McAllister, City Clerk Utoe Phillips, City Attorney Price Dickson, City Engineer C. E. Pierce, Aldermen Bronson, Carter, Hosford, Peal, Sanders, Shook, and Ucker. Absent; Alderman Gregory. Minutes of the regular meeting held October 11th, 1937, were read and approved. Bills; The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee; S. W. Bell Telephone Co. $60.43, Jackson Cafe $`y1.90, H. W. Arm- strong 131.20, J. 0. Mayes Uro. $$1.18, Ross Seasly $2.50, Ben Porter $17.50, Emmett Boyd 16.75, H. L. Tuck Super -Service $34.03, Salsbury General Shop $1.00, Linkway Stores 2.36, A. F. Shumate $$20.00, H. L. Tuck Super -Service $4.68. Alderman Shook moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funis. The motion was seconded by Alderman Bronson and received the unanimous vote of the Council. Reports( The following reports i'or the Month of September ware read in their entirety by the Of Clerk; Clyde Walters as Building Inspector, J. C. Massie as Police Judge, M. E. Hand Officials;as Acting Chief of Police, and Otoe Phillips as City Collector and as City Clerk. By motion of Alderman Bronson, seconded by Alderman Peal, and duly passed by the Council, the reports were ordered received and filed. A Mr..Starns appeared before the Council relative to decorations for the White Way for Homecoming, stating that each unit or pole would cost ;12.00 and that the decorations would become the property of the Uity. He described the decorations in detail and said that the merchants of the City were contributing to the payment of this expense and asked the Council if they cared to assist in this cause. After discussion Alderman Car- ter moved that the City subscribe $24.00 or two units subject to the balance of expense being otherwise subscribed. Alderman Hosford seconded the motion which recdived the entire vote of the Council present and the Mayor so declared. Side -The matter of Sidewalks on the East side of Oakland Street between Maple and Douglas walks on was discussed•,at length. Alderman Hosford moved that the City order sidewalks put in Oakland; on the East side of Oakland Street between Maple Street and Douglas Street. The motion was seconded by Alderman Bronson and carried unanimously. The skating rink on West Dickson was again discussed. Alderman Ucker moved that the Mayor be authorized to offer to refund license fee if proprietor would stop operating. Alderman Hosford seconded the motion which received the entire vote of the Council -- — present and the Mayor so declared. Liability Insurance was discussed at length. Alderman Sanders made a motion that the Insurance Committee get rates on liability Insurance for the City Building and premises and report back next meeting night. The motion was seconded by Alderman Bronson and carried unanimously. The need for Special Police for Homecoming and Halloween was brought to the attention of the Council. After discussion Alderman Ucker moved that the Mayor furnish such ex- tra help as was deemed necessary for proper policAng of the City during Homecoming and Halloween. Alderman Peal seconded the motion which was duly passed by the Council. The need ^l' `''o tires for fire truck was brought to .the attention of the Council. Alderman &noon%:aoved that the Fire Committee investigate the matter and be given power to act. Alderman Ucker seconded the motion which received the entire vote of the Coun- cil. The Water Committee asked the Council to expfless their opinion as to the Dugger land in Wilson Hollow under consideration by the City Water. Plant. After much discussion Alderman Shook moved that the Water Committee be instructed to purchase Dugger land or surrender State deed in their posession. The motion vias seconded by Alderman Hos- ford and received the entire vote of the Council present. A motion to adjourn made by Alderman Hosford, sedonded by Alderman Carter was duly passed by the Council and the Mayor declared the Council adjourned. Attest; ( Approved; (if .�. City Jerk. Mayor. Pierce, Aldermen Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Minutes of the regular meeting held October 19th, 1937s were read and approved. Bills; The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee; Jackson Cafe $3.40, Harry Cooper Supply Co. $$2.26, E. W. Shu- ford $11.70, Fay Kennedy $2.00, Cleo Morris $4.00, Emmett Boyd $$8.00, Ben Porter $17.50 Ross Seasly $5.00, A. F. Shumate $$20.00. Alderman Carter moved that the bills be allow- ed as approved and the Ulerk be instructed to draw warrants for same upon the proper funds. The motion was seconded by Alderman Ucker and carried unanimously and the Mayor so declared. Shelton A bill for $375.00 claimed as balance due for architechtural services by T. E. Shelton Bill; was presented by C. Be Hill. The Building Committee reported that according to their understanding of the agreement with Mr. Shelton that the City does not actually owe Mr. Shelton any further money, but in order to effect a harmonious settlement recommended that he be aid an additional $125.00. After discussion Alderman Gregory moved that the sum of 125.00 be tendered T. E. Shelton as a compromise in full and complete settlement of disputed claim. The motion was seconded by Alderman Hosford. On the Clerk 310 calling the roll the following vote resulted; Ayes: Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Nays; None. The Mayor declared carried as there were 8 Ayes and no Nays. Mr. Givens of the American Legion appeared before the Council asking permission to op- erate a "bull pen" for the pupose of securing contributions for their Christmas Chari- ty fund. After discussion Alderman Sanders moved that this permis- sion be granted on Homecoming Day till 1 o'clock P M. Alderman Bronson seconded the mo- tion. On the question being put before.the Council the following vote resulted; Ayes: Bronson, Carter, Hosford, Peal, Sanders, Shook, and Ucker. Nays; Gregory. The Mayor de- clared carried as there were 7 Ayes and 1 Nay. The matter of special men to relieve McClellan and Burns three nights during Officers training school was brought to the attention of the Council. Alderman Gregory moved that the acting Chief of Police employ necessary men for this purpose. The motion was seconded by Alderman Shook and carried unanimously. The request of Coleman Shoe Store for parking an advertising truck 60 ft long in front of their store lengthwise on Oct. 29th was presented to the Council. After dis- cussion Alderman Ucker moved that this request be denied as to location, but that the Mayor and Acting Chief of Police meet with Mr. Coleman and select a less congested site for this parking. Alderman `eal seconded the motion which received the entire vote of the Council and the Mayor so declared. Alderman Bronson made a motion tha t the Ordinance Committee be instructed to draw up an Ordinance placing the East half of Block 10, Fergusons Addition in the Fire Zone, Alderman Ucker seconded the motion which carried unanimously. Alderman Ucker moved that the Street Cleaner be allowed two extra men and gas bill of $2.50 for the current week. Alderman Sanders seconded the motion which was duly passed by the Council. Car -Test= The Council having decided, after thoro investigation, that the City is not financiall ing able to purchase equipment and operate an Official car testing station, Alderman Greg - Station; ory made the following motion; that J. A. Adams and M. Ray Adams be recommended as ex- clusive operators of Official car -testing station under State Supervision as set forth in.letter of October 25th, 1937, to Gray Albright, Supt of State Police Dept. Alder- man Carter seconded the motion which carried unanimously. The letter follows. Mr. Gray Albright, Superintendent, Arkansas State Police Department, Little Rock, Arkansas. Dear Sir; The City of Fayetteville is not in position at this time to finance and operate an an official automobile testing station and hereby recommends that an exclusive permit be granted to Mr. J. A. Adams and M. Ray Adams of this City by your department if the plans and equipment meet with your approval. They have already advised us of their plans and we are satisfied that the operation of a station at the location selected and constructed in the manner indicated by them will not unduly congest traffic or create a hazardous condition. The City of Fayetteville assures the State Police Department its wholehearted co-oper- at or//in-the enforcement of the law which regulates and requires automobiles to be tested twice each year. The City Police at Fayetteville will cooperate with the State Police Department in this enforcement the same as if this testing station were oper- ated by the City itself. Otoe Philli s yClerke Alderman Hosford of the Insurance Committee reported that the Liability Insurance on the City Administration Building had been given to Cravens & Co. in order to somewhat equalize the amounts carried by the Companies operating in the City. Alderman Bronson introduced an ordinance entitled "An Ordinance creating and estab- lishing a Fire Zone including the East Half of Block Ten in Fergusons Addition to the City of Fayetteville". The Ordinance was -read in its entirety by the Clerk. Alderman :Ucker made a motion which was seconded by Alderman Carter that the rules be suspen- ded and the Ordinance be olaced on :its second reading. This motion was duly passed by the Council and the Clerk read the Ordinance the second time. Alderman Peal then made a motion thet the rulaes be further suspended and the Ordinance be placed on its third and final reading. The motion was seconded by Alderman Bronson and received the entire vote of the Council and the Clerk read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass". On the Clerk's calling the rol the following vote resulted; Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Nays; None. The Mayor declared the Ordinance passed as there were 8 Ayes and no Nays. V. Alderman Bronson moved that the Emergency Clause be voted on separately. Alderman Gregory seconded the motion which was duly passed by the Council. On the Clerk's call- ing the roll on the Emergency Clause the following vote resulted; Ayes; Bronson, Car- ter, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Nays; None. The mayor declared .carried as there were 8 Ayes and no X* Nays, Ordinance No. 800. An Ordinance to.be entitled "An Ordinance creating and establishing a Fire Zone inclu- ding.the East Half of Block Ten in Fergusons Addition to the City Of Fayetteville';. -Section One; Be it ordained by the City Council of the City of Fayetteville, Arkansas, .that there is hereby created and established a fire zone within the City of Fayette- ville, which zone.shall embrace and include the East Half of Block Ten in Ferguson's Addition to the City of Fayetteville, Arkansas. Section Two; Whereas it has been indicated that certain buildings of the type common- ly used for businesses exclusively are to be constructed on said above described prop- erty and thatsaid buildings should be constructed in a manner prescribed for build- ings built within the fire zone,.an emergence is hereby declared and this Ordinance shall take effect and be in force from and after its passage, approval and publica- tion. Alderman Bronson Moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same up- on the proper funds. The motion was seconded by Alderman Shook and received the unani- mous vote of the Council. 2 There being a vacancy on,the Board of Commissioners of "ater Improvement No. 2, a re- quest that Eugene Webb be appointed to fill this vacancy, signed by J. A. Peterson, Chairman, was presented. Alderman Sanders moved that Eugene Webb be appointed Commiss- ioner of Water Improvement District No. 2 to fill vacancy existing therein. Alderman Carter seconded the motion which carded unanimously and the Mayor so declared. V! A letter was read from Ed Poor relative to work on streets done by him and asking car license for same. Alderman Shook moved that the Street Committee investigate the matter with power to act, relative to paying Mr. Poor for work done on Street. Alderman Peal seconded the motion which was duly passed by the Council. The matter of extra help being needed in street cleaning due to falling leaves was dbscussed. Alderman Sanders moved that the Mayor be authorized to furnish sufficient help to street cleaner as long as needed. Alderman Ucker seconded the motion which re- ceived the entire vote cf the Council. C. Be Hill acting for T. Be Shelton, Architect, discussed Mr. Shelton's bill with the Council. No action was taken. No further business Alderman Bronson moved to adjourn.
