McAllister, City Clerk Otoe Phillips, City Attorney Price Dickson, City Engineer C. E. Pierce, Aldermen Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Absent; Alderman Bronson. Minutes of the regular meeting held March 1st, 1937, were read and approved. Shumate y2.2.50� Alderman Sanders moved that the bills be allowed a- approved. and the Clerk be instructed to draw warrants for same upon the proper funds. Alderman Hosford seconded the motion which carried unanimously and the Mayor so declared. Old Air -I The matter of renting the old Airport property fo;, pasturage was discussed. A. C. Ucke port offered p75,00, and one Miller $50.00. Alderman Sanders moved that the offer of A. C. Rental; Ucker be accepted. Alderman Gregory seconded the motion which carried unanimously. No further business Alderman Hosford moved to adjourn. The motion was seconded by Alderman Ucker and duly passed by the Council and the Mayor declared the Council adjourned. Alderman Bronson moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper finds. The motion was seconded by Alderman Shook and carried unanimously and the Mayor so declared. of I The following reports for the Month of February were presented; Clyde Walters as Fire cials: Chief, J. C. Massie as Police Judge, Otoe Phillips as City Collector and as City Clerk Alderman Carter moved that the reports be received and filed. Alderman Peal seconded the motionwhich carried unanimously. The need of First Aid Kit and Tannic Acid Spray was presented X7§t to the Council by Fire Chief Clyde Walters, for the Fire Dept. After discussion Alderman Sanders made a motion that the Fire Chief be authorized to purchase these needed supplies. The mo- tion was seconded by Alderman Carter and received tho entire vote of the Council. Alderman Bronson introduced an ordinance entitled "An Ordinance to amend Sections One and Two of Ordinance No. 420 of the Ordinances of the City of Fayetteville, Ark- ansas", The Clerk read the Ordinance the first time in its entirety. Alderman Gregory moved that the rules be suspended and the Ordinance be placed on its second reading. Alderman Hosford seconded the motion which received tho entire vote of the Council. The Clerk then read the Ordinance the second time. Alderman Sanders moved that the rules be further suspended and the Ordinance be placed on its third and final reading. Alderman Bronson seconded the motion which carried unanimously. The Clerk then read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass". On the Clerk's calling the roll the following vote resulted; Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Nays; None. The Mayor declared the Ordinance passed as there were 8 Ayes and no Nays. Alderman Gregory moved that the Emergency Clause be voted on separately. Alderman Carter seconded the motio%, which carried unanimously. The vote on the fimergency Clause resulted in the following vote; Ayes; Bronson, Garter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Nays; None. The Mayor declared the Emergency Clause carried as there were 8 Ayes ard no Nays. The Ordinance follows on �t &W t. ASz 282 Deposit for Cutting Pavement etc. �t CY ;ity ector City Inspect- or Clyde "alters: Ordinance No. 795: An Ordinance to be entitled "An Ordinance to Amend Sections One and Two of Ordinance No. 420 of the Ordinances of the City of Fayetteville, Arkansas". Be it Ordained by the City Council of the City of Fayetteville, Arkansas; Section One; That Sections One and Two of Ordinance No. 420 of the Ordinances of the Cibty of Fayetteville, Arkansas, be amended so as to read as follows; "That hereafter it shall be unlawful for any person, firm or corPoration to dig into any paved or otherwise permanently improved. street within the corporate limit; of the City of Fayetteville, Arkansas, without first having filed with the City Engi- neer a written application for permission to dig into such street, and without having obtained from said City Engineer such permit: Provided that said City Engineer shall not under any circumstances issue such Permit until said applicant shall have depositec with the City Clerk a cash bond, for the purpose of guaranteeing the replacement of said street in as good condition as the same was in before the same was dug into by said applicant, which bond shall be in an amount not less than $50.00 nor more than p1,000.00 to be determined and fixed by said City Engineer. Provided further that the person, firm or corporation digging in said street shall repair said street at his own expense and under the direction and supervision of said City Engineer, and shall noti- fy said City "ngineer, prior to beginning such repair, of the time and manner of re- pair and obtain the approval of said City Engineer prior to the beginning of solid re- pair and afford said City Engineer the opportunity of being present during the Progress of said repair until completed. Provided further that when such repairing is completed and aoproved,by said City Engineer and paid for, then said City Engineer ::hall author- ize the City.Clerk to pay back to said applicant the sum so deposited by him, less a fee of X2.00, which amount is hereby fixed and allowed the City Engineer for his ser- vices in connection with his duties hereunder; and in the event said applicant shall fail, refuse or neglect to repair said street, then said. City Engineer may repair said street and deduct the costs of said repair from the amount which said applicant has on deposit with said City Clerk, and the balance of said deposit, if any, shall by said City Clerk, under the orders of said City Engineer, be paid to said applicant". Section Two; All Ordinances and parts of Ordinances in conflict herewith are hereby repealed and this Ordinance shall take effect and be in full force from and after its passage, approval and Publication. The matter of electing a City Inspector to succeed Oliver Lollar, resigned, was br.ough- to the attention of the Council. Hugh Rogers of Rogers Electric Co. urged the Council to select a permanent resident for the place in order to avoid too frequent changes. Alderman Bronson moved that the Council go into executive session. Alderman Shook seconded the motion which was duly passed by the Council and the Mayor declared the Council in executive session. After discussion of various matters Alderman Sanders moved that the Council go out of executive session. Alderman Hosfo.rd seconded the rmo- tion which was duly passed by the Council and the Mayor declared the Council in reg- ular session. Consideration was given applicants for the position of City Inspector. Alderman Greg- ory moved that Clyde Walters be appointed City Inspector, embracing the four inspector ships, namely, gas, electrical, plumbing and building. Alderman Hosford seconded the motion which carried unanimously and the ?;a•yor so declared. ''o further business Alderman Bronson moved that the Council adjourn.
