of intoxicating liquor or narcotic drugs and prescribing penalties". The Clerk read the Ordinance the first time in its entirety. Alderman Bronson moved that the rules be suspended and the Ordinance be place on its second .reading. Alderman Ucker seconded the motion which was duly passed by the 314 eckless riving rd . Council and the Clerk read the Ordinance the second time. After discussion Alderman Ucker moved that the rules be further suspended and the Ordinance be placed on its third and final reading. Alderman Shook seconded the motion which was duly passed by the Council and the Clerk read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass". On the Clerk's calling the roll the following vote resulted; Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, Ucker. Nays; None. The Mayor declared the Ordinance passed as there were 8 Ayes and no Nays. Ordinance No. 8010 An Ordinance prohibiting the operation of vehicles by persons under the influ- ence of intoxicating liquor or narcotic drugs and prescribing penalties. Whereas, laws have been enacted by the State of Arkansas which set forth defi- nitions and prescribe penalties for the violation thereof, which definitions and penal• ties are at a variance with existing City ordinances and, W1Qereas, it it necessary that the Ordinances of the City of Fayetteville conform with State laws on the same subject. Now, therefore, be it ordained by the City Council of the City of Fayetteville, Arkansas; Section One; It shall be unlawful and punishable as provided in Section II of this Ordinance, for any person who is an habitual user of narcotic drugs or any per= son who is under the influence of intoxicating liquor or narcotic drugs to drive any vehicle within the corporate limits of the City of Fayetteville, Arkansas, Section Two; Every person who is convicted of a violation of Section I hereof, shall be punished by imprisonment of not less than ten days or not more than one year or by a fine of not less than $100.00 nor more than X4$1,000.00, or by both such fine and imprisonment; and upon a second and subsequent conviction, he shall be punished by imprisonment for not less than ninety days nor more than one ,year, and in the dis- cretion of the Court a fine of not more than $$1,000.00. Section Three; All ordinances or parts of ordinances in conflict herewith are hereby repealed, and this ordinance being necessary for the preservation of public safety shall be in full force and effect from and after its passage, approval and pub- lication� Approved; A. Alderman Carter seconded the motion. On the Clerk's calling the roll the following vote resulted; Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, Ticker. Nays; None. The Mayor declared carried as there were 8 Ayes and no Nays. Alderman Gregory introduced an ordinance entitled "An Ordinance defining reckless driving and prescribing the penalty". The Clerk read the Ordinance the first time in its entirety. Alderman Bronson moved that the rules be suspended and the Ordinance be placed on its second reading. Alderman Peal seconded the motion which was duly passed by the Council. The Clerk then read the Ordinance the second time. After discussion Alderman Peal moved that the rules be further suspended and the Ordinance be placed on its third and final reading. Alderman Ucker seconded the motion which was duly passed by the Council and the Clerk read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass". The Mayor declared carried as there were 8 Ayes and no Nays. Ordinance No. 802. An Ordinance defining reckless driving and prescribing the penalty. Whereas, laws have been enacted by the State of Arkansas which set forth def- initions and prescribe penalties for the violation thereof, which definitions and pen- alties are at a variance with existing City Ordinances; and Whereas, it is necessary that the ordinances of the City of Fayetteville con- form with State laws on the same subject. Now, Therefore, be it ordained by the City Council of the City of Fayetteville, Arkansas; Section One; Any person who drives any vehicle in such a manner as tib indicate a willful or a wanton disregard for the safety of persons or property is guilty of reckless driving. Section Two; Every person convicted of reckless driving shall be punished upon a first conviction by imprisonment for a period of not less than five days nor more than ninety days, or by a fine of not less than $25.00 nor more than $500.00, or by both such fine and imprisonment, and on a second or subsequent conviction shall be pun- ished by imprisonment for not less than ten days nor more than six months, or by a fine of not less than $50.00 nor more than $}1,000.00, or by both such fine and imprisonment. Section Three; All Ordinances or parts of Ordinances in conflict herewith are hereby repealed, and this Ordinance being necessary for the preservation of public safe ty shall be in full force and -effect from and after its passage, approval and publica- tion. Alderman Sanders of the Committee to contact Mr. McIlroy about the Stone Block nuisance reported on conditions in said Block and temporary corrections possible. The matter was carried over. Alderman Bronson moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper fund; The motion was sedended by Alderman Gregory and carried unanimously and the Mayor so declared. Fire Chief Clyde Walters made a report on the trip to Firemen's Training School at Little Rock, stating that the instruction received was of great importance and asking for some special equipment needed. Alderman Gregory moved that nedessary amount up to $50.00 be allowed for such equipment. Alderman Carter seconded the motion which carries unanimously. A letter from the State Highway Commission to E. P. Douglas, Resident Engineer, relati' to office rental in the City Administration Building was read. This letter stated that the Bureau of Public Roads will not approve for participation in Federal Funds rental charges for office space in buildings owned by political subdivisions. After discussio Alderman Carter moved that the City furnish office space, rental free, to the Highway Engineering Dep't. Alderman Gregory seconded the motion which carried unanimously. Alderman Bronson moved that the Council go into executive session. Alderman Shook sec- onded the motion which was duly passed by the Council and the Mayor declared the Counc in executive session. After discussion of various matters Alderman Gregory moved that the Council go out of executive session.. Alderman Sanders seconded the motion which wa duly passed by the Council and the Mayor declared the Council in regular session. The matter of Superintendent.for the City Water Plant was mentioned . By motion of Alderman sanders, seconded by Alderman Shook, and duly passed by the Council, the applications of Carl Smith, W. N. Gladsom, and W. J. Reynolds were ordered received and filed. No further business :Aderman Bronson moved to adjourn. The motion was seconded by Alderman Carter and received the entire vote of the Council present and the Mayor de- clared the Council adjourned.
