Alderman Sanders moved that the City Attorney go to Little Rock with Alderman Gregory,expenses paid,by the City, seconded by Alderman Hosford, and carrie unanimously. No further business, Alderman Ucker moved.to adjourn; seconded by Alderman Bronson, and carried unanimously. McAllister, City Clerk Otoe Phillips, City Attorney Price Dickson, City Engineer C. E. Pierce, Aldermen.; Bronson, Carter, Hosford, Peal, Shook, and Ucker. Absent; Alde_lmen Gregory and Sanders. Minutes of the regular meeting held October 12th, 1936, were read and approved. The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee; J. 0. Mayes Gro. $$0.25, Price Dickson, City Attorney, $2.40, Elmer Weir $7.50, James Bohannon $12.00, Ben Porter $$17.50, A. F. Shumate $2u.00. Alderman Ucker moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upbn the pr.opor funds. This motion was seconded by Alderman Hosford and carried innanimously. W. S. Duggan asked permission to cut pavement in front of the TelephoneCo. for water service connection:. Alderman Hosford moved that this permit be granted under supervision of the City Engineer. The motion was seconded by Alderman Carter and duly passed by the Council. A. C. Ucker asked permission to cut curb at St. Josephs Catholic Church on North Willow for drain tile. Alderman Bronson moved that this permit be granted under supervision of the City Engineer. The motion was seconded by Alderman Carter and redeived the entire vote of the Uouncil. The matter of utility bills for WPA Sewing Project was discussed at length. Alderman Peal moved that the City pay $10.00 per month thru the winter till April 1st, 1937, to apply on WPA Sewing Project utility bills. The motion was seconded by Alderman Bronson and received the entire vote of the Council present. No further busines§;'Alderman Bronson moved that the Council adjourn. Pierce, Aldermen; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Minutes of the regular meeting held October 19th, -1936, were read and approved. Shumate $20.00, The Automotive.110.56. Alderman Shook moved that the bills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funds. Alderman Hosford seconded the motion, which carried unanimously. The matter of Tax Levy for 1936 tax collections was brought before the Council. After discussion Aldermen Gregory of the Finance Committee moved that the following levy be made; 5 Mills for General Fund 1Q It It Fire " 1 it " Hospital " 3 it " City Bond " 1 It " Aviation Alderman Hosford.seconded the motion. On the Clerks calling the roll the following vote resulted; Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Nays; None. The Mayor declared carried as there were eight Ayes and no Nays. X65 Tax Levy 1936. To levSr taxes for the year 1936 upon the real and personal property within the Cor- porate Limits of the City of Fayetteville, Arkansas; Be it resolved by the City Council of the City of Fayetteville, Ark.; Section One; That the rate of taxes for CITY GENERAL FUND purposes, for the year 1936, be, and the same is hereby declared to be FIVE(5) MILLS on each dollar of assessed valuation of all real and personal property within the Corporate limits of the City of Fayetteville.. Ark* as shown by the assessment books for State and County purposes, and that the same is hereby levied; and the Mayor and the City Clerk are hereby su- thorized and directed to certify this levy to the County Clerk of Washington County, Ark., to the end that the same be placed on the tax books and collected with the State and County taxes. Section Two; That the rate of taxes for FIRE DEPARTMENT purposes, for the year 1936, be, and the same is hereby declared to be ONE AND ONE HALF(1j) MILLS on each dollar of assessed valuation of all real and personal property within the Corporate limits of the City of Vayetteville, Ark., as shown by the assessment books for State and County purposes, and the same is hereby levied; and the Mayor and the City Clerk are hereby authorized and directed to certify this levy to the County Clerk of Washington County, Ark., to the end that the same be placed on the tax books and collected with the State and County taxes. Section Three; That the sate of taxes for CITY HOSPITAL purposes, for the year 1936, b;, and the same is hereby declared to be ONE(1) MILL on each dollar of assessed val- uation of all real and personal property within the Corporate limits of the City of Fayetteville, Ark., as shown.by the assessment books for State and County purposes, and the same is hereby levied; and the Mayor and the City Clerk are hereby authorized and directed to certify this levy to the County Clerk of Washington County, Ark., to the end that the same be placed on the tax books and collected with the State and County taxes. Section Four; That the rate of taxes for the year 1936, for the purpose of paying FUNDING BONDS AND THE INTEREST THEREON be, and the same is hereby declared to be THREE(3) MILLS on -each dollar of assessed valuation of all real and personal property within the Corporate limits of the City of Fayetteville, Ark., as shown by the assess- ment books for State and County purposes, and the same is hereby levied; and the Mayor and the City Clerk are hereby authorized and directed to certify this levy to the County Clerk of Washington County, Ark., to the end that the same be placed on the tax books and collected with the State and County taxes. Gregory entitled "An Ordinance to be entitled "An ordinance to provide for additional regulations for the retail sale of beer and light wines, providing penalties for violation of said regulations, and for other purposes." The Ordinance was read in its entirety the first time. Alderman San- ders made a motion seconded by Alderman Bronson that the rules be suspended and the Ordinance be placed on its second reading. On the Clerk calling the roll the following vote resulted; Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, Ucker, Nays; None. The Mayor declared the motion carried and the Clerk then read the Ordi- nance the second time. Alderman Carter moved that the Ordinance be amended in Section Your to read "200 feet" instead of "one block" of any church or school in the resi- dential section. The motion was seconded by Alderman Ucker and carried unanimously. Alderman Bronson then moved that the rules be further suspended and the Ordinance be placed on its third and final reading. AldermanHosford seconded the motion which carri unanimously and the Clerk read the Ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass". On the Clerks Calling the roll the follow ing vote resulted; Ayes; Bronson, Carter, Gregory, Hosford, Peal, Sanders, Shook, and Ucker. Nays; None. The Mayor declared the Ordinance as passed as there were eight Ayes and no Nays. Ordinance No. 793, An Ordinance to be entitled "An Ordinance to provide for additional regulations far the retail sales of beer and light wines, providing penalties for violation of said regulations, and for other purposes; WHEAAS_;: Ordinance No. 760 does not provide proper 'gupervision for the retail sale of beer and light wines and for the revocation of licenses ror selling the same in the City of Fayetteville, and WHERRAS, It is necessary for additional restrictions tobe placed on the sale of the same.and to provide for revocation of licenses, THEREFORE, Be it ordained by the City Council of the City of Fayetteville: Section 1. It shall be unlawful for any person, firm corporation, or association to make false answers in any application to questions touching his qualifications for a permit to sell beer and light wines in the City of Fayetteville. \ 266 Section 2. It shall be unlawful to sell beer or light wines in any residence, or in any house or building used in part as a residence, or built onto, or is a part of any residence, provided, however, that this section shall not.apply to places of business where apartments. are locdLted over the same. Section 3. It shall be unlawful to sell or serve beer or light wines, or allow the same to be consumed, in any dance hall or place where dancing is carried on; and it shall be unlawful for dancing to be allowed in any place where beer or light wines are being sold, dispensed or served; and it shall be unlawful to sell beer or light wines in any place or building where there is a direct entrance allowing ingress or egress to any dance hall or place where dancing.is allowed. Provided, however, that no part of this section shall apply to private homes being used exclusively as such. Section 4. It.shall be unlawful to sell beer or light wines within 200 feet of any church or any public or parochial school in the residentidl section of the City of Fayetteville, The residential sectionoof the City of Fayetteville shall be any part of thldaCity that is outside of the fire zone as is now or may hereafter be fixed by the City Council, and the business section of the City of Fayetteville is that part of said City within the fire zone. Section 5. It shall be unlawful to sell beer or light wines in the residential section of the City of Fayetteville between the hours of 12:00 o'clock midnight and 7:00 o'clock in the morning, or to serve either or allow either to be con- sumed in a public place between those hours. Section 6. It shall be unlawful to sell beer or light wines to any person who is intoxicated at the time the sale is made. Section 7. It shall be unlawful for any person, firm, corporation, or association engaged in the retail sale of beer or light wines in the City of Fayetteville to allow any intoxicated person or persons to loiter in his place of business. Section 8. If any person, firm, corporation, or association engaged in the "sale of beer or light'wines in the City of Fayetteville shall allow any person or persons of dissolute character to loiter -in and around his place of business, or shall permit profane language therein, or loud or unnecessary noises, or Conduct his plape of business in any other way that is detrimental to the good morals of the community, or in such manner as to constitute a nuisance, or if the City Council shall find that any retail dealer in beer or light wines has made false answers to questions touching his qualifications.to sell the same, then the City Council shall revoke the license of such person, firm, corporation, or association to sell beer or light wines in the City of Fayetteville. Section 9. Nothing in this Ordinance shall.t?e construed as repealing any part of Ordinance No. 760, but this Ordinance isos all be supplemental thereto. Section 10. Any person, firm corporation,_or association violating section 1,2,3, 4,5,6, or 7 of this Ordinance shall be deemed guilty of a misdeameanor, and upom conviction shall be fined any sum of not more than Five Hundred Dollars (,$500.00) and'each days violation of said Ordinance shall constitute a separate offense, and in addition to such fine, it shall be the duty of theCCourt to revoke the license of anyone so convicted. Section 11. It being ascertained and found by the Fayetteville City douncil that the unregulated sale of beer and light wines -in the City of Fayetteville, constitutes a menace to the public peace, health, and safety of .the citizens of Fayetteville and requires the immediate passage of an ordinance to regulate and control sale of beer and light wines, an emergency is hereby declared to exist, and this Ordinance shall take and be in force from and after its passage, approval and publication: Attest: Otoe Phillips Approved: A.D. McAllister City Clerk Mayor 27 Published in Fayetteville Daily.Democrat Oct.7% 1936 Alderman Gregory moved that the emergency clause be voted on separately, seconded by Alderman Ucker and carried unanimously. The matter of heat for building for WPA Sewing Project was discussed. Alderman Car- ter moved that the City pay for heating. Alderman Ucker seconded the motion which received the entire vote of the Council. Acting Chief of Police M. E. Hand asked the Council to allow him 2 cars and 4 men to patrol the streets Halloween night. Alderman Peal put this in the form of a mo -1 tion which was seconded by .;'Aderman Hosford and carried unanimously. A possible saving to the City by buying sand and cement.in car lots.was discussed. Alderman Sanders made a motion that the Mayor and the City Engineer look into the matter and be given power to act. Alderman Pea]. seconded the motion which was duly passed by the Council. Alderman Gregory of the City,Planning Board and City Attorney Price Dickson gave reports on Municipal League meeting and State Firemen's meeting, respectively. Alderman Carter moved that the U. of A. be paid $57.60 for street oil as per state- ment. Alderman Hosfor.d seconded the motion,.which carried unanimously. No further business Alderman Shook moved to adjourn. Alderman Bronson seconded the motion whichwas duly passed by the Council, and the Mayor declared the Council adjourned.
