City Attorney trice Dickson, Alder- men Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Absent; City Engineer C. E. Pierce. Minutes of the regular meeting held July 6th, 1937, were read and approved. Bills; The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee; Lewis Bros Co. $400.07, Jackson Cafe $19.15, Mrs C. Be Paddock $10.00, University of Arkansas $6.00, Cravens & Co. •$,'108.861 Eason & Co. $120.75, Crescent Drug Store $0.76; Bohe Gro. $3.46, Ozark Gro. Co. $6.78, Jas Bohannon $12.00, Ben Porter $17.50, Salsbury General Shop $0.35, H. C. Trail $}10.00, Heerwagen Bras. $1.00 „A. F. Shumate $22.50. Alderman Sanders moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funds. The motion was seconded by alderman Hosford and received the unanimous vote of the Council, eports df The reports of Otoe Phillixs as City Clerk and as City Collector were presented. lerk &� Alderman Gregory moved that the reports be received and filed. Alderman Peal seconded ollect the motion which received the unanimous vote of the Council and the Mayor so declared. The matter of the Arkansas Municipal League meeting to be held in Little Rock July 15th and 16th was discussed. XXK It was suggested that the Mayor, City Clerk and City Attorney, with a Committeeof three appointed by the Liayor attend, with special refer- ence to investigating Automobile Inspecting Stations. Alderman Sanders put this in the form of a motion which was seconded by Alderman Peal and carried unanimously. The Mayor named as this Committee Ucker, Sanders and Gregory. No further business Alderman Bronson moved to adjourn. The motion was seconded by Alderman Carter and duly passed by the Council and the Mayor declared the Council adjourned. Reduce 1,.otor- Vehicle License lth inan c Alderman Ucker made a motion that the price on Motor Vehicles purdhased after July lst, or from new residents moving to the City be reduced 50%. This motion was seconded by AldermanAl osford and received the unanimous vote of the Council. Alderman Bronson introduced an ordinance entitled " An Ordinance to regulate the keepin of hogs,cattle, horses, mules, goats, ind fowls within the corporate limits of the City of Fayetteville, Arkansas, and for other purposes". The Clerk read the Ordinance the first time in its entirety. Alderman Sanders moved thiit the rules be suspended and the ordinance placed on its second reading. Alderman Carter seconded the motion which received the entire vote of the Council. The Clerk then read the Ordinance the second time. Aide -man Ucker moved that the rules be further suspended and the Ordinance be placed on its third and fir_a reading. alderman Hosford seconded the motion which received the unanimous voteo'the Council. The Clerk then read the Ordinance the third and final time. The I.Iayor put the question : "Shall the Ordinance pass". On the Clerk's calling the roll, the following vote resulted: Ayes: Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Nays: None. The Mayor declared the Ordinan passed as there were 8 Ayes and no Nays. ORDINANCE N6. 798. An Ordinance to be entitled " An Ordinance to regulate the keeping of Hogs, Czttle, Hors Io;ules, Goats and Fowls within the Corporate limits of the City of Fayetteville, Ark.and for other purposes"e e it ordained by the City Council of the City of Fayetteville, Arkansas: Section one: That hereafter it shall be unlawful for any person, persons, firm or cornoraF on to keep any pig or swine of any kind or description whatsoever within the corporate limits of the City of Fayetteville, Arkansas. Section two: Not more than two cattle, and their increase up to the age of three months shall tie kept on any one City lot within the corporate limits of the City of Fayettevi7 Arkansas,unless a minimum of one -half acre of space be provided each addtional cow. Section three :That hereafter it shall be unlawful to permit any cattle or horses to run at large or graze upon any of the streets or alleys within the- corporate limits of saic City of Fayetteville, Arkansas. .I =s,I le A I,inutes of theregular meeting held July 12th,1937 were read and approved. Alderman Bronson moved that the Judge, reports be received and filed. Alderman Peal seconded the motion which received the Chief & unanimous vote of the Council and the Mayor so declared. Section five: All stables, yards and enclosures where horses, cattle,mules, goats or owfIs are kept within the corporate limits of the City of Fayetteville, Arkansas, shall be kept free.from filth.and•shall.be maintained in a sanitary condition. Section six: By.sanitary condition is meant: Sub -division A. All manure when removed from the stalls of barns and stables must be collected and kept dry in bins completely enclosed on top, bottom and sides from the 1st., day of April until the T§t, dam of november of each year and must be kepu constantly screened from fillies;. Sub -division B. All manure bins shall be entirely emptied and thoroughly clean ed at least once per month. , Sub -division C. Droppings shall not be permitted to accumulte to the extent that it shall create breeiing places for"flies or' -..taint' -the a,tmos.- phere with odors. Section seven: That upon complaint of any person to the sanitary officer or City Health Officer or if either of them shall have reasonable grounds to believe that any person is violating any of the provisions of this Ordinance it shall become the duty of the Sanitary Police or the City Health Officer to at once inspect the premises of such owner or occupant, and if the stable, yard or enclosure of such premises are in a filthy and unsanitary condition, or if more than the prescribed number of cattle are being kept without sufficient space as herein provided,it shall be the duty of the sanitary officer or the City Health Officer to report the same to the -Police Court of the City of Fayetteville, which Court shall issue "a notice to the owner or,occupant of the house setting forth what grounds of this Ordinance have been violated and commanding that the terms of this ordinance be complied with within five days from the date of service of said notice, Section eight: Any person, persons, firm or corporation who fails or refuses to comply wit he provisio nsof this Ordinance after having been notified as herein provided shall be deemed guilty of a misdemeanor and upon conviction sh^_11 be fined in any -sum not exceeding Twenty-five Dollars($25.00), and each day the terms of this Ordinance are violated after the expiration of five days from the date of the service of notice as herein provided shall constitute a separate offense;and in addition to the fine herein provided,the Court may order an unsanitary condition abated, and may further order the removal, _from the corporate limits of the City of Fayetteville, /Arkansas,of such horses, cattle mules, goats or fowls as may have contributed to the unsanitary condition or a violation of the terms of this Ordinance. Section nine: Ordinances numberd 293,391, and 451 are hereby expressly repealed and all ordinances an parts of ordinances in conflict herewith be and the'same are herby repealed, and this ordinance being necessary for the preservation of the public health, peace and safety of the residents of the City of Fayetteville, an emergency is hereby declared and this ordinance shall„take effect and be in force from and after its passage, approval and publication. Alderman Gregory moved that a separate vote be taken on the Emergency Clause on the above Ordinance. Motion seconded•by Alderman Bronson. On the Clerks calling the roll the following vote resulted: Ayes: Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook and Ucker. Nays: None. The Mayor declared carried as there were eight Ayes and no'Naysl Report by Alderman Ucker on lots Vilest of City Buildia?g was given. The "Committee, Aldermen Sanders and Ucker and Mayor McAllister, appointed to attend the Arkansas Municipal League meeting in Little Rock, reported on this convention lm d on their inspection of three approved makes of testing equipment for officiallinspection of motor vehicles under the new State law. The matter of ammunition for the Police force was discussed by the Council. Alderman Hosford moved that the City Civil Service Commission be contacted in regard to this matter. Motion was seconded by Alderman Ucker and carried unanimously. Alderman Bronson moved that the Council go into Executive Session, seconded by Aldo Peal, and carried unanimously, and the Mayor declared the Council in Executive Session. - After discussion of various matters, Alderman Ucker moved that the Council go out of Executive Session. This motion was seconded by Alderman Gregory and duly passed by the Council, and the I,Iayor declared the Council out of Executive Session. A motion to adjourn made by Alderman Grep;ory and seconded by Alderman Peal received the unanimous vote of the Council, and the Mayor declared the Council adjourned. Attest:Approved — C1� Mayor. 1.
