Ratliff and his inestimable services, we feel a deep and abiding regret. That we extend to Mrs Ratliff, Dean W, N. Gladson and other relatives our heartfelt sympathyand solace. That a copy of this Resolution be forwarded to his family, and that it be published in the Fayetteville Daily Democrat. Cit (erl� l"LaMa�� Y � Y The matter of filling the vacancy created by the dec ase of E. M. Ratliff, City Engineer, was brought to the attentidri of the Council by Mayor McAllister. The applications of William Carl Smith, and C. E. Pierce, present acting City Engineer were read by the Clerk. After discussion, Alderman Sanders moved that C. E. Pierce, be appointed to the office of City Engineer of the City of Fayetteville, Arkansas,the duties of which office he had been carrying on during the illness of'Mr. Ratliff. This motion was seconded by Alderman Bynum, and upon the question being put before the Gouncil resulted in the following vote: Ayes: Alderman Bronson, Bynum, Carter, Gregory, Peal, Sanders Shook and Ucker. Nays: None. The Mayor declared carried and C. E. Pierce pis:, appointed City Engineer. Clyde Walters, Fire Chief, broughtnto the attention of the Council, the need of a Booster pump tank and fittings for the Fire Department, which equipment can be bought at an approximate cost of $V5.00. After some discussion, Alderman Bronson moved that the Fire Chief be authorized to purchase this equipment at a cost not to -exceed $75.00. Alderman Peal seconded this motion which upon the roll call, resulted in the following vote: Ayes: Alderman Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Nays: None, The Mayor declared carried. There being no further business, Alderman Ucker moved to adjourn. An Ordinance entitled " An Ordinance providing for assessing and collecting a license Tax for the privilege of operating vehicles upon the Streets and'alleys4bf'_the City,of I Fayetteville, Arkansas; specifying the rates and terms; defining certain words, and for other purposes" left on its second reading was brought to the attention of the Council. After discussion,Alderman Sanders moved that the Ordinance be read the third and final .. time, Alderman Bronson seconded this motion and upon the question being put before the Council the following vote ppsulted: Ayes: Alderman Bronson, Bynum, Carter, Gregory, Peal, Sanders and Shoo '"n's"ent and not voting Alderman Ucker. Upon the Clerk's calling the roll, the following vote esulted: Ayes: Aldermen:Bronson, Bynum, Carter, Gregory, Peal, Sanders and Shoo c kWt and not voting Alderman Ucker, The Mayor declared carried as there were seven Ayes and no Nays. 0 RD INA NC E NUMBER 789. oe,, An Ordinance to be entitled " AN ORDINANCE PROVIDING FOR ASSESSING AND COLLECTING A LICENSE TAX FOR THE PRIVILEGE OF OPERATING VEHICLES UPON THE STREETS.AND ALLEYS OF THE CITY OF FAYEPTEVILLE, ARKANSAS: SPECIFYING THE RATES AND TERMS: DEFINING CERTAIN WORDS, ad for other purposes: Be it ordained by the City Council of the City of Fayetteville, Ark.: SECTION ONE:That a license tax for the privilege of operating vehicles on the Streets. - and Alleys of the City of Fayetteville,`�rkansas, are hereby assessed according to the following schedule,to wit; For each pleasure or, passenger Motor Car, per annum, ------------ 45.00 For each Motor -cycle, with or without side car,,per annum--------- 5.00 (over) i 1 r mmmmmm"Om -W 223 For each Truck, per each half ton capacity, per annum, ---------------- $5.00 for each horse-drawn vehicle, for hire, per annum,---- ............ --..-$5-.Oo For each vehicle hauling passengers for hire, per annum,---------- - $25.00 SECTION TWO: That the,License Tax assessed in Section one of this Ordinance applies and is intended to apply to all such vehicles owned by any citizen, resident, firm or corporation of the City of Fayetteville, Arkansas, and operated upon the streets or' alleys of said City. Also, said license Tax applies and is intended to apply to all such vehicles, owned by any person, persons,firm or corporation or organization doing business or performing its functions within the said City,if said vehicles gre operated upon the Streets or Alleys of said City, making deliveries to stores, shops, hotels, apartments,private residences or other places, carrying passengers for.hire, or operated merely as "pleasure" cars,£or riding from place to place. SECTION THREE:That the License Tax assessed in Section One of this Ordinance is for a period of one year only, said year beginning January lst,and ending December 31st, of each year, and is due on or before February 1st, of each year. If a vehicle subject to the License Ta)t as herp.in set forth, is purchased or otherwise acquired, after the first day of February, in any year,the License Tax ther�on,shall become due and payable within ten days from the date of purchase or acquiring. Proof of the said date shall be presented to the collector by the applicant for the license. SECTION FOUR: That if and when the City Council, by resolution duly adopted,shall so direct,the Mayor shall issue his proclamation,reducing the rates set forth in Section One of this Ordinance,and defining the terns upon which said reduction shall be made, and specifying the dates when such reduction,shall begin and end. SECTION FIVE: That the City Collector shall,issue no evidence of the payment of the License Tax herein assessed for a sum less than the annual license in force at the time of issuance. SECTION SIX: That upon the payment of the License Tax provided for in this Ordinance the City Clerk shall issue to the applicant a license plate, tag, or sticker, having thereon the name of the City and a serial number, and shall keep a record of the name of the applicant, a description of the vehicle, date of issuance, and the number of the plate, tag or sticker. SECTION SEVEN: That it shall be the duty.of the applicant above mentioned to cauhe to be prominently displayed upon the front of the vehicle, the plate, tag or sticker intended for that vehicle. SECTION EIGHT: Any person operating a vehicle subject to the provisions of this Ordinance, but not having displayed thereon, the license plate, tag or sticker,provid- ed for herein, and any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in any sum not less than One Dollar ($�00) nor more than Ten ($10.00) Dollars; and each day such violation shall be continued shall constitute a separate offense. SECTION NINE: The words "resident of the City of Fayetteville, Arkansas", for the Purpose o.f,this Ordinance means any person whose place of abode is within the limits ofsaid Oity; also any person, persons, firm, corporation or organization, owning or using a place of business, warehouse, office, factory or place of abode within the limits of said City. The above words shall not be construed to include bona fide students in the University of Arkansas, or in the Fayetteville Business College, nor visitors, nor tourists in the City for a period of less than three months, provided such students, visitors, and tourists do not engage in any gainful activities or i occupations within the City. SECTION TEN: That in consideration of the services rendered by officers serving the City, either by election or appointment; alsoall duly authorized employes who serve the City in the capacity.as a permanent. --.employe be and is hereby entitled to one tag, sticker, or plate 'Gratis" for his or,their personal car only. SECTION ELEVEN: That all Ordinances or parts of Ordinances in conflict herewith be,ad the same is hereby repealed. This Ordinance being necessrry for the immediate preser- vation of the public health,peace and safety, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after passage. approval and publication. Suttles asked that the house be moved to South end of lot with basement; also excavation for and moving of Filling Station. The Council felt that this was out of line and that the original proposition of Two hundred Fifty ($250.) Dollars net damage,as made by the Committee,should stand: There being no further business,Alderman Bronson moved to adjourn, which.motion was seconded by Alderman Gregoryand carried unanimously; and the Mayor.declared the Counc adjourned. Duggans Contractor, asking permission to cut paving on South Duncan street for the purpose of making a sewer connection for A. E. Lusky. Alderman Sanders moved that this request be granted to be done under supervision of City Engineer. This motion was seconded by Alderman Carter and received the unanimous vote of the Council. Dr. A. M. Harding, Chairman of the Board of Commissioners University Improvement Dist., No.l,appeared before the Council, stating that the District was paid out and all refund (made with the exception of $94.30 due,John Rich, whom they were unable to locate, and asking that the Commissioners be discharged. Dr. Harding read alletter from the Chancery Nudge relative to disposition of the $94.30 refund due John Rich. This letter suggested that the money be.turned over to the City Street Fund, to be held subject to the call of John Rich.,Alderman Gregory moved that this money be accepted and placed in the Street Fund, subject to call of John Rich,` and that the Commissioners be excused from further duties, when their final report has been�audited'and found correct. Alderman Sanders seconded this motion which/received thw.entire voteo£ the Council. Fire Chief. Clyde Walters appeared before the Council, stating that the town of Huntsville want ell uy two (2) usedlCh6raicalstanks belongint to the Fayetteville station. Alde anrmoved that this matter be referred to the Fire Committee and Fire Chief for further investigation and with power to act.
