Fayetteville City Council met in regular session Mond y January 27,1936 7:30 P.M.
Present: Mayor A.D.McAllister, City Clerk, Otoe Phillips, City Clerk, City Attorney Rex Perkins.
Aldermen: Bronson, Bynum, Carter, Gregory, Peal., Sanders, Shook and Ucker.
Minutes of the regular meeting held January 20th,1936 were read and approved,
Bills: The following bills were presented after their approval by Alderman Peal, Chairman of
the Auditi.n� Committee: Ben Porter $$35.0.0; A. F. Shumate x$18.00; Jim Gibson $12.00;
Elmer Weir ,2.50; The Automotive x$.90; J W Shelley Y$6.75. Alderman Carter moved that
the bd.111s be allowed as approved, and the Clerk instructed to draw warrants upon the
properr funds. This motion was seconded byAlderman Bynum which received the unanimous
voteof the Council.
Jerpe'sIA letter from Jerpe Dairy Corporation protesting payment of 25.00 license on Produce
Letter:ffhouses, stating others were buying and selling were not paying. No action was taken.
Alderman Gregory introduced an Ordinance entitled "AN ORDINANCE DEDIC TING CERTAIN
LANDS LYING IN SECTIONS 9 and 16, TOWNSHIP 16 North,Range 30 West, to THE CITY OF
FAYETTEVILLE, ARKANS-S, FOR STREET PURPOSES,
The Clerk read the Ordinance the first time in its entirety. Alderman Sanders moved
that the -rules be suspended, and the Ordinance placed on its second reading. Alderman
Bynum seconded this motion which received the entice vote of the Council. The Clerk
then read the Ordinance the second time. Alderman Carter moved that the rules be
further suspended and the Ordinance placed on its .third and final reading. Alderman
Ucker seconded this motion which received the unanimous vote of the Council. The Clerk
then read the Ordinance the third and final time. The Hayor then put�the quest ion -"Shall
the Ordinance Pass". On the Clerk's calling the roll, the following vote resulted: Ayes
Aldermen: Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Nays: None.
The Mayor declared the Ordinance passed, as there were eight Ayes and no Nays.

N ORDINANCE ENTITLED AN ORDINANCE DEDICATING CERTAIN LANDS LYING IN SECTIONS 9 and 16
, TOWNSHIP 16 NORTH, RANGE 30 WEST, TO THE CITY OF FAYETTEVILLE, ARKANSAS, FOR STREET
PURPOSES.
BE IT ORDAINED"BY THE CITY COUNCIL OF,THE,CITY OF.FAYFETEVILIEE,ARKANSAS,
SECTION ONE" That the following described route of Highway Job 9,154, ovew Maple street
in Fayetteville, Arkansas, as follol3s, to wit: -
Starting at the quarter corner common to Sections 9 and 16, Township 16
North, Range 30 West run thence South 33.5 feet to a point on the centerline of Survey
Job 9154,Fayetteville, Overpass Road, said point being hereinafter designated as
Station 7} 52;thence North 84058' West 252 feet to Station 5} 00 for a point of
beginning.
Beginning at aforesaid Station bi•�:.'00 as located in the preceding
description run thence South 84058' East 430 feet to Station 9 t 30 end of the job.
The right of way widths conveyed for the hereinbefore described centerline
alignment are as follows, to wit:

SECTION TWO.; That all Ordinances and parts of Ordinances in conflict herewith are
thereby repealed.
TION THREE: Whereas, the convenience, welfare and safety of the traveling public
and that the route of the said Highway through the City of Fayetteville be changed
the route herein set forth and dedicated, an emergency is hereby declared to exist
this Ordinance being necessary for the preservation of the public peace, health
safety an emergency is hereby declared to exist and this Ordinance shall take effect
be in full force from and after its passage and publication.
Passed and approved by vote of eight (8) members of the City Council on

Alderman Gregory moved that the Emergency Ulause be voted on separately. Alderman
Shook seconded the motion and upon the question being put before the Uouncil,-the
following vote resulted: Ayes: Aldermen Bronson, Bynum, Carter, Gregory, Peal, ganders,
Shook and Ucker. Nays.: None. The Mayor declared the Emergency clause incorporated in
Ordinance No.790 by a separate vote on same.
Alderman Carter introduced the following Resolution:and moved its adoption:

BE IT RESOLVED BY THE CITY COUNCIL of Fayetteville, Arkansas, that A. D. McAllister
Mayor of Fayetteville, Arkansas, be and he is hereby authorized and directed, or n
in the name and behalf of the City of Fayetteville, Arkansas, to sign the name of said
City to that certain agreemer_t between the City of.Fayetteville and the Arkansas
State Highway Commission relative to the construction of Highway NO, 62 passed and
adopted the _day of January 1936,, by this Council.
Alderman Ucker seconded the motion for adoption of this resolution and upon the Mayor
putting the question before the Council, thefollowing voted: Ayes: Alderman Bronson,
Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Nays: None.The Mayor declared
carried.
AGREEMENT BY MUNICIPALITY OR POLITICAL
SUBDIVISION TO MAINTAIN HIGHWAYS IMPROVED UNDER
UNDER.EMERGENCY RELIEF NPROPRIATION.
1. The City of Fayetteville, State of Arkansas,hereinafter referred to as
City, and the Arkansas State Highway Commission, herein after referred to as the
Highway Department, hereby agree as follows:
2. That the said ':ity hereby requests the Highway Department to submit the
aforementioned project with recommendation that it be approved by the Secretary of
Agriculture, and agrees that if such project is approved and constructed by the Highway
Department and the Secretary of agriculture it thereafter, at its own cost and expense,
will maintain the project,including the repairs and maintenance of all bridges and
drainage structures, in a manner satisfactory to them, or their authorized representati
and will make ample provision each year for such maintenance.

The Mayor presented the matter of sending a representative to meeting of the State
Municipal League in Little Bock, January 28ml936. Alder:an Shook moved thRttthe City
send a representative, and that Alderman Gregory be the representative; seconded by
Alderman Bronson, and upon the question being put before the Council, carried unani-
mously.
Alderman Peal, Chairman of the Auditing Corrmittee reported that the recordsi;of
Douglas Street Improvement District No.1 had been audited and found correct. Alderman
Gregory moved th t the report be received and filed and the Commissioners dismissed,
seconded by Alderman Ucker, and received the unanmous vote of the Council.
Relative to Annex No.l Mount Nord Improvement District No.l, the Auditing Committe
reported that they were not able to finish their work as some of the papers were not
included, and that final report will be made later.

Alderman Bynum moved that this report be received and filed, seconded by Alderman
Shook and carried unanimously.

Alderman Bronson moved that the Council go into Executive Session, seconded by Alderman
Bynum and duly passed by the Cduncil. The Mayor declared the Council in Executive
Session. The Fire Fund overdraft was discussed at length.
Alderman Bronson moved that the Council go out of Executive Session, seconded by
Alderman Ucker, and carried unanimously; and the Mayor declared the Council out of
Executive Session.
There being no further business, Alderman Sanders moved.that the Council adjourn until
Wednesday January 29,1936, 7:30 P. M.

the Auditing Committee. Whereupon, Alderman Bronson made a motion seconded by Alderman
Ucker that the bills be allowed as approved, and the Clerk be instructed to issue
warrants upon the proper funds in payment of same. This motion received the entire
vote of the Council and the Mayor declared carried, and instructed the Clerk to issue

Mrs Sidney Rieff asked that her son, Sidney Jr., 15 years, be granted a permit to
drive automobile. Alderman Ucker moved that the permit be granted, same to be under
supervision of Chief of Police, seconded by Alderman Sanders and unanimously passed
( by the Council.

Alderman Bronson introduced an Ordinance entitled "AN ORDINANCE TO AMEND ORDINANCE
Number 789 of the City of Favettevile, Arkansas': The Clerk read the Ordinance the
first time in its entirety. Alderman Bynum moved that the rules be suspended and
Ordinance placed on its .second reading. Alderman Carter seconded this motion which
received the entire vote of the Council. The Clerk then read the Ordinance the second

placed on its third and final reading. Alderman Ucker seconded this motion wh ich
again received the unanimous vote of the Council. The Clerk then read the Ordinance

carried as there were eight Ayes and no Nays.

AN ORDINANCE TO AMEND ORDINANCE NUMBER 789 OF THE CITY OF FAYETTEV ILLE, ARKANSAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTP'i ILLF, ARKANSAS:
That Section One of Ordinance 789 of the City of Fa;Yetteville, Arkansas,be
and it is hereby amended to include the following sentence: That the maximum fee to b
charged to any truck, or truck and trailer, or tractor and trailer,is the sum of ($25.
Twentyfive-Dollars per .year.
This Ordinance being necessary for the immediate preservation of the public
peace, health and safety, an emergency is declared to exist, and this Ordi-nance shall
be in full force and effect from and of ter its passage, approval and publication.
